Wade, which legalized abortion. The North Carolina legislature adopted amendments in 2015 that imposed several additional requirements to receive an abortion such as longer waiting periods, reporting requirements, and other measures meant to narrow who was allowed to receive an abortion.<\/p>\n<p>Advocacy groups argued that abortion providers would be prosecuted for performing the procedure, with a <a href=\"https:\/\/reproductiverights.org\/court-strikes-down-north-carolina-abortion-ban\/\" target=\"_blank\" rel=\"noopener noreferrer\">judge agreeing<\/a> in 2019 and blocking the law\u2019s enforcement in cases where the unborn baby is considered not viable.<\/p>\n<p>The 4th U.S. Circuit Court of Appeals <a href=\"https:\/\/oltem1bixlohb0d4busw018c-wpengine.netdna-ssl.com\/wp-content\/uploads\/2021\/06\/4th-circuit-opinion-nc-20-week.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">upheld<\/a> the 2019 decision. The defendants argued abortion providers had no standing to sue over the law, noting North Carolina has never charged an abortion provider under the statutes and doesn\u2019t have plans to do so. Judge Diana Gribbon Motz, however, said state lawmaker\u2019s attempt to codify the law in 2015 proved defendants want the law enforced.<\/p>\n<p>\u201cIt is difficult to explain why the legislature would have altered the text of the 20-week ban if it did not expect for those words to ever be given effect,\u201d she wrote. \u201cAs a nation we remain deeply embroiled in debate over the legal status of abortion. While this conversation rages around us, this court cannot say that the threat of prosecution to abortion providers who violate the law is not credible.\u201d<\/p>\n<p>Planned Parenthood celebrated the ruling in a statement.<\/p>\n<p>\u201cToday\u2019s ruling is an important victory for our patients across North Carolina,\u201d Planned Parenthood South Atlantic President and CEO Jenny Black said in a <a href=\"https:\/\/www.plannedparenthoodaction.org\/planned-parenthood-votes-south-atlantic\/press-room\/appeals-court-affirms-decision-striking-down-unconstitutional-abortion-ban\" target=\"_blank\" rel=\"noopener noreferrer\">statement<\/a>.<strong> <a href=\"https:\/\/dailycaller.com\/2021\/05\/18\/planned-parenthood-sues-lubbock-abortion-sanctuary-city\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Planned Parenthood Sues Abortion \u2018Sanctuary City\u2019)<\/a><\/strong><\/p>\n<blockquote class=\"twitter-tweet\" readability=\"9.6279069767442\">\n<p dir=\"ltr\" lang=\"en\">BREAKING: This morning a federal appeals court upheld the decision to strike down a North Carolina law banning safe, legal abortion after 20 weeks. When people can make decisions about their pregnancies that are best for them, families thrive and we build communities where each of us can participate fully and with dignity,\u201d she continued.<\/p>\n<p>The Supreme Court <a href=\"https:\/\/dailycaller.com\/2021\/05\/17\/supreme-court-abortion-case-mississippi-roe-wade-dobbs-jackson-womens-health\/\" target=\"_blank\" rel=\"noopener noreferrer\">recently agreed<\/a> to take up a case challenging Mississippi\u2019s 15-week abortion ban. The case will hear whether abortion bans prior to fetal viability are constitutional.
