Version: 4.0.47--><div><img decoding=\"async\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/05\/Scott-Peterson.jpg?w=1200&amp;h=800&amp;ixlib=react-9.0.3\" class=\"ff-og-image-inserted\" \/><\/div>\n<p>A California district attorney filed a notice in court Friday indicating she no longer plans to seek a new death sentence against Scott Peterson, who was convicted of murdering his pregnant wife, Laci, in 2005 during a high-profile trial.<\/p>\n<p>The filing was first reported by The Modesto Bee, which described the move as \u201can about-face.\u201d The court document said prosecutors decided to change course after consulting with Laci Peterson\u2019s family.<\/p>\n<p><a href=\"https:\/\/www.modbee.com\/news\/local\/crime\/article251763358.html\">According<\/a> to the Bee, \u201cThe decision means Scott Peterson\u2019s sentence would remain life without the possibility of parole.\u201d The outlet reported, \u201cIt was reverted to that in August when the California Supreme Court overturned his death sentence for the murder of his wife, Laci, and their unborn son, Conner, because it said the trial judge erred by excluding potential jurors opposed to the death penalty.\u201d<\/p>\n<p>Stanislaus County District Attorney Birgit Fladager said in her filing that Laci\u2019s family has \u201cno doubt\u201d Scott killed his wife and unborn son but opted to drop efforts to restore the death penalty because \u201cthis process is simply too painful to endure once again.\u201d<\/p>\n<p>The Associated Press <a href=\"https:\/\/www.latimes.com\/california\/story\/2021-05-28\/laci-peterson-case-d-a-wont-pursue-new-death-penalty-against-husband-convicted-of-murder\">reported<\/a>, \u201cPeterson, now 48, was convicted in San Mateo court after his trial was moved from Stanislaus County because of the massive pre-trial publicity that followed the Christmas Eve 2002 disappearance of 27-year-old Laci, who was eight months pregnant.\u201d According to the AP, \u201cInvestigators say Peterson took the bodies from their Modesto home and dumped them from his fishing boat into San Francisco Bay, where they surfaced months later.\u201d<\/p>\n<p>Peterson has maintained his innocence and could still get a new trial if his conviction is overturned.<\/p>\n<p>The California Supreme Court also ruled last year that \u201ca trial court must decide whether one of the jurors intentionally withheld information on a questionnaire in order to get on the jury,\u201d The Bee reported.<\/p>\n<p>On Friday, The Bee spoke to Peterson\u2019s attorney by phone, who claims he has new evidence that proves his client is innocent.<\/p>\n<p>\u201cWe want to show in a court of law before an unbiased jury, without all the headlines and the craziness that went into the first trial,\u201d said defense attorney Pat Harris. \u201cWe want to show the evidence of who committed this murder.\u201d<\/p>\n<p>Harris said he did not know whether prosecutors could pursue the death penalty again if Peterson is found guilty in a new trial.<\/p>\n<p>\u201cIt\u2019s not clear to me that they\u2019re saying no matter what, we\u2019re taking the death penalty off the table or they\u2019re saying if we go back to trial we\u2019re reserving the right to put the death penalty back up again,\u201d Harris told the AP. \u201cIt sounds like they\u2019re kind of holding back that if the judge orders a new trial, they could put the death penalty back on the table.\u201d<\/p>\n<p>Scott Peterson\u2019s family said they would inform him of the news on Saturday.<\/p>\n<p>The district attorney\u2019s office did not provide a comment to The Bee or AP.<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
