Acting Director of the White House Office of National Drug Control Policy, Regina LaBelle, affirmed the Biden administration\u2019s support of the EQUAL Act at the Senate Judiciary Committee hearing, <a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/ONDCP%20%20LaBelle%20Testimony%20-%20Senate%20Judiciary%20-%20Crack%20Cocaine%20Disparity%20to%20Committee.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">according to testimony<\/a>.<\/p>\n<p>President Joe Biden was originally responsible for the <a href=\"https:\/\/www.congress.gov\/99\/statute\/STATUTE-100\/STATUTE-100-Pg3207.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Anti-Drug Abuse Act of 1986<\/a>, in which someone caught distributing five grams of crack cocaine, served the same five-year prison term as someone caught with 500 grams of powder cocaine. This became known as the \u201c100-1 rule,\u201d <a href=\"https:\/\/www.washingtonpost.com\/politics\/biden-drugs-sentencing-cocaine\/2021\/06\/21\/cd0c5e26-d2dc-11eb-ae54-515e2f63d37d_story.html\" target=\"_blank\" rel=\"noopener noreferrer\">The Washington Post<\/a> reported, and in 2010, Congress enacted the <a href=\"https:\/\/www.congress.gov\/111\/plaws\/publ220\/PLAW-111publ220.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Fair Sentencing Act<\/a>, which reduced the disparity to 18-to-1.<\/p>\n<p>Eliminating the disparity is something Biden campaigned on during his 2020 run for president and the issue of cocaine sentencing was a recent subject in the Supreme Court, where it <a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/20-5904_i4dk.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">ruled<\/a> unanimously that\u00a0individuals convicted of certain low-level crack-cocaine offenses are <a href=\"https:\/\/dailycaller.com\/2021\/06\/14\/supreme-court-clarence-thomas-sonia-sotomayor\/\" target=\"_blank\" rel=\"noopener noreferrer\">not eligible for resentencing<\/a> under the <a href=\"https:\/\/www.congress.gov\/115\/bills\/s756\/BILLS-115s756enr.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">First Step Act<\/a>, a Trump-era law that made some criminal-justice reforms retroactive. The court ruled against Tarahrick Terry, who pleaded guilty to one count of possession with intent to distribute 3.9 grams of crack cocaine and was <a href=\"https:\/\/dailycaller.com\/2021\/02\/01\/lisa-monaco-joe-biden-justice-department-reginald-steward\/\" target=\"_blank\" rel=\"noopener noreferrer\">sentenced<\/a> to fifteen and a half years in prison in 2008.<\/p>\n<p>\u201cWe now know that this wrong-headed crack-powder disparity has ruined thousands of lives and failed to move us one step closer to ending the scourge of drug addiction in America,\u201d said Democratic Senate Majority Whip and one of the sponsors of the bill, Richard Durbin of Illinois, in a statement to The Washington Post. \u201cEnough.\u201d<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
