Weapons of war don\u2019t belong on our streets.<\/p>\n<p>\u2014 Rob Bonta (@RobBonta) <a href=\"https:\/\/twitter.com\/RobBonta\/status\/1403050538795634691?ref_src=twsrc%5Etfw\">June 10, 2021<\/a><\/p>\n<\/blockquote>\n<p>Announcing the appeal, Bonta said District Judge Roger Benitez\u2019s <a href=\"https:\/\/dailycaller.com\/2021\/06\/08\/gun-control-howls-gnashes-teeth-when-californias-rifle-ban-struck\/\" target=\"_blank\" rel=\"noopener noreferrer\">ruling<\/a> was \u201cdisturbing and troubling and of great concern,\u201d according to <a href=\"https:\/\/www.cnn.com\/2021\/06\/10\/politics\/california-appeals-assault-style-weapons-ban\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">CNN<\/a>.<\/p>\n<p>\u201cWe cannot be and we are not deterred by this ruling,\u201d Bonta reportedly said.<\/p>\n<p>Bonta is asking the appeals court to stay <a href=\"https:\/\/dailycaller.com\/2021\/06\/05\/california-assault-weapons-ban-overturned\/\" target=\"_blank\" rel=\"noopener noreferrer\">Benitez\u2019s ruling<\/a> which would keep the assault weapons ban in place until the appeals process is complete, according to the report. <strong><a href=\"https:\/\/dailycaller.com\/2021\/03\/31\/assault-weapons-ban-biden-1994-crime-bill\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: ANALYSIS: Here\u2019s What Actually Happens When You Ban Assault Weapons)<\/a><\/strong><\/p>\n<p>Benitez, in his introduction, <a href=\"https:\/\/d3n8a8pro7vhmx.cloudfront.net\/firearmspolicycoalition\/pages\/5381\/attachments\/original\/1622850515\/Miller_v_Bonta_Opinion.pdf?1622850515\" target=\"_blank\" rel=\"noopener noreferrer\">wrote<\/a> \u201clike the Swiss Army knife, the popular AR-15 rifle is a perfect combination of home defense weapon and homeland defense weapon. Good for both home and battle, the AR-15 is the kind of versatile gun that lies at the intersection of the kinds of firearms protected under <i>District of Columbia v. Heller <\/i>and <i>United States v. Miller. <\/i>Yet, the State of California makes it a crime to have an AR-15 type rifle.\u201d<\/p>\n<p>Mattie Scott, who lost a son to gun violence in 1996 and works with the Brady Center\u2019s California chapter, said Thursday that equating a Swiss army knife to an AR-15 is \u201cinsulting,\u201d according to CNN.<\/p>\n<p>\u201cIt is insulting to read his decision where he called the kind of weapon that killed my son akin to a pocket knife. Pocket knives were not invented to kill as many people as possible. Pocket knives don\u2019t tear families apart.\u201d<\/p>\n<p>Bonta also criticized the comparison in a <a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-and-governor-newsom-announce-appeal-decision-overturn\" target=\"_blank\" rel=\"noopener noreferrer\">statement<\/a>. \u201cEquating firearms that have been used in many of the deadliest mass shootings in this country with Swiss Army knives has no basis in law or fact,\u201d Bonta said. \u201cThe ban on assault weapons will not put an end to all gun violence, but it is one important tool the state has to protect the safety of Californians while also respecting the rights of law-abiding residents who choose to possess firearms,\u201d Bonta said.<\/p>\n<p>Benitez ruled the case is about an \u201caverage\u201d gun being used \u201cin average ways for average purposes.\u201d<\/p>\n<p>\u201cOne is to be forgiven if one is persuaded by news media and others that the nation is awash with murderous AR-15 assault rifles.
