Ron DeSantis\u2019s decision to sign a bill banning biological males from women\u2019s sports was \u201cstrengthened\u201d by pressure from woke corporations like the NCAA, the governor\u2019s press secretary told the Daily Caller News Foundation.<\/p>\n<p>DeSantis signed the\u00a0<a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2021\/1475\/BillText\/Filed\/PDF\">Fairness in Women\u2019s Sports Act<\/a> Tuesday, legislation that prohibits biological males from participating in athletic teams or sports designated for female students. Kristi Noem <a href=\"https:\/\/dailycaller.com\/2021\/03\/30\/noem-south-dakota-bill-explains\/\">refused to sign<\/a> a similar South Dakota bill without her suggested changes. The governor insisted that the bill would subject South Dakota to lawsuits the state could not win and said she seeks to \u201cprotect girls\u201d through other measures, including\u00a0two executive orders: one to \u201c<a href=\"https:\/\/sdsos.gov\/general-information\/executive-actions\/executive-orders\/assets\/2021-05.PDF\">protect fairness in K-12 athletics<\/a>\u201d and another to \u201c<a href=\"https:\/\/sdsos.gov\/general-information\/executive-actions\/executive-orders\/assets\/2021-06.PDF\">do so in college athletics<\/a>.\u201d<\/p>\n<p>Noem continues to push back on assertions that she\u00a0<a href=\"https:\/\/dailycaller.com\/2021\/03\/22\/tucker-noem-south-dakota-bill-womens-sports\/\">caved to pressure<\/a> from groups like the NCAA, emphasizing that she wants long-term solutions that will protect South Dakota girls. <strong><a href=\"https:\/\/dailycaller.com\/2021\/03\/30\/noem-south-dakota-bill-explains\/\">(RELATED: Here\u2019s Why Noem Fought South Dakota\u2019s Bill Banning Biological Males From Women\u2019s Sports)<\/a><\/strong><\/p>\n<p>\u201cSince November, my team and I have worked to find the best way to defend women\u2019s sports effectively \u2014 not just to feel good, but to do good,\u201d Noem\u00a0<a href=\"https:\/\/www.nationalreview.com\/2021\/03\/fighting-smart-for-fairness-in-womens-sports\/\">wrote in a March National Review op-ed<\/a>. \u201cWe have to be able to win in court.\u201d<\/p>\n<p>\u201cIt is for that reason that I asked the South Dakota state legislature to make revisions to HB 1217,\u201d Noem wrote. \u201cAs passed, this bill was a trial lawyer\u2019s dream. Noem\u2019s action on HB 1217 sparked distrust from conservatives like American Principles Project President Terry Schilling, who suggested that many conservatives now see DeSantis as \u201cthe gold standard of Republican leadership in 2021.\u201d<\/p>\n<p>\u201cWhat distinguishes the approaches of Governors Kristi Noem and Ron DeSantis on defending women\u2019s sports is one simple thing: political courage,\u201d Schilling told the DCNF, accusing Noem of caving to pressure from \u201cwoke business interests and the NCAA to kill the legislation.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2021\/03\/22\/noem-political-theater-adf-biological-males-womens-sports\/\">(RELATED: Conservatives Accuse Noem Of \u2018Political Theater\u2019 Over Bill Banning Biological Males From Women\u2019s Sports)<\/a><\/strong><\/p>\n<p>\u201cUnfortunately she caved to that pressure, and her weak defense was that she could only take action once a sufficient coalition existed on the issue,\u201d Schilling said. \u201cBy contrast, Gov. DeSantis did the smart thing when faced with woke elite pressure: he didn\u2019t back down. This is the essence of real leadership \u2014 good leaders don\u2019t wait for others to join them before taking a stand. Instead, they set an example for others to follow, as DeSantis has done on this and many other important issues.\u201d<\/p>\n<p>Pushaw shied away from comparing DeSantis and Noem, telling the DCNF that \u201cDeSantis is focused on Florida\u201d and that the governor prefers not to engage in competitions or comparisons with other governors.<\/p>\n<p>\u201cHe just doesn\u2019t see things that way,\u201d she said, \u201cor even pay much attention to what\u2019s going on in other states necessarily because he\u2019s focused on Florida and wants to do what\u2019s best for Florida, regardless of what happens or does not happen in other states. It doesn\u2019t factor into his calculations as far as the decision that he makes here.\u201d<\/p>\n<h3>The Florida Bill and the South Dakota Bill: How Are They Different?<\/h3>\n<p>South Dakota\u2019s bill, or\u00a0<a href=\"https:\/\/legiscan.com\/SD\/text\/HB1217\/id\/2271801\">H.B. 1217,<\/a> applied to all athletic teams or sports sponsored by a public school, school district, or institution of higher education under the control of the Board of Regents or the South Dakota Board of Technical Education. The bill not only banned biological males from participating in women\u2019s sports but also established that there are only two biological sexes (male and female) and that there are \u201cinherent\u201d differences between men and women.<\/p>\n<p>South Dakota\u2019s bill does not mention birth certificates, but one of Noem\u2019s revisions suggested that a student\u2019s enrollment on a team must be based on their biological sex \u201cas reflected on the birth certificate or affidavit provided upon initial enrollment.\u201d<\/p>\n<p>Critics like the American Principle Project\u2019s <a href=\"https:\/\/jonschweppe.substack.com\/p\/the-kristi-noem-veto-explained\">Jon Schweppe<\/a> point out that this revision does not take into account transgender students who amended their birth certificates, allowable under <a href=\"https:\/\/casetext.com\/regulation\/south-dakota-administrative-rules\/title-44-department-of-health\/article-4409-public-health-statistics\/chapter-440905-amendment-of-records\/section-44090502-requirements-for-amending-vital-records\">South Dakota administrative law,<\/a> as the National Center for Transgender Equality <a href=\"https:\/\/transequality.org\/documents\/state\/south-dakota\">noted<\/a>.<\/p>\n<p>\u201cIn other words, under Noem\u2019s proposed changes, a biological male would easily be able to participate in women\u2019s sports in South Dakota (even in K-12) as long as he files the proper paperwork,\u201d Schweppe wrote in a March Substack.<\/p>\n<p>The Fairness in Women\u2019s Sports Act applies to athletic teams or sports sponsored by a public secondary school, high school, public college, or university institution.<\/p>\n<p>The bill does not apply to elementary education, and specifies that teams be designated based on the biological sex on the student\u2019s birth certificate \u2014 which is \u201cconsidered to have correctly stated the student\u2019s biological sex at birth if the statement was filed at or near the time of the student\u2019s birth.\u201d<\/p>\n<p>Since Florida\u2019s bill specifically says \u201cat or near the time of the student\u2019s birth,\u201d the state avoided the pitfalls that Noem\u2019s revisions presented, Schweppe said.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
