Here is a guide to understanding his most common gun control myths.<\/p>\n<p><strong>Is it true that gun shows don\u2019t require background checks?<\/strong><\/p>\n<p>\u201cMost people don\u2019t know: If you walk into a store and you buy a gun, you have a background check. But you go to a gun show, you can buy whatever you want and no background check,\u201d Biden <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/04\/08\/remarks-by-president-biden-on-gun-violence-prevention\/\">said<\/a> on April 8.<\/p>\n<p>But Joe Biden <a href=\"https:\/\/quoteinvestigator.com\/2018\/11\/18\/know-trouble\/\">shouldn\u2019t know this<\/a>, either, because it\u2019s false. Federal law r<a href=\"https:\/\/www.foxnews.com\/politics\/how-do-gun-background-checks-work-a-look-at-the-current-system\">equires<\/a> any gun seller who holds a Federal Firearms License (FFL) to conduct a background check on the would-be buyer before completing the purchase, regardless of where the sale takes place. That includes gun shows.<\/p>\n<p>Private individuals may sell firearms to people who live in their own state without a background check \u2014 but FFL holders may also \u201c<a href=\"https:\/\/www.atf.gov\/firearms\/docs\/guide\/facilitating-private-sales-federal-firearms-licensee-guide\/download\">facilitate<\/a>\u201d private sales by <a href=\"https:\/\/www.atf.gov\/rules-and-regulations\/docs\/ruling\/atf-proc-2020-2-%E2%80%93-recordkeeping-and-background-check-procedure\/download\">performing<\/a> background checks, if one of the parties requests it. A survey funded by a <a href=\"https:\/\/www.influencewatch.org\/non-profit\/fund-for-a-safer-future\/\">gun control organization<\/a> found that <a href=\"https:\/\/www.acpjournals.org\/doi\/10.7326\/M16-1590\">nearly 80%<\/a> of all gun sales in the previous year included a background check.<\/p>\n<p>Aside from federal mandates, 16 states and the District of Columbia require background checks on all firearms sales as of this writing, <a href=\"https:\/\/giffords.org\/lawcenter\/gun-laws\/policy-areas\/background-checks\/universal-background-checks\/\">according<\/a> to the Giffords Law Center to Prevent Gun Violence.<\/p>\n<p><strong>What is the truth about the \u2018Charleston loophole\u2019?<\/strong><\/p>\n<p>Biden cited another frequent gun ownership myth on April 8, according to the White House transcript: the co-called Charleston loophole. \u201cIf the FBI hasn\u2019t com- \u2014 didn\u2019t complete the background check within three days \u2014 There\u2019s a process.&nbsp; If wasn\u2019t done in three days, according to Charleston loophole, you get to buy the gun. [The Charleston shooter] bought the gun and killed a hell of a lot of innocent people.\u201d<\/p>\n<p>Under federal law, FBI background checks must be completed within three days; if they are not, the seller <em>may<\/em> (but does not have to) proceed with the sale. But the Charleston church shooter procured a weapon despite the fact that he had been <a href=\"https:\/\/www.factcheck.org\/2016\/02\/clintons-charleston-loophole-claim\/\">listed<\/a> (erroneously) as a felony drug user, something not uncovered for months after the purchase. Rather than exposing the incompetence of the federal bureaucracy, gun control advocates say this proves the federal government should be given more authority over law-abiding citizens\u2019 self-defense choices. And rather than tell federal employees to speed the process up, a proposal from Rep. James Clyburn (D-SC) would <a href=\"https:\/\/thehill.com\/homenews\/house\/541227-clyburn-reintroduces-legislation-to-close-the-charleston-loophole\">extend<\/a> the period to 10 days.<\/p>\n<p>In reality, the background check would likely <em>not <\/em>have prevented the purchase of the firearm used in the Charleston shooting, because the shooter had been charged with a misdemeanor, not a felony. Whether drug possession would have been enough to keep a gun out of his hands is legally <a href=\"https:\/\/www.thetexastrialattorney.com\/blog\/can-you-buy-gun-misdemeanor-drug-charge\/\">ambiguous<\/a>.<\/p>\n<p>Biden also ignores that a sale does not end the federal government\u2019s jurisdiction over firearms. If the federal government finds an applicant violated its background criteria <em>after<\/em> the three-day window, the ATF can issue a retrieval order authorizing federal agents to stop the sale \u2014 or remove the firearm from its owner\u2019s home. The ATF issued <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2017\/12\/04\/exclusive-feds-issue-4-000-orders-seize-guns-people-who-failed-background-checks\/901017001\/\">4,000 gun retrieval orders<\/a> in 2016 alone. Agents successfully retrieve approximately 93% of all firearms involved in such transactions.