Scott Applewhite, File)<\/p>\n<\/div>\n<h5>OAN Newsroom<br \/>UPDATED 1:12 PM PT \u2013 Thursday, June 10, 2021<\/h5>\n<p>The Supreme Court has narrowed the scope of what the federal government can consider a \u201cviolent felony.\u201d On Thursday, five justices rejected the government\u2019s interpretation of \u201cviolent felony\u201d when it comes to sentencing enhancements as part of the <a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/19-5410_8nj9.pdf\">Armed Career Criminal Act<\/a>.<\/p>\n<p>The provision imposes a 15-year minimum sentence on anyone convicted of a felony that involves possession of a firearm if they have three or more prior convictions as a violent felon. An offense qualifies as a \u201cviolent felony\u201d if it involves \u201cthe use, attempted use or threatened use of physical force against the person of another.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">NEW: SCOTUS rules against federal government&#8217;s interpretation of the Armed Career Criminal Act. Court says a felony involving recklessness does not satisfy the law&#8217;s &#8220;use of physical force&#8221; element and thus does not trigger the law&#8217;s &#8220;violent felony&#8221; mandatory minimum sentence.<\/p>\n<p>\u2014 SCOTUSblog (@SCOTUSblog) <a href=\"https:\/\/twitter.com\/SCOTUSblog\/status\/1402989687841574914?ref_src=twsrc%5Etfw\">June 10, 2021<\/a><\/p>\n<\/blockquote>\n<p>The defendant in the case, Charles Borden Jr., pleaded guilty to a federal gun crime. However, he argued the sentencing shouldn\u2019t apply as one of his previous convictions included \u201creckless aggravated assault,\u201d which carries less blame than someone who knowingly causes an injury. Ultimately, his argument was rejected.<\/p>\n<p>Justice Elena Kagan wrote, \u201cin ordinary language, against means in opposition to.\u201d Justice Brett M. Kavanaugh added the ordinary meaning of \u201cagainst the person of another\u201d encompasses recklessness.<\/p>\n<p>Although, Justice Clarence Thomas\u2019 definition sounded slightly different, he eventually agreed with the other justices.
