The gunman has been <a href=\"https:\/\/www.sfchronicle.com\/crime\/article\/Mass-shooting-in-San-Jose-What-we-know-so-far-16204689.php\">identified<\/a> in multiple reports as Samuel J. Cassidy, a 57-year-old VTA employee. He was also killed.<\/p>\n<p>Left-leaning politicians and media outlets immediately seized on the tragedy to renew their calls for stricter gun control, although the transit facility is a gun-free zone.<\/p>\n<p>The Valley Transit Authority website <a href=\"https:\/\/www.vta.org\/faq\/what-are-rules-ride-bus-and-light-rail\">states<\/a>:<\/p>\n<blockquote readability=\"9\">\n<p><em>It is unlawful for any person to possess any of the&nbsp;following items on a bus, train or transit facility:<\/em><\/p>\n<ol>\n<li><em>Any firearm<\/em><\/li>\n<li><em>Any imitation firearm as defined in California&nbsp;Penal Code (CPC) Section 417.4<\/em><\/li>\n<li><em>Any instrument that expels a metallic projectile,&nbsp;such as a BB or pellet, through the force of air&nbsp;pressure, CO2 pressure, or spring action, or&nbsp;any spot marker gun or paint gun<\/em><\/li>\n<li><em>Any metal military practice, metal or plastic&nbsp;replica hand grenade<\/em><\/li>\n<li><em>Any unauthorized tear gas weapon<\/em><\/li>\n<li><em>Any undetectable knife, as described in&nbsp;CPC Section 17290.<\/em><\/li>\n<\/ol>\n<p><strong><em>Violators will be prosecuted&nbsp;to the maximum penalty&nbsp;allowed by law pursuant&nbsp;to CPC 171.7(b).<\/em><\/strong><\/p>\n<\/blockquote>\n<p>Some <a href=\"https:\/\/www.dailywire.com\/news\/what-percentage-mass-shootings-happen-gun-free-amanda-prestigiacomo\">98%<\/a> of all mass shootings have taken place in gun-free zones since 1950, according to the <a href=\"https:\/\/crimeresearch.org\/2014\/09\/more-misleading-information-from-bloombergs-everytown-for-gun-safety-on-guns-analysis-of-recent-mass-shootings\/\">Crime Prevention Research Center<\/a>, although gun control activists dispute the number.<\/p>\n<p>Nonetheless, the Biden administration, state and local Democratic officials, and media talking heads seemed to indicate that stronger gun laws could have prevented the shooting.<\/p>\n<p>Their calls came despite the fact that they did not yet know the kind of firearm the assailant used while committing the crime. The weapon has still not been confirmed as of this writing.<\/p>\n<p>Cedric Richmond, a special adviser to Joe Biden and the director of the White House\u2019s <a href=\"http:\/\/therightswriter.com\/2009\/10\/valerie-jarretts-ministry-of-culture\/\">Office of Public Engagement<\/a>, went on MSNBC\u2019s \u201cKaty Tur Reports,\u201d telling guest anchor Geoff Bennett that Senate Republicans\u2019 refusal to pass Democratic gun control bills is \u201ca real failure to meet the needs of the American people.\u201d<\/p>\n<p>\u201cThere are bills right now sitting in the Senate that the Senate could take up and pass to protect people, protect families,\u201d said Richmond, a former five-term congressman from Louisiana.<\/p>\n<p>He added that eight families had lost a loved one in this shooting \u2014 implying these bills may have prevented their tragedy.<\/p>\n<p>Richmond said the San Jose shooting should jolt the nation into passing a host of new restrictions on the Second Amendment.<\/p>\n<p>\u201cAs a country, we should be outraged. We should not only offer our prayers, and our condolences, and our thoughts, but we ought to offer some action. And we ought to do things to prevent this,\u201d Richmond said, again implying the bills would have prevented Wednesday\u2019s shooting.<\/p>\n<p>President Joe Biden is \u201ctalking about everything from making sure that we have red flag laws, reduce the size of cartridges, ban assault weapons, universal background checks, close the Charleston loophole, doing all of those things that can protect American lives,\u201d Richmond told Bennett. \u201cIt\u2019s time. We really call upon Congress to get this done.\u201d<\/p>\n<p>Richmond noted that, as a U.S. senator, Biden \u201cpassed the assault weapons ban, and it\u2019s time for us to get another assault weapons ban in place. That ban also limited the size of the ammunition cartridges.\u201d Since the law has lapsed, the AR-15 has become the most popular rifle in the United States.<\/p>\n<p>Others who <a href=\"https:\/\/www.sfchronicle.com\/crime\/article\/Mass-shooting-in-San-Jose-What-we-know-so-far-16204689.php\">responded<\/a> to the deadly shooting by blaming \u201cgun culture,\u201d or clamoring for more legislation, include U.S. Sen. Dianne Feinstein of California, Berkeley Mayor Jesse Arreguin, and California Assemblymember Evan Low.<\/p>\n<p>Earlier in the \u201cKaty Tur Show,\u201d Bennett interviewed Jim Cavanaugh, a former special agent for the ATF, who called for a \u201cbetter mosaic of firearms laws\u201d at the federal level.<\/p>\n<p>\u201cThere\u2019s bills up there for background checks and ammunition capacity on assault weapons. There\u2019s some good bills up there that could help America. They need to work on those,\u201d said Cavanaugh, who <a href=\"https:\/\/apnews.com\/article\/84e066dac550f64a03ea3fee14d0b1ab\">defended<\/a> the ATF\u2019s actions during the deadly 1993 showdown with the Branch Davidians at Waco.<\/p>\n<p>\u201cState governments, likewise, should be working to make reasonable gun laws that don\u2019t hurt the citizens\u2019 constitutional rights but make us all safer,\u201d he continued. \u201cWe don\u2019t have that. In effect, what we\u2019ve passed is guns where everybody can open carry a rifle, walking all around, going into statehouses with rifles, walking all around. That\u2019s not making us safer. That\u2019s just letting people parade around with long guns for their own aggrandizement. It doesn\u2019t mean anything about a constitutional right, and it\u2019s certainly not making us any safer.\u201d<\/p>\n<p>MSNBC failed to report that California already has some of the strictest gun control laws in the nation.
