Version: 4.0.47--><div><img decoding=\"async\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/06\/Missouri-governor-1200x800-1.jpg\" class=\"ff-og-image-inserted\"  style=\"display:none\"><\/div>\n<div class=\"e12o35pe0 css-1wr5klf\" readability=\"49.657530981888\">\n<p>Missouri Republican Governor Mike Parson signed a bill into law over the weekend that bars local police departments from enforcing federal gun control laws that violate Second Amendment rights, a move that comes as Democrat President Joe Biden seeks to impose stricter gun control.<\/p>\n<p>\u201cThe new law allows state gun laws to surpass federal gun laws and holds police departments liable if an officer violates someone\u2019s second amendment rights,\u201d FOX 4 <a href=\"https:\/\/fox4kc.com\/news\/governor-parson-signs-house-bill-85-to-protect-missourians-2nd-amendment-rights\/\">reported<\/a>. \u201cIf someone\u2019s second amendment right is violated, local law enforcement could pay $50,000.\u201d<\/p>\n<p>Parson, a former sheriff, <a href=\"https:\/\/twitter.com\/GovParsonMO\/status\/1403798757171515395\">said<\/a> that the law \u201cdraws a line in the sand and demonstrates our commitment to reject any attempt by the federal government to circumvent the fundamental right Missourians have to keep and bear arms to protect themselves and their property.\u201d<\/p>\n<p>\u201cMissouri\u2019s HB 85 puts those in Washington D.C. on notice that here in our state we support responsible, law-abiding gun owners, and that we oppose government overreach and any unlawful efforts to limit our access to firearms,\u201d Parson added.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"10.056074766355\">\n<p lang=\"en\" dir=\"ltr\">Missouri\u2019s HB 85 puts those in Washington D.C. on notice that here in our state we support responsible, law-abiding gun owners, and that we oppose government overreach and any unlawful efforts to limit our access to firearms. <a href=\"https:\/\/twitter.com\/hashtag\/2ndAmendment?src=hash&#038;ref_src=twsrc%5Etfw\">#2ndAmendment<\/a> <a href=\"https:\/\/t.co\/T4qLJ8lKJR\">pic.twitter.com\/T4qLJ8lKJR<\/a><\/p>\n<p>\u2014 Governor Mike Parson (@GovParsonMO) <a href=\"https:\/\/twitter.com\/GovParsonMO\/status\/1403800482057969669?ref_src=twsrc%5Etfw\">June 12, 2021<\/a><\/p>\n<\/blockquote>\n<p>The law comes as Biden has repeatedly <a href=\"https:\/\/www.dailywire.com\/news\/biden-calls-for-assault-gun-ban-while-americans-buy-in-record-numbers-after-riots-defund-police-push-nra-trolls-him\">called<\/a> for <a href=\"https:\/\/www.dailywire.com\/news\/biden-makes-false-claims-about-guns-in-executive-order-presser-gets-atf-name-wrong\">banning<\/a> semi-automatic firearms, <a href=\"https:\/\/www.dailywire.com\/news\/psaki-on-biden-cracking-down-on-second-amendment-rights-this-is-only-the-beginning-more-is-coming\">forcing<\/a> certain types of pistols to be registered with the federal government and taxed, and <a href=\"https:\/\/www.dailywire.com\/news\/breaking-biden-announces-executive-order-crackdown-on-guns-new-anti-gun-atf-director\">nominated<\/a> an anti-Second Amendment zealot to run the ATF.<\/p>\n<p>The law, dubbed the \u201cSecond Amendment Preservation Act,\u201d <a href=\"https:\/\/www.house.mo.gov\/billtracking\/bills211\/sumpdf\/HB0085T.pdf\">states<\/a>:<\/p>\n<ol>\n<li><em>Declares that laws, rules, orders, or other actions that collect data, restrict or prohibit the manufacture, ownership, and use of firearms, firearm accessories, or ammunition exclusively within this state exceed the powers granted to the federal government except to the extent they are necessary and proper for governing and regulating land and naval forces of the United States or for organizing, arming, and discipling militia forces actively employed in the service of the United States Armed Forces. Infringing actions would include any registration or tracking of firearms, firearm accessories, or ammunition or any registration or tracking of the ownership of firearms, firearm accessories, or ammunition;<\/em><\/li>\n<li><em>Declares that all federal acts, laws, executive orders, administrative orders, court orders, rules, and regulations, whether past, present, or future, that infringe on the people\u2019s right to keep and bear arms as guaranteed by the Second Amendment to the United States Constitution and Article I, Section 23 of the Missouri Constitution must be invalid in this state, including those that impose a tax, levy, fee, or stamp on these items as specified in the bill; require the registration or tracking of these items or their owners; prohibit the possession, ownership, use, or transfer of a firearm; or order the confiscation of these items;<\/em><\/li>\n<li><em>Declares that it must be the duty of the courts and law enforcement agencies to protect the rights of law-abiding citizens to keep and bear arms and that no person, including a public officer or state employee of this state or any political subdivision of this state, can have authority to enforce or attempt to enforce any federal laws, orders, or rules infringing on the right to keep and bear arms;<\/em><\/li>\n<li><em>Specifies that any entity or person who knowingly acts under the color of any federal or state law to deprive a Missouri citizen of the rights or privileges ensured by the federal and state constitutions to keep and bear arms must be liable to the injured party for redress, including monetary damages in the amount of $50,000 per occurrence and injunctive relief. Reasonable attorney fees and costs may be awarded to the prevailing party with specified exceptions. The employer of the individual who is found liable is responsible for the civil penalty, attorney\u2019s fees, and court costs associated with the litigation if the individual is found to have violated this act. Government entities may not recover under this act;<\/em><\/li>\n<li><em>Declares the federal excise tax rate on arms and ammunition in effect prior to January 1, 2021, which funds programs under the Wildlife Restoration Act, does not have a chilling effect on the purchase or ownership of such arms and ammunition;<\/em><\/li>\n<li><em>Declares nothing in these sections shall be construed to prohibit Missouri officials from accepting aid from federal officials in an effort to enforce Missouri laws;<\/em><\/li>\n<li><em>Declares that \u201cmaterial aid and support\u201d shall include voluntarily giving or allowing others to make use of lodging; communications equipment or services, including social media accounts; facilities; weapons; personnel; transportation; clothing; or other physical assets. Material aid and support shall not include giving or allowing the use of medicine or other materials necessary to treat physical injuries, nor shall the term include any assistance provided to help persons escape a serious, present risk of life-threatening injury;<\/em><\/li>\n<li><em>Declares that it shall not be considered a violation of Sections 1.410 to 1.480 to provide material aid to federal officials who are in pursuit of a suspect when there is a demonstrable criminal nexus with another state or country and such suspect is either not a citizen of this state or is not present in this state; and<\/em><\/li>\n<li><em>Declares that it shall not be considered a violation of Sections 1.410 to 1.480 to provide material aid to federal prosecution for:<\/em>\n<ol>\n<li><em>Felony crimes against a person when such prosecution includes weapons violations substantially similar to those found in Chapter 570 or Chapter 571 so long as such weapons violations are merely ancillary to such prosecution; or<\/em><\/li>\n<li><em>Class A or class B felony violations substantially similar to those found in Chapter 579 when such prosecution includes weapons violations substantially similar to those found in Chapter 570 or Chapter 571 so long as such weapons violations are merely ancillary to such prosecution.<\/em><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><i><span>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