<\/p>\n<p><strong>Do gun manufacturers have \u2018absolute immunity\u2019 from lawsuits?<\/strong><\/p>\n<p>In 2020, candidate Biden sought to contrast himself with the surging campaign of Senator Bernie Sanders (I-VT) by highlighting Sanders\u2019 onetime pro-gun voting record. During a Democratic presidential primary debate last February 25, Biden <a href=\"https:\/\/www.usatoday.com\/story\/news\/factcheck\/2020\/07\/18\/fact-check-joe-biden-botched-stats-covid-gun-deaths\/5461700002\/\">said<\/a> Sanders \u201cand others have in fact also gave in to the gun manufacturers\u2019 absolute immunity. Imagine if I stood here and said we give immunity to drug companies, we give immunity to tobacco companies. That has caused carnage on our streets.\u201d<\/p>\n<p>The firearms industry does <em>not <\/em>have absolute immunity from all lawsuits. Biden referred to Sanders\u2019 yea vote on the 2005 <a href=\"https:\/\/www.congress.gov\/bill\/109th-congress\/senate-bill\/397\/text\">Protection of Lawful Commerce in Arms Act<\/a> (PLCAA), which prevents lawyers from filing ludicrous nuisance lawsuits against the gun <em>manufacturer<\/em> or <em>seller <\/em>because their product was used illegally in a shooting. But the PLCAA <a href=\"https:\/\/fas.org\/sgp\/crs\/misc\/R42871.pdf\">still allows<\/a> firearms companies to be sued for six infractions:<\/p>\n<ul>\n<li>if an injury occurred due to a defective product. (For instance, Sig Sauer has been <a href=\"https:\/\/www.military.com\/daily-news\/2021\/02\/19\/sig-sauer-faces-10-million-lawsuit-over-p320-pistol-after-alleged-accidental-discharge-wounds.html\">sued<\/a> multiple times over injuries caused by an allegedly defective trigger in the P320 handgun);<\/li>\n<li>if the seller or manufacturer is guilty of a breach of warranty or contract;<\/li>\n<li>if an FFL-holder knowingly broke the law by selling a firearm to someone not legally allowed to own one;<\/li>\n<li>if a seller or manufacturer negligently entrusted a firearm (s)he knows is likely to be used in a crime (e.g., a <a href=\"https:\/\/www.atf.gov\/firearms\/dont-lie-other-guy\">straw purchase<\/a>);<\/li>\n<li>if a gun dealer or manufacturer broke truth in advertising laws or knowingly marketed firearms to someone not legally permitted to possess them; or<\/li>\n<li>if a gun dealer or manufacturer broke existing gun law, specifically the 1968 Gun Control Act and the 1934 National Firearms Act.<\/li>\n<\/ul>\n<p>Federal lawmakers have conferred limited immunity on industries besides firearms manufacturers. For instance, social media platforms like Twitter cannot be sued for material posts on their platform thanks to protections contained in <a href=\"https:\/\/www.congress.gov\/bill\/104th-congress\/senate-bill\/652\/text\">Section 230<\/a> of the 1996 Communications Decency Act, which then-Senator Biden <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_lists\/roll_call_vote_cfm.cfm?congress=104&amp;session=1&amp;vote=00268\">voted for<\/a>, <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_lists\/roll_call_vote_cfm.cfm?congress=104&amp;session=2&amp;vote=00008\">twice<\/a>.<\/p>\n<p><strong>Do \u2018red flag\u2019 laws reduce suicide?<\/strong><\/p>\n<p>Again on April 8, Biden said, \u201cStates that have red flag laws have seen a reduction in the number of suicides in their states.\u201d<\/p>\n<p>So-called \u201cred flag laws\u201d \u2014 technically known as <em>Extreme<\/em>&nbsp;<em>Risk<\/em>&nbsp;<em>Protection<\/em>&nbsp;<em>Orders<\/em> (ERPOs) \u2014 allow law enforcement officers to remove firearms from people who legally possess them if officials deem them a risk to themselves or others. The person claiming erratic behavior may be anyone from a police officer or doctor to a disgruntled relative, and not every state gives the accused the right to defend themselves <a href=\"https:\/\/www.pewtrusts.org\/en\/research-and-analysis\/blogs\/stateline\/2019\/09\/04\/red-flag-laws-spur-debate-over-due-process\">in court<\/a>.<\/p>\n<p>But do they <em>work<\/em>? So far, the answer is \u201cunclear\u201d and \u201cinconclusive,\u201d <a href=\"https:\/\/www.rand.org\/research\/gun-policy\/analysis\/extreme-risk-protection-orders\/suicide.html\">according<\/a> to a 2020 study from the RAND Corporation. Although RAND deemed the results of Indiana\u2019s [red flag] law \u201csuggestive\u201d of a possible suicide reduction, the authors concluded, \u201cwe find inconclusive evidence for the effect of extreme risk protection orders on total and firearm suicides.\u201d<\/p>\n<p><strong>Were there 150 million \u2018gun deaths\u2019 in 13 years?