He pivoted to delivery and created a pickup system in the Bamboo Club\u2019s parking lot for drive-through customers.<\/p>\n<p>When the second pandemic shutdown hit in July and outdoor dining spaces were allowed to open, Gallo spent thousands of dollars on renting and installing a large tent, tables, fencing and tiki-style decorations on that same parking lot to create the best outdoor tiki-bar experience for his customers.<\/p>\n<p>Business, finally, was starting to pick up, he said.<\/p>\n<p>On Thursday, California Gov. Gavin Newsom <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2020-11-19\/california-limited-stay-at-home-rules-covid-19-surge\">announced a third shutdown<\/a> prohibiting nonessential gatherings between 10 p.m. and 5 a.m. as another wave of the coronavirus sweeps through the country. The <a class=\"link\" href=\"https:\/\/www.latimes.com\/projects\/california-coronavirus-cases-tracking-outbreak\">state has reported an average of more than 10,000 new cases each day <\/a>over the last week.<\/p>\n<p>California has not experienced a daily case count this high since the outbreak began, even during the surge in the summer that stands as the state\u2019s deadliest period during the COVID-19 pandemic.<\/p>\n<p>This time, Gallo said he feels more prepared and a little less worried. But it doesn\u2019t feel any more fair.<\/p>\n<p>\u201cIn Long Beach in particular, I thought we were doing a good job,\u201d he said. \u201cAre these cases coming from outdoor dining? I don\u2019t think so.\u201d<\/p>\n<p>Like Gallo, other late-night restaurant and bar owners feel that the third pandemic shutdown is an unfair punishment that isn\u2019t getting to the root cause of the coronavirus surge. He had spent a lot of money, he said, on installing furniture and dividers for his outdoor patio space that was finally starting to show results.<\/p>\n<p>Now, Weiss said he\u2019ll have to cut his longtime employees\u2019 hours.<\/p>\n<p>\u201cI\u2019d rather not,\u201d Weiss said. \u201cThis was not ideal for any of us. This will cut off a good portion of our late-night sales.\u201d<\/p>\n<p>Weiss said he thinks his patrons will simply continue gathering at home.<\/p>\n<p>\u201cPeople still want to be social,\u201d he said. \u201cPeople are still going to go out and they\u2019re not going to be doing it at restaurants anymore. They\u2019ll be going to their houses.\u201d<\/p>\n<p>According to a <a class=\"link\" href=\"https:\/\/www.cdc.gov\/mmwr\/volumes\/69\/wr\/mm6936a5.htm?s_cid=mm6936a5_x\">U.S. Centers for Disease Control and Prevention report<\/a>, adults with positive coronavirus test results were about twice as likely to have reported dining at a restaurant than those who tested negative.<\/p>\n<p>One problem, researchers say, is that eating and drinking inevitably requires customers to remove their masks, which raises the risk of spreading the virus, especially during animated conversations. When patrons are drinking late into the night, they are more likely to let their guard down.<\/p>\n<p>While <a class=\"link\" href=\"https:\/\/blogs.sjsu.edu\/newsroom\/2020\/sjsu-celebrates-dr-anthony-fauci-with-william-randolph-hearst-award-virtual-event\/\">accepting an award<\/a> this week from San Jose State University, Dr. Anthony Fauci, the U.S. government\u2019s top infectious diseases expert, said that a policy of ordering bars and restaurants to close at an earlier time has helped to control the pandemic in other countries.<\/p>\n<p>\u201cWhen you look at what happens as you get late into the evening, people let down their guard, people maybe drink a little bit too much, people get in congregate settings,\u201d Fauci said. He said it was sound to shorten such business hours to control the pandemic.<\/p>\n<p>Corissa Hernandez, owner of Xelas in Boyle Heights and the newly opened Nativo in Highland Park, said she implemented the rules early after hearing the announcement.<\/p>\n<p>She\u2019s aware that the virus has disproportionately affected Black and Latino lives in communities such as Boyle Heights, so she takes her community\u2019s safety seriously, she said.<\/p>\n<p>\u201cKeeping the community safe is of utmost importance to us,\u201d she said. \u201cIf it means shutting down, I\u2019m OK with that as long as it\u2019s across the board and it\u2019s fair.\u201d<\/p>\n<p>But Hernandez feels that the way Newsom and local government have arrived at decisions to implement new rules excludes business owners who are in the trenches doing their best to salvage their businesses and local economies.<\/p>\n<p>She also feels the rules implemented so far haven\u2019t been enforced fairly, and she said she would have liked to see local business owners have a say in the decisions made across the state and county.<\/p>\n<p>\u201cThe communication needs to be more clear and not as insensitive as it has been,\u201d she added. \u201cTwo days\u2019 notice does not take into consideration the inventory we spent, the costs of labor, the real jobs affected.\u201d<\/p>\n<div class=\"enhancement\">\n<div class=\"promo-wrapper\">\n<div class=\"promo-title-container-dupe\">\n<p class=\"promo-title\"><a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2020-11-19\/california-covid-19-cases-new-weekly-record-amid-spike\">L.A. Newsom<\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>If restaurants are being forced to close early, she said, local officials should find ways to enforce social distancing in homes and private parties that go unregulated.<\/p>\n<p>\u201cMy neighbors just the other night threw a 70-person party until 3 a.m.,\u201d she said. \u201cUnfortunately we\u2019re not all playing fair and [business owners] are the ones who pay the price.\u201d<\/p>\n<p>In another punch for restaurant owners, Newsom\u2019s restrictions come on the heels of revelations <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2020-11-16\/gavin-newsom-apology-french-laundry-dinner-covid-19\">he and his wife joined a party for a friend-lobbyist<\/a> at the swanky French Laundry restaurant in Napa, and <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2020-11-18\/newsom-french-laundry-dinner-explanation-photos-jason-kinney-california-medical-association-covid-19\">was photographed there without a mask<\/a>.<\/p>\n<p>\u201cI don\u2019t disagree with Newsom and how he\u2019s handled things,\u201d Gallo said. \u201cBut the \u2018Do as I say and not as I do\u2019 [mentality], I don\u2019t like that. You should be following the guidelines.\u201d<\/p>\n<p>\u201cIt\u2019s disappointing,\u201d Hernandez said. \u201cI believe in selecting leadership that looks out for BIPOC business owners.
