Jean Carroll.<\/p>\n<p>Carroll accused the former president of <a href=\"https:\/\/dailycaller.com\/2020\/01\/30\/e-jean-carroll-lawyers-donald-trump-dna\/\">raping her<\/a> in an NYC department store fitting room in the early 1990s. She <a href=\"https:\/\/dailycaller.com\/2019\/11\/04\/e-jean-carroll-sue-trump-defamation\/\">sued Trump<\/a>\u00a0for defamation in 2019,\u00a0alleging he damaged her reputation and career when he <a href=\"https:\/\/dailycaller.com\/2019\/06\/24\/trump-e-jean-carroll-rape-not-my-type\/\">denied<\/a> her allegations. <strong><a href=\"https:\/\/dailycaller.com\/2019\/06\/27\/e-jean-carroll-trump-rape-claim\/\">(RELATED:\u00a0E Jean Carroll Says She Has \u2018Not Been Raped\u2019 Following Trump Accusation)<\/a><\/strong><\/p>\n<p>The DOJ, according to a court filing made Monday with the U.S. Circuit Court of Appeals, noted that while it isn\u2019t \u201cendorsing\u201d Trump\u2019s conduct, the former president was acting \u201cwithin the scope of\u201d his job at the time as an elected official.<\/p>\n<p>\u201cIn making and defending a Westfall Act certification \u2026 the Department of Justice is not endorsing the allegedly tortious conduct or representing that it actually furthered the interests of the United States. Nor is a reviewing court making any such determinations in upholding the Department\u2019s certification,\u201d Brian Boynton, the acting head of the Justice Department\u2019s Civil Division, <a href=\"https:\/\/www.documentcloud.org\/documents\/20799187-dojcarrollrpybrf060721\">wrote.<\/a><\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-2\">\u201cSpeaking to the public and the press on matters of public concern is undoubtedly part of an elected official\u2019s job,\u201d he noted. \u201cCourts have thus consistently and repeatedly held that allegedly defamatory statements made in that context are within the scope of elected officials\u2019 employment \u2014 including when the statements were prompted by press inquiries about the official\u2019s private life.\u201d<\/p>\n<div id=\"attachment_7208602\" class=\"wp-caption aligncenter\" readability=\"35\"><img decoding=\"async\" aria-describedby=\"caption-attachment-7208602\" loading=\"lazy\" class=\"size-full wp-image-7208602\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/06\/GettyImages-1186744429-scaled-1.jpg\" alt=\"E. Savenok\/Getty Images for Glamour)<\/p>\n<\/div>\n<p>Former Attorney General William Barr previously moved to back Trump\u2019s defense, prompting it to move from New York state court to federal court. This allowed the Justice Department to represent Trump, The Hill <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/557266-biden-doj-to-defend-trump-in-e-jean-carroll-defamation-lawsuit\">reported<\/a>.<\/p>\n<p>The current DOJ\u2019s position agrees with the idea that Trump can\u2019t be sued for defamation, as he made the comments while he was president. The decision wasn\u2019t discussed with the White House, which appeared to distance itself from the backing.<\/p>\n<p>\u201cThis is in active litigation, and so we refer you to the Department of Justice concerning its court filings,\u201d White House spokesperson Andrew Bates said <a href=\"https:\/\/www.politico.com\/news\/2021\/06\/07\/biden-justice-department-defends-trump-in-suit-over-rape-denial-492088\">according<\/a> to Politico. \u201cThe White House was not consulted by DOJ on the decision to file this brief or its contents. While we are not going to comment on this ongoing litigation, the American people know well that President Biden and his team have utterly different standards from their predecessors for what qualify as acceptable statements.\u201d<\/p>\n<p><a href=\"https:\/\/dailycaller.com\/2019\/06\/24\/e-jean-carroll-book-trump\/\">Carroll<\/a> said in a statement to Politico that she is \u201cangry\u201d and \u201coffended\u201d by the development.<\/p>\n<p>\u201cAs women across the country are standing up and holding men accountable for assault \u2014 the DOJ is trying to stop me from having that same right. I am angry! I am offended!\u201d she said.<\/p>\n<p>Similarly, Carroll\u2019s attorney Roberta Kaplan said \u201cit is truly shocking\u201d that the DOJ is allowing \u201cTrump to get away with lying about\u201d the alleged incident.<\/p>\n<p>\u201cIt is horrific that Donald Trump raped E. Jean Carroll in a New York City department store many years ago,\u201d Kaplan said according to Politico. \u201cBut it is truly shocking that the current Department of Justice would allow Donald Trump to get away with lying about it, thereby depriving our client of her day in court.
