The bill will have a strong focus on the fundamental rights and procedural rights of the accused.\u201d<\/span><\/p>\n<p><span>\u201cI believe this will maintain the crucial balance which is key to our criminal justice system while ensuring greater clarity and streamlining of Garda powers,\u201d Humphreys concluded.<\/span><\/p>\n<p><span>According to <a href=\"https:\/\/www.irishtimes.com\/news\/crime-and-law\/new-garda-powers-to-allow-access-to-mobile-phones-changes-to-stop-and-search-1.4592434\">The Irish Times<\/a>, this measure, \u201c<\/span><span>combined with a code of practice to be drawn up, will result in stop and search trends becoming clear over time.\u201d<\/span><\/p>\n<p><span>\u201cThis would include the gender and ethnicity of those being stopped,\u201d The Irish Times added. \u201cIt will also become clear what parts of the country, and in cities in which post codes, stop and search actions happen most frequently and what age groups were stopped most often.\u201d<\/span><\/p>\n<p><span>The Irish Times also explained that anyone who refuses to \u201csurrender a password for a mobile phone or other device to garda\u00ed will be committing a crime,\u201d and \u201ccould face up to five years in prison and a fine of up to \u20ac30,000\u201d as a result.<\/span><\/p>\n<p><span>Among the <\/span><a href=\"https:\/\/www.gov.ie\/en\/press-release\/6ed9f-garda-powers-to-be-modernised-and-updated-under-new-bill-from-minister-humphreys\/\"><span>measures<\/span><\/a><span> included in the bill are \u201c<\/span><span>a power for An Garda S\u00edoch\u00e1na and other bodies to require a person to provide passwords for access to electronic devices when carrying out a search warrant,\u201d \u201ca new requirement to make a written record of a stop and search.
