Some proponents of the alternatives also say it will lead to attorneys being better prepared when they do begin practicing.<\/p>\n<p>The recommendations come after more than 1,000 new lawyers <a href=\"https:\/\/news.bloomberglaw.com\/business-and-practice\/over-1-000-new-lawyers-get-licenses-without-taking-bar-exam\">became licensed<\/a> over the past year without taking a bar exam, thanks to emergency pandemic programs in Utah, Washington, Oregon, Louisiana, and Washington, D.C.<\/p>\n<p>The <a href=\"https:\/\/willamette.edu\/news\/library\/2021\/06\/law-alternative-pathways.html\">recommendations<\/a> were delivered on Friday last week to the Oregon Supreme Court, which is set to consider them at a public meeting on July 7. The court \u2014 along with the Oregon State Bar \u2014 is currently accepting <a href=\"https:\/\/taskforces.osbar.org\/ate\/comments\/\">public<\/a> <a href=\"https:\/\/taskforces.osbar.org\/standard-setting-task-force\/comments\/\">comment<\/a> online up to the day before the meeting.<\/p>\n<p>The move came the same week the American Bar Association (ABA) released new <a href=\"https:\/\/www.americanbar.org\/content\/dam\/aba\/administrative\/legal_education_and_admissions_to_the_bar\/statistics\/20210621-bpq-national-summary-data-race-ethnicity-gender.pdf\">data<\/a> showing dramatic racial disparities in bar exam scores.<\/p>\n<p>In 2020, 87.65% of the white candidates taking a bar exam for the first time passed. Among first-time black candidates, 66.28% passed, and among first-time Hispanic candidates, 75.59% passed, according to the ABA\u2019s Section of Legal Education and Admissions to the Bar.<\/p>\n<p>In 2020, 17% who took the Oregon bar <a href=\"https:\/\/www.osbar.org\/admissions\/examresults_july2019.htm\">failed<\/a>. In 2016, the fail rate <a href=\"https:\/\/www.osbar.org\/admissions\/examresults_july2016.htm\">was<\/a> significantly more dismal at 42%.<\/p>\n<p>Oregon has required lawyers to pass a bar exam for 111 years, since 1910.<\/p>\n<p>Hans Bader, a longtime civil rights lawyer who served a stint in the federal Office for Civil Rights, said that while he can see the argument for getting rid of the bar exam, lawyers should be required to disclose to clients that they did not pass it.<\/p>\n<p>\u201cYou might still be able to learn these basics later, by being an apprentice in a law firm,\u201d Bader told The Daily Wire. \u201cSo I can see the argument that if you attended law school, and got a law degree, you should be allowed to practice law even if you couldn\u2019t pass the bar exam.\u201d<\/p>\n<p>However, he added, \u201cif someone like that is allowed to practice law, I think they should have to publicly disclose in advertisements or client solicitations that they didn\u2019t pass the bar exam, so prospective clients can take that into account, and realize that they are not the cream of the crop, in terms of lawyers.\u201d<\/p>\n<div dir=\"ltr\" readability=\"11.684210526316\">Bader also expressed his view that Oregon\u2019s law degree requirement should be <a href=\"https:\/\/truthonthemarket.com\/2011\/09\/20\/hans-bader-on-abolish-law-school-requirement-keep-the-bar-exam\/\">scrapped<\/a> before the bar exam, as the high cost is a more significant barrier for some people.
