Wade<\/i> is overturned.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">The bill would essentially end abortions in the state of Texas if a constitutional amendment is created that allows states to ban the practice, or if a court decides that states are able to take such action. It would potentially make Texas one of the first states in the nation to take the bold step in banning the procedure.<\/p>\n<p class=\"p1\">The legislation is <a href=\"https:\/\/capitol.texas.gov\/BillLookup\/Text.aspx?LegSess=87R&#038;Bill=HB1280\"><span class=\"s1\">House Bill 1280<\/span><\/a>, or the \u201cHuman Life Protection Act of 2021,\u201d a <a href=\"https:\/\/www.texastribune.org\/2021\/06\/16\/texas-abortion-law-roe-wade\/\">\u201ctrigger bill\u201d<\/a> that would go into effect at a later time depending on other various actions.<\/p>\n<p class=\"p1\">The bill would allow abortions when a pregnant woman\u2019s life is at risk if she does not get an abortion, but the person performing, inducing, or attempting it must be a licensed physician and perform the procedure in a way that allows the best opportunity for the unborn child to live unless that would create more risk of death or impairment for the mother. Physicians are not allowed, however, to take certain actions to perform, induce, or attempt an abortion \u201cif, at the time the abortion was performed, induced, or attempted, the person knew the risk of death or a substantial impairment of a major bodily function\u201d described in the bill.<\/p>\n<p>As The Texas Tribune <a href=\"https:\/\/www.texastribune.org\/2021\/06\/16\/texas-abortion-law-roe-wade\/\">noted<\/a>, \u201cThere is no exception for women at risk of suicide or self-harm, pregnant as a result of rape or incest, or in the case of severe or potentially lethal fetal abnormalities.\u201d<\/p>\n<p class=\"p1\">If a person knowingly performs, induces, or attempts an abortion, they are in violation of the law, the offense of which is a felony of the second degree. If an unborn child dies because of the abortion, the offense is a felony of the first degree.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">A person who violates the law could be fined $100,000 per violation. Doctors and health professionals who break the law would also be revoked of their licenses, permits, or other authorities.<\/p>\n<p class=\"p1\">The law could go into effect 30 days after the Supreme Court overrules <i>Roe v. Wade<span class=\"Apple-converted-space\">\u00a0<\/span><\/i> \u201cas modified by <i>Planned Parenthood v. Casey,\u201d <\/i>which would permit states to ban abortions. It could also go into effect if the Supreme Court issues judgment in another decision that allows for states to ban abortions or a constitutional amendment is created that allows states to ban the practice, as well.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Abbott previously signed a bill into law that would prohibit abortions after a fetal heartbeat can be detected, known as one of the \u201cheartbeat bills.\u201d<\/p>\n<p class=\"p1\">As The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/abbott-signs-heartbeat-bill-allowing-texans-to-sue-abortion-providers\"><span class=\"s1\">reported<\/span><\/a> last month, Abbott signed the law \u201cthat will prohibit Texas clinics from performing or inducing abortions once a fetal heartbeat has been detected and open up abortion providers to lawsuits.\u201d<\/p>\n<p class=\"p1\">The law will go into effect in September and includes a \u201cfirst-of-its-kind legal provision,\u201d according to\u00a0<a href=\"https:\/\/www.texastribune.org\/2021\/05\/18\/texas-heartbeat-bill-abortions-law\/\"><span class=\"s1\">The Texas Tribune<\/span><\/a> that would permit \u201cprivate citizens to file civil suits against abortion clinics over alleged violations, instead of relying on the state to enforce the ban,\u201d The Daily Wire noted.<\/p>\n<p class=\"p1\">\u201cIt\u2019s a very unique law and it\u2019s a very clever law,\u201d Josh Blackman, a constitutional law professor at South Texas College of Law Houston, told the Tribune. \u201cPlanned Parenthood can\u2019t go to court and sue Attorney General [Ken] Paxton like they usually would because he has no role in enforcing the statute. They have to basically sit and wait to be sued.\u201d<\/p>\n<p class=\"p1\">As The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/federal-court-rules-north-carolina-20-week-abortion-ban-unconstitutional\"><span class=\"s1\">reported<\/span><\/a> earlier this week, A North Carolina federal appeals court upheld a previous ruling on North Carolina\u2019s abortion laws in what was perceived as a win for pro-choice groups. The ruling came as the Supreme Court recently agreed to hear a case out of Mississippi where abortions are banned after 15 weeks.<\/p>\n<p class=\"p1\">As The Washington Post <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/supreme-court-abortion-roe-v-wade\/2021\/05\/17\/cdaf1dd6-b708-11eb-a6b1-81296da0339b_story.html\"><span class=\"s1\">reported<\/span><\/a>, \u201cIn accepting the [Mississippi] case for next term, the court said it would examine whether \u2018all pre-viability prohibitions on elective abortions are unconstitutional.\u2019 That has been a key component of the court\u2019s jurisprudence, and the announcement sounded ominous to abortion rights advocates.\u201d<\/p>\n<p><i><span>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
