In 2016, abortion providers challenged this, saying that it was unconstitutional to allow for the \u201cState\u2019s criminalization of previability abortions,\u201d per Circuit Judge Diana Gribbon Motz in the U.S. Court of Appeals for the Fourth Circuit\u2019s published <a href=\"https:\/\/www.foxnews.com\/politics\/us-appeals-court-ruling-north-carolina-20-week-abortion-ban-unconstitutional\">opinion<\/a>. North Carolina had previously appealed a district court\u2019s decision, arguing that the abortion providers did not have standing to bring the suit due to the fact that \u201cthey do not face a credible threat of prosecution for violation of the challenged provisions.\u201d<\/p>\n<p class=\"p1\">The court\u2019s <a href=\"https:\/\/oltem1bixlohb0d4busw018c-wpengine.netdna-ssl.com\/wp-content\/uploads\/2021\/06\/4th-circuit-opinion-nc-20-week.pdf\"><span class=\"s1\">documentation<\/span><\/a> explained that after the Supreme Court decision in the 1973 <em>Roe v. Wade<\/em> case, North Carolina allowed for abortions to be performed prior to the twentieth week of a woman\u2019s pregnancy.<\/p>\n<p class=\"p1\">In 2015, North Carolina created modifications to abortion exceptions including a 72-hour waiting period for a woman before she gets an abortion. They also required that the Department of Health and Human Services inspect abortion clinics each year.<\/p>\n<p class=\"p1\">The court found that even though abortion providers had not been prosecuted for perhaps performing abortions after the 20-week threshold, the state still \u201chas a renewed interest in regulating abortion.\u201d It discussed the state\u2019s recent amendments and the fact that other states have taken action to ban abortions. The court decided that the \u201cthreat of prosecution to abortion providers who violate the law\u201d is credible, and upheld the lower court\u2019s decision that the state\u2019s ban was unconstitutional.<\/p>\n<p class=\"p1\">The decision comes as the <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/supreme-court-abortion-roe-v-wade\/2021\/05\/17\/cdaf1dd6-b708-11eb-a6b1-81296da0339b_story.html\">Supreme Court<\/a> is set to hear a case out of Mississippi where most abortions are banned after 15 weeks. It sets the stage for a potential overturning of the <a href=\"https:\/\/www.law.cornell.edu\/wex\/roe_v_wade_(1973)\"><em>Roe v. Wade<\/em> and <em>Casey v. Planned Parenthood<\/em><\/a> decisions, which said that a woman can get an abortion up to the point of viability, or when a fetus can survive on its own.<\/p>\n<p class=\"p1\">The perception of pregnancy changes dramatically based on the implications of the conversation.<\/p>\n<p class=\"p1\">At 20 weeks, the \u201c<a href=\"https:\/\/www.whattoexpect.com\/pregnancy\/week-by-week\/week-20.aspx\"><span class=\"s1\">What To Expect\u201d network<\/span><\/a> describes what might start happening inside a woman\u2019s body as her child continues to form. \u201cIf you didn\u2019t start feeling your baby-to-be\u2019s punches and kicks last week, you may this week \u2014 and it\u2019s the best! But it could take a little longer,\u201d it says.<span class=\"Apple-converted-space\">\u00a0<\/span>It adds that babies might start sucking their thumbs inside the womb soon as they work on sucking reflexes. Gender revelations can typically take place around the 20th week of pregnancy.<\/p>\n<p class=\"p1\">If a woman is going to have a baby girl, this is the week of pregnancy when the baby\u2019s uterus is fully formed, meaning that one day, that pregnant mother might be a grandmother, the site notes. \u201cYour little girl also has primitive eggs in tiny ovaries now, about 7 million of them. By birth, that number will be down to 1 or 2 million,\u201d it adds.<\/p>\n<p>Infants are mostly considered to be viable after 24 weeks gestation, with their chances of survival dropping to less than 50% if they are born before then, according to <a href=\"https:\/\/healthcare.utah.edu\/womenshealth\/pregnancy-birth\/preterm-birth\/when-is-it-safe-to-deliver.php\"><span class=\"s1\">University of Utah health<\/span><\/a>. According to a 2001 <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/11753511\/\"><span class=\"s1\">report<\/span><\/a> from the National Library of Medicine, based on data reviewed at the time, it found that \u201cintensive care should be an optional choice for fetuses at 23 and 24 weeks of gestation and should be offered to every fetus at 25 weeks or more.\u201d<\/p>\n<p class=\"p1\">Laws are important, and decisions that are made will affect the outcome of people\u2019s lives, but when it comes to abortion, the conversation often shifts to viability when perhaps it should shift to the obvious outcome if a woman does not go through with an abortion: the birth of a human.<\/p>\n<p class=\"p1\">In the court\u2019s recent decision on the North Carolina law, the conversation centered on the penalization of abortion providers and the prospect of such punishments taking place \u2014 rightly so, as the law was the primary concern \u2014 but as states take measures to increase abortion restrictions or push for more access to abortion, there should be a discussion about the pain caused not to the abortion providers who might be penalized, but to the women and children who are most negatively impacted by the nature of abortion.<\/p>\n<p class=\"p1\">At <a href=\"https:\/\/www.whattoexpect.com\/pregnancy\/week-by-week\/week-20.aspx\"><span class=\"s1\">20 weeks<\/span><\/a>, a baby is \u201cas big as a sweet potato.\u201d<\/p>\n<p><em><span>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
