His denial sparked a backlash among conservatives and pro-life advocates and prompted multiple senators to question him about the <a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/senate-bill\/3\">Partial Birth Abortion Ban Act<\/a> in hearings this week.<\/p>\n<p>During Thursday\u2019s hearing, Republican Montana Sen. Steve Daines asked Becerra whether partial birth abortion is illegal several times. Becerra repeatedly refused to address the question or acknowledge that partial birth abortion is illegal and emphasized that Roe v. Wade is the law of the land.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/senate-bill\/3\">Partial Birth Abortion Ban Act<\/a>\u00a0passed Congress in 2003, was signed by former President George W. Bush, and\u00a0<a href=\"https:\/\/www.nytimes.com\/2007\/04\/18\/us\/18cnd-scotus.html\">was upheld<\/a> by the U.S. Supreme Court as constitutional in 2007. <strong><a href=\"https:\/\/dailycaller.com\/2021\/02\/23\/becerra-abortion-romney-partial-birth-california-biden\/\">(RELATED: Republican Senators Push Biden Nominee Becerra On His Abortion Record)<\/a><\/strong><\/p>\n<p>The law defines partial birth abortion as \u201can abortion in which a physician deliberately and intentionally vaginally delivers a living, unborn child\u2019s body until either the entire baby\u2019s head is outside the body of the mother, or any part of the baby\u2019s trunk past the navel is outside the body of the mother and only the head remains inside the womb, for the purpose of performing an overt act (usually the puncturing of the back of the child\u2019s skull and removing the baby\u2019s brains) that the person knows will kill the partially delivered infant, performs this act, and then completes delivery of the dead infant.\u201d<\/p>\n<p>Daines pushed Becerra on the matter, asking, \u201cIs it illegal?\u201d<\/p>\n<p><strong>WATCH:<\/strong><\/p>\n<blockquote class=\"twitter-tweet\" readability=\"9.3209302325581\">\n<p dir=\"ltr\" lang=\"en\">The law is the law\u2014partial birth abortions ARE illegal.<\/p>\n<p>So, why won\u2019t <a href=\"https:\/\/twitter.com\/JoeBiden?ref_src=twsrc%5Etfw\">@JoeBiden<\/a>\u2018s Secretary of HHS acknowledge the law? Wade to receive reproductive health care services.\u201d<\/p>\n<p>Republican Indiana Sen. Mike Braun also pressed Becerra on partial birth abortion during a Wednesday hearing, during which Becerra insisted that HHS would do \u201cwhat the law permits us to do.\u201d<\/p>\n<p><strong>WATCH:\u00a0<\/strong><\/p>\n<blockquote class=\"twitter-tweet\" readability=\"12.534435261708\">\n<p dir=\"ltr\" lang=\"en\">In House testimony last month, HHS Sec.
