Jean Carroll, who accused Trump of sexually assaulting her in a Bergdorf Goodman fitting room sometime in the mid-1990s in an essay for New York magazine. Trump forcefully denied Carroll\u2019s allegations, telling reporters after Carroll\u2019s story surfaced that he had never met the \u201cElle\u201d columnist, that Carroll was \u201ctotally lying\u201d in order to make a forthcoming book on her time in New York City more desirable to readers, and that \u201cshe\u2019s not my type.\u201d<\/p>\n<p><a href=\"https:\/\/www.nytimes.com\/2021\/06\/07\/nyregion\/trump-jean-carroll-lawsuit.html\">The New York Times reports<\/a> that the Biden DOJ submitted a brief acknowledging \u201cthat Mr. Trump\u2019s remarks about Ms. Carroll were \u2018crude and disrespectful,&#8217;\u201d but defending the former president from a claim of defamation, taking up Trump\u2019s claim that he is not subject to a suit on the issue because the remarks were made in the context of his official duties as president.<\/p>\n<p>\u201cThen-President Trump\u2019s response to Ms. Carroll\u2019s serious allegations of sexual assault included statements that questioned her credibility in terms that were crude and disrespectful,\u201d Biden\u2019s DOJ said in its brief. \u201cBut this case does not concern whether Mr. Trump\u2019s response was appropriate. Nor does it turn on the truthfulness of Ms. Carroll\u2019s allegations.\u201d<\/p>\n<p>\u201cRather, the lawyers wrote, because they believe Trump was an employee of the government and that he acted \u2018within the scope of employment,&#8217;\u201d <a href=\"https:\/\/www.cnn.com\/2021\/06\/07\/politics\/e-jean-carroll-trump-lawsuit-justice-department\/index.html\">CNN added<\/a>, \u201cthe department, rather than Trump personally, should serve as defendant in the case.\u201d<\/p>\n<p>\u201cElected public officials can \u2014 and often must \u2014 address allegations regarding personal wrongdoing that inspire doubt about their suitability for office,\u201d the brief continued. \u201cOfficials do not step outside the bounds of their office simply because they are addressing questions regarding allegations about their personal lives.\u201d<\/p>\n<p>The DOJ intervened in the case, initially, at the behest of Attorney General William Barr who reportedly feared that, if Carroll\u2019s case went to trial, the then-President could have been forced to sit for a deposition, and attorneys allowed to ask Trump questions under oath. \u201cIn a highly unusual move, Mr. Barr transferred the case to federal court and substituted the federal government for Mr. Trump as the defendant,\u201d the New York Times noted.<\/p>\n<p>\u201cFederal law forbids government employees from being sued for defamation, meaning that if the move was successful, Ms. Carroll\u2019s claim would be dismissed,\u201d the outlet added.<\/p>\n<p>Just after Barr removed the case to federal court, Biden used the decision as a way of suggesting that Trump was misusing federal resources, essentially protecting himself using the force of the federal government.<\/p>\n<p>\u201cAt one of their debates,\u00a0Mr. Biden accused Mr. Trump of treating the Justice Department like his \u201cown law firm\u201d in the suit, filed against him by the writer E.
