Law-abiding citizens keeping and bearing modern rifles benefit public safety, counter-balance the threat of illegal gun violence, and help make our homes and streets safer.\u201d<\/p>\n<p>The group said they decided to intervene not because \u201cthey disagree with California\u2019s policy choice, but because the challenged law represents a policy choice that the Second Amendment forecloses.\u201d<\/p>\n<p>\u201cCalifornia should not be permitted to invade its own citizens\u2019 constitutional rights, and this Court should not imperil the rights of citizens in this Circuit and other states with its analysis.\u201d<\/p>\n<p>The states argue that California\u2019s ban affects guns used by \u201cmillions of law-abiding citizens\u201d and \u201ccriminalizes mere possession of commonly-used arms,\u201d striking \u201cat the core of the Second Amendment.\u201d<\/p>\n<div id=\"attachment_7216051\" class=\"wp-caption alignnone\" readability=\"37\"><img decoding=\"async\" aria-describedby=\"caption-attachment-7216051\" loading=\"lazy\" class=\"size-full wp-image-7216051\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/06\/GettyImages-98551064-scaled-1.jpg\" alt=\"WASHINGTON - APRIL 19: A man stands next to a sign pro-gun rally organized by the Second Amendment March group, near the Washington Monument April 19, 2010 in Washington, DC. America must never abandon her law-abiding citizens and their fundamental right to defend themselves.\u201d<\/p>\n<p>Democratic California Attorney General Rob Bonta <a href=\"https:\/\/dailycaller.com\/2021\/06\/10\/california-appeals-ruling-overturning-assault-weapons-ban\/\" target=\"_blank\" rel=\"noopener noreferrer\">filed an appeal<\/a>\u00a0June 10 challenging District Judge Roger Benitez\u2019s <a href=\"https:\/\/dailycaller.com\/2021\/06\/05\/california-assault-weapons-ban-overturned\/\" target=\"_blank\" rel=\"noopener noreferrer\">ruling<\/a>, which found that \u201cunder no level of heightened scrutiny can the [ban on assault weapons] survive.\u201d<\/p>\n<p>Similar to the argument being made by the coalition of states, Benitez <a href=\"https:\/\/d3n8a8pro7vhmx.cloudfront.net\/firearmspolicycoalition\/pages\/5381\/attachments\/original\/1622850515\/Miller_v_Bonta_Opinion.pdf?1622850515\" target=\"_blank\" rel=\"noopener noreferrer\">ruled<\/a> firearms, like the AR-15, is a \u201cpopular\u201d choice for \u201chome defense\u201d and \u201cis the kind of versatile gun that lies at the intersection of the kinds of firearms protected under <i>District of Columbia v. Heller <\/i>and <i>United States v. Miller.<\/i>\u201d<\/p>\n<p>Benitez ruled the case is about an \u201caverage\u201d gun being used \u201cin average ways for average purposes.\u201d<\/p>\n<p>Bonta said he \u201cwon\u2019t rest in the fight to defend our state\u2019s commonsense gun laws.
