Kristi Noem\u2019s request for a permit allowing fireworks over Mount Rushmore to celebrate\u00a0Independence Day, <a href=\"https:\/\/thehill.com\/policy\/energy-environment\/556566-judge-rebuffs-gov-kristi-noems-bid-for-july-4th-fireworks-at-mount?rl=1\" target=\"_blank\" rel=\"noopener\">The Hill <\/a>reported Wednesday.<\/p>\n<p>President Joe Biden&#8217;s\u00a0administration initially denied Noem\u2019s permit request to celebrate the Fourth of July\u00a0with fireworks, citing the COVID-19 pandemic and respect for\u00a0Native American tribes as\u00a0reasons.<\/p>\n<p>\u201cPotential risks to the park itself and to the health and safety of employees and visitors associated with the fireworks demonstration continue to be a concern and are still being evaluated as a result of the 2020 event,\u201d wrote Herbert Frost, National Park\u00a0Service\u00a0regional director, at the time the denial was issued. \u201cIn addition, the park\u2019s many tribal partners expressly oppose fireworks at the Memorial. These factors, compiled with the COVID-19 pandemic, do not allow safe and responsible fireworks display to be held at this site.\u201d<\/p>\n<p>Noem sued to appeal the denial.<\/p>\n<p>U.S. District Judge Roberto Lange, an appointee of President Barack Obama, issued the 36-page decision, which denied preliminary judgment to Noem based on the unlikelihood of her prevailing in her suit against federal officials, according to the report.<\/p>\n<p>\u201cThis Court fully understands the State&#8217;s position and why this suit was brought,\u201d Lange\u2019s decision read. \u201cBut under governing law, the State is unlikely to succeed on the merits of its claims and has not met the requirements for interim legal relief.\u201d<\/p>\n<p>Lange said in his decision that the reasons cited by the Biden administration were not &#8220;arbitrary and capricious.&#8221;<\/p>\n<p>Noem said she would appeal the decision.<\/p>\n<p>&#8220;I am disappointed that the court gave cover to this unlawful action with today\u2019s decision. But rest assured, this fight is not over,&#8221; Noem said.\u00a0<\/p>\n<p>&#8220;My legal team will appeal this incorrect decision so that we can return the Fireworks Celebration to Mount Rushmore and celebrate our nation\u2019s birthday at America\u2019s Shrine to Democracy for next year and in the future,\u201d Noem said in a statement following the ruling.<\/p>\n<p>Last year, President Donald\u00a0Trump held a national celebration at the monument for the first time since 2009, when the celebration was paused due to concerns about wildfires, <a href=\"https:\/\/www.cnn.com\/2020\/07\/03\/politics\/trump-mount-rushmore-fireworks\/index.html\" target=\"_blank\" rel=\"noopener\">CNN reported<\/a> at the time.<\/p>\n<p>The gathering was criticized for the lack of masks and social distancing amid the pandemic.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A South Dakota federal judge has further denied Republican Gov.
