The case <\/span><a href=\"https:\/\/casetext.com\/case\/united-states-v-vaello-madero-1\"><span>United States v. Vaello-Madero<\/span><\/a> <span>follows Jos\u00e9 Luis Vaello-Madero, who was born in Puerto Rico born in 1954 and moved to New York in 1985. <\/span><span>He continued to received <a href=\"https:\/\/www.ssa.gov\/ssi\/\" target=\"_blank\" rel=\"noopener noreferrer\">SSI<\/a> \u2014 a government program that provides assistance to low-income households of Americans aged 65 or older, or with disabilities \u2014 when he returned to Puerto Rico, which the Justice Department says violated the program requirements, according to <a href=\"https:\/\/harvardlawreview.org\/2021\/01\/united-states-v-vaello-madero\/\" target=\"_blank\" rel=\"noopener noreferrer\">Harvard Law Review<\/a>. <\/span><strong><a href=\"https:\/\/dailycaller.com\/2021\/04\/14\/conda-the-economics-of-puerto-rico-statehood\/\">(RELATED: Opinion: The Economics Of Puerto Rico Statehood)<\/a><\/strong><\/p>\n<p><span>The SSI program is <a href=\"https:\/\/www.ssa.gov\/policy\/docs\/factsheets\/cong_stats\/2002\/pr.html\" target=\"_blank\" rel=\"noopener noreferrer\">only<\/a> available to residents of the fifty states, the District of Columbia, and the unincorporated territory of the Northern Mariana Islands, and the program doesn\u2019t include <\/span><a href=\"https:\/\/dailycaller.com\/2021\/04\/30\/poll-democrats-puerto-rico-statehood-more-puerto-ricans-power-politics-referendum\/\"><span>Puerto Rico<\/span><\/a><span>.<\/span><\/p>\n<p><span>Vaello-Madero moved back to <\/span><a href=\"https:\/\/dailycaller.com\/2021\/04\/30\/puerto-rico-washington-dc-statehood-democrats\/\"><span>Puerto Rico<\/span><\/a><span> in 2013 to take care of his wife and continued receiving benefits. During the summer of 2016, Vaello-Madero was notified by the Social Security Administration that he couldn\u2019t receive any more benefits due to his move, according to <a href=\"https:\/\/harvardlawreview.org\/2021\/01\/united-states-v-vaello-madero\/\" target=\"_blank\" rel=\"noopener noreferrer\">Harvard Law Review<\/a>.<\/span><\/p>\n<p><span> The federal government later asked the District of Puerto Rico to give the $28,081 it gave to Vaello-Madero from 2013 to 2016. The district court later denied the government\u2019s request, according to <\/span><a href=\"https:\/\/harvardlawreview.org\/2021\/01\/united-states-v-vaello-madero\/\"><span>Harvard Law Review<\/span><\/a><span>.\u00a0<\/span><\/p>\n<p><span>The Supreme Court will decide whether Congress violated the <\/span><a href=\"https:\/\/www.law.cornell.edu\/constitution\/fifth_amendment\"><span>Fifth Amendment<\/span><\/a><span> by creating a program that does not extend to Puerto Rico, specifically focusing on the equal-protection component which states no person will \u201cbe deprived of life, liberty, or property, without due process of law.\u201d\u00a0<\/span><\/p>\n<blockquote class=\"twitter-tweet\" readability=\"10.170798898072\">\n<p dir=\"ltr\" lang=\"en\">Biden issues a statement in advance of DOJ\u2019s <a href=\"https:\/\/twitter.com\/hashtag\/SCOTUS?src=hash&#038;ref_src=twsrc%5Etfw\">#SCOTUS<\/a> filing in the Puerto Rico SSI case, saying that PR\u2019s exclusion from SSI \u201cis inconsistent with my Administration\u2019s policies and values,\u201d but that DOJ will defend it.
