Eric Swalwell\u2019s attorneys are reportedly having trouble serving a lawsuit to Republican Alabama Rep. Mo Brooks accusing him of helping incite the Jan. 6 Capitol riot, according to a new court filing.<\/p>\n<p>The attorneys asked a judge for additional time to serve the complaint Wednesday, according to <a href=\"https:\/\/thehill.com\/homenews\/house\/556616-swalwell-attorneys-having-difficulty-serving-brooks-with-lawsuit-report\" target=\"_blank\" rel=\"noopener noreferrer\">The Hill<\/a>, also requesting that a U.S. Marshal or other official serve the complaint due to issues finding <a href=\"https:\/\/dailycaller.com\/2021\/05\/12\/exclusive-republicans-to-introduce-legislation-calling-for-colleges-to-disclose-foreign-influence\/\" target=\"_blank\" rel=\"noopener noreferrer\">Brooks<\/a>, in addition to \u201crecovery of costs associated\u201d with trying to serve the suit.<\/p>\n<p>The suit was first <a href=\"https:\/\/dailycaller.com\/2021\/03\/05\/eric-swalwell-sues-trump-responsible-capitol-riot\/\" target=\"_blank\" rel=\"noopener noreferrer\">filed in March<\/a> against Brooks, as well as former President Donald Trump and former New York City Mayor Rudy Giuliani and accused them of provoking the Capitol Hill riot.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"4.3711340206186\">\n<p dir=\"ltr\" lang=\"en\">Where in the world is <a href=\"https:\/\/twitter.com\/MoBrooks?ref_src=twsrc%5Etfw\">@MoBrooks<\/a>? <a href=\"https:\/\/t.co\/zomrZRhcsE\">https:\/\/t.co\/zomrZRhcsE<\/a><\/p>\n<p>\u2014 Reed Galen (@reedgalen) <a href=\"https:\/\/twitter.com\/reedgalen\/status\/1400247452523892736?ref_src=twsrc%5Etfw\">June 3, 2021<\/a><\/p>\n<\/blockquote>\n<p>In the <a href=\"https:\/\/assets.documentcloud.org\/documents\/20796707\/6-2-21-swalwell-motion-for-extension.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">9-page motion<\/a> filed by Swalwell\u2019s attorneys, they asked for a 60-day extension, telling the judge that it was necessary \u201cin light of [Brooks\u2019] ongoing refusal to waive service and the inherent difficulties of attempting service on a sitting member of congress.\u201d<\/p>\n<p>The motion claimed that Swalwell\u2019s counsel had reached out to Brooks\u2019 office on two separate occasions with no response, before reaching out via email with a formal waiver request.<\/p>\n<p>Swalwell\u2019s attorneys allegedly hired a private investigator to find out where Brooks was so they could serve the suit, according to the motion, calling it a \u201cdifficult feat under normal circumstances.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2021\/05\/14\/eric-swalwell-rebuffs-marjorie-taylor-greene-aide-ditch-mask\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018You Don\u2019t Tell Me What To F**king Do!\u2019: Eric Swalwell Rebuffs Marjorie Taylor Greene Aide For Telling Him He Can Ditch His Mask)<\/a><\/strong><\/p>\n<blockquote class=\"twitter-tweet\" readability=\"7.4328358208955\">\n<p dir=\"ltr\" lang=\"en\">Attorneys for Rep.
