Jails aren\u2019t designed for long-term incarceration, Effman said, and because it\u2019s unlikely a trial would occur in the next four to six months Weinstein would be sitting in a jail instead of his current prison during that time. If LA wants jurisdiction, Effman argued, they can do a virtual arraignment,\u201d<a href=\"https:\/\/www.hollywoodreporter.com\/business\/business-news\/harvey-weinstein-extradited-california-1234968284\/\"> per The Hollywood Reporter<\/a>. Effman argued that there was no harm in allowing Weinstein to remain in custody in New York and that the disgraced Hollywood mega-producer \u201cwould be ready to go to L.A. when they\u2019re ready to start voir dire for jury selection.\u201d<\/p>\n<p>He added that a \u201ccopy and paste error\u201d invalidated the prosecutor\u2019s request for temporary custody.<\/p>\n<p>Prosecutors at the hearing pointed out that Los Angeles is not a \u201cremote outpost\u201d and that Weinstein could receive acceptable medical care in California.<\/p>\n<p>Erie County Judge Kenneth Case agreed and ordered Weinstein transferred.<\/p>\n<p>\u201cBased upon everything that I\u2019ve read and I\u2019ve heard, I believe that I will respectfully deny your petition, Mr. Effman,\u201d Case said, per THR. \u201cIf California doesn\u2019t come to pick up Mr. Weinstein within a reasonable period of time, certainly, come back to see me. But based on all of the circumstances, and as I say the paperwork and argument I have heard, I respectfully deny the request.\u201d<\/p>\n<p>Case had already approved Weinstein\u2019s extradition \u2014 back on April 30th of this year \u2014 but Weinstein\u2019s attorneys filed suit to delay the transfer. At this point, Weinstein\u2019s only hope to stave off trial in Los Angeles is intervention from New York governor Andrew Cuomo, an unlikely scenario.<\/p>\n<p>Los Angeles is, of course, the second major city to prosecute Weinstein for sex crimes. He is currently serving a 23-year sentence in New York after being convicted for four felony sex offenses. In California, he will face \u201ca total of four counts each of forcible oral copulation and forcible rape, two counts of sexual battery by restraint and one count of sexual penetration by use of force, for crimes dating from 2004 to 2013 involving five different women,\u201d <a href=\"https:\/\/www.nytimes.com\/2021\/04\/30\/nyregion\/harvey-weinstein-extradition-rape-assault.html\">according to the New York Times<\/a>. The eleven charges carry the potential for additional \u201cdecades in prison,\u201d the outlet noted.<\/p>\n<p>A grand jury, <a href=\"https:\/\/www.dailywire.com\/news\/harvey-weinstein-secretly-indicted-on-rape-charges-by-la-grand-jury-extradition-hearing-monday\">the Daily Wire reported<\/a>, handed down a \u201csecretive indictment\u201d against Weinstein back in April.<\/p>\n<p>The indictment is virtually identical to the criminal complaint, which had been filed in January 2020 by former DA Jackie Lacey,\u201d Fox News reported at the time. \u201cThe disgraced movie mogul, who is already serving a 23-year sentence in New York for rape and sexual assault, faces 11 counts in California, including rape and sexual battery involving five incidents that allegedly took place between 2004 and 2013. If convicted, he faces up to 140 years behind bars.\u201d<\/p>\n<p>Los Angeles prosecutors said, earlier this year, that they would like to put Weinstein on trial as soon as possible. \u201cErie County prosecutors said that Los Angeles officials would probably not transfer Weinstein to California until the end of this month of the first half of July,\u201d <a href=\"https:\/\/deadline.com\/2021\/06\/harvey-weinstein-extradition-los-angeles-1234775653\/\">Deadline reported<\/a>.<\/p>\n<p><i>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
