Despite his recent assurances, the Obama-Biden administration spied on some of the very same<em>\u00a0<\/em>reporters, and the Biden administration has even publicly defended Trump\u2019s actions.<\/p>\n<p>Last week, CNN\u2019s Kaitlan Collins <a href=\"https:\/\/twitter.com\/kaitlancollins\/status\/1395871101331386373\">asked<\/a> Biden his thoughts about \u201cseizing reporters\u2019 phone records and emails.\u201d<\/p>\n<p>The practice of secretly asking a court to give the administration access to such data, usually to find out who is leaking information to the media, is \u201cabsolutely, positively wrong,\u201d Biden said.<\/p>\n<p>\u201cSo, you won\u2019t let your Justice Department do that?\u201d Collins asked.<\/p>\n<p>\u201cI will not let that happen,\u201d Biden <a href=\"https:\/\/www.dailywire.com\/news\/watch-biden-sparks-controversy-with-comments-about-refusing-to-seize-reporters-records\">promised<\/a>.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"9.15859030837\">\n<p lang=\"en\" dir=\"ltr\">\u201cIt\u2019s simply, simply wrong. I will not let that happen,\u201d President Biden tells me about the Justice Department seizing the records of reporters. <a href=\"https:\/\/t.co\/bRL88NssMr\">pic.twitter.com\/bRL88NssMr<\/a><\/p>\n<p>\u2014 Kaitlan Collins (@kaitlancollins) <a href=\"https:\/\/twitter.com\/kaitlancollins\/status\/1395871101331386373?ref_src=twsrc%5Etfw\">May 21, 2021<\/a><\/p>\n<\/blockquote>\n<p>The president clearly wanted to put himself in a positive light compared to his predecessor, whose administration obtained reporters\u2019 private contacts. Under President Trump, the Justice Department secretly surveilled four reporters from <a href=\"https:\/\/www.washingtonexaminer.com\/news\/trump-justice-department-records-new-york-times-journalists-comey-leak-investigation\">The New York Times<\/a> (Matt Apuzzo, Adam Goldman, Eric Lichtblau, and Michael S. Schmidt); at least three reporters at <a href=\"https:\/\/www.washingtonexaminer.com\/news\/trump-department-of-justice-obtained-journalists-records\">The Washington Post<\/a> (Adam Entous, Greg Miller, and Ellen Nakashima); and one reporter at <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/defense-national-security\/cnns-barbara-starrs-phone-and-email-records-secretly-obtained-by-trump-doj\">CNN<\/a> (Barbara Starr).<\/p>\n<p>But Joe Biden\u2019s record in the executive branch is hardly encouraging, whether as president or vice president.<\/p>\n<p>The Obama administration <a href=\"https:\/\/www.wired.com\/2013\/05\/doj-got-reporter-phone-records\/\">snooped<\/a> on five Associated Press reporters who broke a story about a foiled al-Qaeda plot in 2012, as well as their editor (Matt Apuzzo, Adam Goldman, Kimberly Dozier, Eileen Sullivan, Alan Fram, and editor Ted Bridis). You\u2019ll note two of the names \u2014 Matt Apuzzo and Adam Goldman \u2014 are the <em>same <\/em>reporters whose surveillance Biden now calls \u201csimply, simply wrong.\u201d<\/p>\n<p>To get their information, Obama grabbed records from 20 phone lines, including the reporters\u2019 private numbers and the general AP number used by a total of <a href=\"https:\/\/nypost.com\/2018\/09\/08\/obama-who-once-surveilled-reporters-criticizes-trump-over-press-freedom\/\">100 reporters<\/a> in the House of Representatives.<\/p>\n<p>The AP described the Obama-Biden administration\u2019s actions as \u201cserious interference with AP\u2019s constitutional rights to gather and report the news.\u201d<\/p>\n<p>\u201cThere can be no possible justification for such an overbroad collection of the telephone communications of The Associated Press and its reporters,\u201d AP CEO Gary Pruitt\u00a0wrote in <a href=\"https:\/\/www.wired.com\/images_blogs\/threatlevel\/2013\/05\/Letter-to-Eric-Holder_reporter-call-records.pdf\">a letter<\/a> to then-Attorney General (and self-described Obama \u201c<a href=\"https:\/\/www.politico.com\/blogs\/politico44\/2013\/04\/eric-holder-im-still-the-presidents-wingman-160861\">wingman<\/a>\u201d) Eric Holder.<\/p>\n<p>They didn\u2019t leave it at that. The Obama administration also spied on <a href=\"https:\/\/www.dailywire.com\/news\/fact-check-obama-claimed-he-merely-complained-ashe-schow\">Fox News reporter James Rosen<\/a>, prying into his personal phone line and private emails. To get the warrant for these records, the administration named Rosen a potential \u201ccriminal co-conspirator,\u201d although he was <a href=\"https:\/\/www.sandiegouniontribune.com\/opinion\/the-conversation\/sd-before-trump-obama-prosecuted-leaks-20170804-htmlstory.html\">never charged<\/a> with a crime.<\/p>\n<p>The Obama-Biden administration looked not only at the phone and emails records, but even the personal banking and credit records of <a href=\"https:\/\/www.dailywire.com\/news\/fact-check-obama-claimed-he-merely-complained-ashe-schow\">The New York Times reporter James Risen<\/a> \u2014 a move that continued the actions of the George W. Bush administration.<\/p>\n<p>\u201cThe Obama administration pursued leaks as vigorously as the Trump administration, in many ways, and actually used the Espionage Act to try to track down leakers and punish them more than all previous administrations put together,\u201d said Eugene Robinson, a \u201cMorning Joe\u201d contributor and Washington Post editor, on Friday. \u201cThat was definitely a step down the slippery slope.\u201d<\/p>\n<p>Sitting on the \u201cMorning Joe\u201d panel, former Obama administration DHS Secretary Jeh Johnson admitted, \u201cI would not rule out in all circumstances subpoenaing the records of a reporter who is the recipient of a major national security breach,\u201d because \u201cit can jeopardize national security, jeopardize foreign relations.\u201d<\/p>\n<p>Not only has Biden been part of an administration that aggressively looked into the <a href=\"https:\/\/sharylattkisson.com\/2017\/12\/obama-era-surveillance-timeline\/\">private records of reporters<\/a> but, as president, his Department of Justice has defended the actions of the Trump administration\u2019s DOJ.<\/p>\n<p>The process Trump\u2019s DOJ used to obtain reporters\u2019 records \u201cfollows the established procedures within its media guidelines policy,\u201d <a href=\"https:\/\/www.washingtonexaminer.com\/news\/biden-administration-defends-trump-seizing-journalists-phone-records\">said<\/a> Biden Justice Department spokesman Marc Raimondi last month. \u201cThe targets of these investigations are not the news media recipients but rather those with access to the national defense information who provided it to the media and thus failed to protect it as lawfully required.\u201d<\/p>\n<p>The policy continuation has not been lost on everyone in the legacy media. CNN\u2019s Brian Stelter <a href=\"https:\/\/www.dailywire.com\/news\/everything-you-missed-from-cable-news-experts-this-weekend\">asked<\/a> a Washington Post reporter last month, \u201cDoes it strike you that it\u2019s the Biden DOJ defending what the Trump DOJ did, and before it was the Trump administration, the Obama DOJ was engaging in this kind of subpoenaing of reporter phone records?