<\/strong><\/p>\n<p>In 2020, then-candidate Biden inflated the number of gun-related deaths to unimaginable levels. Since assuming office, that number has continued to rise. \u201cThrough the first five months of 2021, gunfire killed more than 8,100 people in the United States, about 54 lives lost per day,\u201d according to a Washington Post <a href=\"https:\/\/www.washingtonpost.com\/nation\/2021\/06\/14\/2021-gun-violence\/\">analysis<\/a>. \u201cThat\u2019s 14 more deaths per day than the average toll during the same period of the previous six years.\u201d<\/p>\n<p><strong>Can you own a machine gun?<\/strong><\/p>\n<p>In a February 2020 campaign stop, candidate Biden <a href=\"https:\/\/www.washingtonexaminer.com\/news\/no-way-an-ak-47-is-going-to-take-care-of-you-biden-dismisses-founding-father-quote-on-militias\">told<\/a> the crowd, \u201c\u201dYou can\u2019t own a machine gun \u2026 no matter how much money you have.\u201d Under the Constitution, politicians \u201ccan limit the kinds of weapons that are able to be owned.\u201d<\/p>\n<p>You actually <em>can <\/em>own a machine gun to this day, but it<a href=\"https:\/\/rocketffl.com\/who-can-own-a-full-auto-machine-gun\/\"> takes a lot of work<\/a>. <a href=\"https:\/\/www.atf.gov\/firearms\/qa\/may-machine-guns-be-transferred-one-registered-possessor-another\">According<\/a> to the ATF, private citizens may own an automatic weapon if \u201cthe machine gun was lawfully registered and possessed before May 19, 1986,\u201d and the individual meets all the conditions stipulated in <a href=\"https:\/\/www.atf.gov\/file\/61546\/download\">Form 4<\/a> \u2014 including being a legal U.S. citizenship with a clean criminal record who is not addicted to any illegal drug (including marijuana). The background check takes an estimated <a href=\"https:\/\/rocketffl.com\/who-can-own-a-full-auto-machine-gun\/\">9-12 months<\/a>; it requires a $200 tax (which Biden would <a href=\"https:\/\/www.atr.org\/bidens-atf-pick-wants-200-gun-tax\">like to apply<\/a> to semi-automatic rifles and magazines that hold more than 10 rounds); it will not be approved if <a href=\"https:\/\/giffords.org\/lawcenter\/gun-laws\/policy-areas\/hardware-ammunition\/machine-guns-50-caliber\/\">state or local law<\/a> prohibit ownership of a machine gun; and a used machine gun typically sells for $10,000 or more. \u201cMachine guns covered by the<a href=\"https:\/\/www.atf.gov\/firearms\/qa\/which-firearms-are-regulated-under-nfa\">&nbsp;1934 National Firearms Act<\/a>&nbsp;have never been used in a mass shooting in America,\u201d <a href=\"https:\/\/gunsandamerica.org\/story\/18\/12\/20\/automatic-weapons-are-legal-but-it-takes-a-lot-to-get-one-of-the-630000-in-the-u-s\/\">noted<\/a> the Guns and America Project, an <a href=\"https:\/\/gunsandamerica.org\/about\/\">initiative<\/a> of multiple taxpayer-funded public media stations.<\/p>\n<p><strong>Has the Second Amendment always regulated who can own guns, and limited the kinds of weapons they can own?<\/strong><\/p>\n<p>\u201cThe Second Amendment, from the day it was passed, limited the type of people who could own a gun and what type of weapon you could own. You couldn\u2019t buy a cannon,\u201d <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/06\/23\/remarks-by-president-biden-and-attorney-general-garland-on-gun-crime-prevention-strategy\/\">said<\/a> President Biden on June 23.<\/p>\n<p>This is both <a href=\"https:\/\/www.dailywire.com\/news\/fact-checking-joe-bidens-misleading-second-amendment-claims\">true and false<\/a>. It\u2019s false that the Second Amendment forbade private citizens from owning a cannon (or any other kind of weapon). The first federal gun control law came&nbsp;<a href=\"https:\/\/time.com\/5169210\/us-gun-control-laws-history-timeline\/\">with the 1934 National Firearms Act<\/a>, which <a href=\"https:\/\/www.atf.gov\/rules-and-regulations\/national-firearms-act\">restricted, regulated, and registered<\/a> certain classes of firearms and accessories. Private citizens could, and did indeed, own cannons in the revolutionary era. On the other hand, many laws have \u201climited the type of people who could own a gun,\u201d particularly black Americans (whether <a href=\"https:\/\/thehill.com\/blogs\/pundits-blog\/civil-rights\/347324-the-racist-origin-of-gun-control-laws\">free<\/a> or <a href=\"https:\/\/www.shsu.edu\/~jll004\/vabeachcourse_spring09\/bacons_rebellion\/slavelawincolonialvirginiatimeline.pdf\">slave<\/a>) and <a href=\"https:\/\/www.google.com\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=&amp;ved=2ahUKEwj43rHOiLHxAhUDVc0KHcVMBZoQFjAAegQIAxAD&amp;url=https%3A%2F%2Fangela-riley.squarespace.com%2Fs%2FRiley-Indians-and-Guns.pdf&amp;usg=AOvVaw0FHaBgzpj8hGK8Jk3ynH-z\">American Indians<\/a>.
