The piece discussed a Fort Lauderdale shooting which left two FBI agents dead and three wounded.<\/span><\/p>\n<p><span>\u201cTwo FBI agents were killed and three were wounded in a shooting early Tuesday while agents were serving a warrant in a child exploitation case in Florida, according to the FBI. The suspect died of an apparent self-inflicted gun shot wound, a person familiar with the matter said,\u201d reported USA Today at the time. \u201cAuthorities are investigating whether the suspect had cameras rigged at the apartment to provide an outside view of people who might be approaching at the time of the incident, said the source, who is not authorized to comment publicly.\u201d<\/span><\/p>\n<p><span>According to <\/span><a href=\"https:\/\/www.politico.com\/news\/2021\/06\/03\/usa-today-subpeona-florida-shooting-491847\"><span>Politico<\/span><\/a><span>, the FBI served a <\/span><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.231951\/gov.uscourts.dcd.231951.1.1.pdf\"><span>subpoena<\/span><\/a><span> to USA Today\u2019s publisher in April, which \u201cseeks information about who accessed the news article online during a 35-minute window starting just after 8 p.m. on the day of the shootings.\u201d<\/span><\/p>\n<p><span>The demand for information is \u201csigned by a senior FBI agent in Maryland,\u201d and asks for internet addresses and mobile phone information that could then be used to identify specific readers. The FBI is claiming that this information \u201c<\/span><span>relates to a federal criminal investigation being conducted by the FBI.\u201d<\/span><\/p>\n<p><span>In a filing in U.S. District Court, lawyers for USA Today\u2019s publisher, Gannett, accused the FBI of violating the First Amendment in its demand. Politico reported that Gannett\u2019s legal team \u201calso complained that the FBI appears to have ignored the Justice Department\u2019s policy for seeking information from the media.\u201d<\/span><\/p>\n<p><span>\u201cA government demand for records that would identify specific individuals who read specific expressive materials, like the Subpoena at issue here, invades the First Amendment rights of both publisher and reader, and must be quashed accordingly,\u201d Gannett attorneys Charles Tobin and Maxwell Mishkin wrote on behalf of USA Today.<\/span><\/p>\n<p><span>Gannett\u2019s motion was filed on May 28, just one day before the FBI\u2019s response deadline. \u201cThe motion was made public by U.S. District Court in Washington on Thursday,\u201d added Politico. \u201cThe case has been assigned to Judge James Boasberg, an appointee of President Barack Obama.\u201d<\/span><\/p>\n<p><span>This news comes as the Obama, Trump, and now Biden administration face <\/span><a href=\"https:\/\/www.dailywire.com\/news\/joe-biden-rips-trump-for-doing-the-same-thing-the-obama-administration-did\"><span>scrutiny<\/span><\/a><span> for engaging in and defending the seizure of journalistic records, such as phone records.<\/span><\/p>\n<p><span>\u201cWe were surprised to receive this subpoena particularly in light of President Biden\u2019s recent statements in support of press freedom,\u201d USA Today publisher Maribel Perez Wadsworth said in a statement, as reported by <a href=\"https:\/\/www.theverge.com\/2021\/6\/5\/22519653\/usa-today-fbi-ip-address-identifying-info-request-florida-shooter\">The Verge<\/a>. \u201cThe subpoena is also contrary to the Justice Department\u2019s own guidelines concerning the narrow circumstances in which subpoenas can be issued to the news media.\u201d<\/span><\/p>\n<p><i><span>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
