They must have been cheating.\u201d<\/strong><\/li>\n<li><strong>The former ATF agent reported Chipman\u2019s comments to the Equal Employment Opportunity Commission, according to Jones.\u00a0<\/strong><\/li>\n<\/ul>\n<p>A conservative watchdog group filed a Freedom of Information Act lawsuit Tuesday for records that could shed light on an incident in which President Joe Biden\u2019s nominee to lead the Bureau of Alcohol, Tobacco, Firearms and Explosives allegedly made a derogatory comment about black agents.<\/p>\n<p>The pro-gun control nominee, David Chipman, told Sen. Ted Cruz in writing that he received two Equal Employment Opportunity Commission (EEOC) complaints during his 15 years as a manager with the ATF. Chipman said the complaints were \u201cresolved without any finding of discrimination and no disciplinary action was taken against me.\u201d<\/p>\n<p>Chipman added that his ATF personnel file is under the control of the federal government, but he did not answer when asked if he would be willing to provide his file to the Senate Judiciary Committee. The ATF declined to comment to the DCNF.<\/p>\n<p>Tom Jones, the president of the American Accountability Foundation, said he filed two FOIA requests with the ATF in May requesting records related to any complaints and disciplinary measures taken against Chipman during his 25-year tenure with the agency. The AAF\u2019s lawsuit said the ATF failed to produce the records in the timeframe allotted by the law, despite Chipman\u2019s acknowledgment in his written statement to Cruz that the federal government has control of his personnel file.<\/p>\n<p>Jones said AAF\u2019s FOIA <a href=\"http:\/\/wordpress.bidennoms.com\/wp-content\/uploads\/2021\/06\/D.D.C.-21-cv-01669-dckt-000001_000-filed-2021-06-22.pdf\">lawsuit<\/a> could produce records related to an incident around 2007 in which Chipman allegedly made a derogatory comment about black ATF agents performing too well on a selection exam.<\/p>\n<p>Jones told the Daily Caller News Foundation he spoke with a former ATF agent who personally witnessed Chipman making the derogatory comment after reviewing results for candidates who had passed an assessment to become an assistant special agent in charge.<\/p>\n<p>Jones said the former ATF agent recalled Chipman saying: \u201cWow, there were an unusually large number of African American agents that passed the exam this time. They must have been cheating.\u201d<\/p>\n<p>According to Jones, the former ATF agent was \u201cincensed\u201d upon hearing Chipman\u2019s comment and reported the incident to the EEOC.<\/p>\n<p>Chipman was the assistant special agent in charge of the Detroit Field Division at the time he allegedly made the derogatory comment.<\/p>\n<p>The DCNF\u2019s attempts to reach the agent who reported Chipman\u2019s comments to the EEOC were unsuccessful.<\/p>\n<p>Another former ATF agent who worked in the Detroit office at the time told the DCNF that Chipman\u2019s alleged comments about African Americans \u201cspread like wildfire at the agency.\u201d<\/p>\n<p>The former Detroit-based ATF agent, who wished to remain anonymous out of fear of retaliation, did not personally witness Chipman making the comment, but recalled colleagues talking about how Chipman \u201cmade this remark that all the African Americans must be cheating because there\u2019s no way they could get these scores.\u201d<\/p>\n<p>\u201cHe made this remark in front of a bunch of witnesses,\u201d the former Detroit-based ATF agent said. \u201cIt spread like wildfire at the agency. It got tremendous blowback, as it should. (Screenshot)<\/p>\n<\/div>\n<p>Jones, who has 13 years of experience vetting political nominees as a former Senate staffer, said Chipman\u2019s apparent unwillingness to provide his personnel records shouldn\u2019t be overlooked.<\/p>\n<p>\u201cAnything short of, \u2018sure, what do I need to do to turn over my personnel record,\u2019 should be a big red flag for folks,\u201d Jones said.<\/p>\n<p>Chipman\u2019s confirmation faces an uphill battle in the Senate Judiciary Committee.<\/p>\n<p>Republican members of the committee grilled Chipman during his confirmation hearing in May over his past comments in support of restricting gun rights and his recent work with the pro-gun control group Everytown for Gun Safety.<\/p>\n<p>GOP Sen. Mike Lee of Utah ripped into Chipman during the hearing for his \u201ctroubling\u201d and \u201cflippant\u201d comments towards legal gun owners during a Reddit \u201cAsk Me Anything\u201d in September 2019.<\/p>\n<p>\u201cWhile at ATF I conducted studies involving people who failed background checks to determine how many later committed crimes with a gun \u2013 many did. This is a perfect opportunity to arrest people before committing crimes rather than responding after the fact,\u201d Chipman said during the Reddit event.<\/p>\n<p>Chipman said during his hearing that his prior comments on arresting law-abiding gun owners were a mistake, according to <a href=\"https:\/\/www.foxnews.com\/politics\/republicans-biden-atf-nominee-chipman-guns\">Fox News<\/a>.<\/p>\n<p>Chipman also incorrectly claimed during the Reddit event that Branch Davidian members shot down two government helicopters using .50-caliber Barrett rifles during the Waco siege in 1993. <strong><a href=\"https:\/\/dailycaller.com\/2021\/04\/07\/david-chipman-atf-biden-waco-branch-davidians\/\">(RELATED: Biden\u2019s Nominee To Lead ATF Pushed Dubious Claim About Waco Siege To Call For Blanket Ban On Assault Rifles)<\/a><\/strong><\/p>\n<p>Republican Sen. Susan Collins of Maine <a href=\"https:\/\/www.nationalreview.com\/news\/susan-collins-to-vote-no-on-unusually-divisive-biden-atf-nominee-chipman\/\">announced<\/a> Monday she will vote against Chipman\u2019s nomination, calling him an \u201cunusually divisive pick for this important position.\u201d<\/p>\n<p>\u201cIn particular, I am concerned that his confirmation would do significant damage to the collaborative working relationship that must exist between ATF, the firearms industry, sportsmen and women, and other law-abiding gun owners exercising their Second Amendment rights,\u201d Collins said in a statement.<\/p>\n<p>The White House did not immediately return requests for comment.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
