The definition of \u201caggravated felonies\u201d is itself flawed \u2014 a relic of the racist War on Drugs \u2014 and should not hide the agency\u2019s enforcement priorities. \u201cAggravated felonies,\u201d a term specific to immigration law, include offenses that are neither \u201caggravated\u201d nor \u201cfelonies\u201d \u2014 for example, this category has been interpreted to include many state drug misdemeanors. \u201cAggravated felonies\u201d as a category has been designed to ensure that people have as few rights as possible to fight detention and deportation. Moreover, we are concerned that the memorandum only requires that ICE officers have a \u201cgood faith belief\u201d that someone has an aggravated felony conviction even while acknowledging that such a determination is \u201ca complex question.\u201d<\/em><\/p>\n<\/blockquote>\n<p>The progressive members also take issue with \u201cracial profiling\u201d that allegedly takes place when an illegal alien is presumed to be an \u201cactive\u201d participant in gang activity.<\/p>\n<p>\u201cGiving ICE the discretion to determine what qualifies as \u2018gang activity\u2019 doubles down on an arbitrary and discriminatory framework used by law enforcement,\u201d the letter stated.<\/p>\n<p>\u201cWe are in a moment of racial reckoning in this country, with communities across the country calling for an end to mass incarceration and racist policing,\u201d the members of Congress wrote, adding that the Biden administration needs to \u201cend mass incarceration, criminalization and deportation of immigrants.\u201d<\/p>\n<p>Noteworthy signatories include \u201cSquad\u201d members Ayanna Pressley (D-MA), Rashida Tlaib (D-MI) Cori Bush (D-MO), Jamaal Bowman (D-NY), and Congressional Progressive Caucus Chair Pramila Jayapal (D-WA).<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"11.375\">\n<p lang=\"en\" dir=\"ltr\">Recently, we led 34 colleagues in calling on ICE to end the carceral approach to immigration. <\/p>\n<p>We need humane and just immigration policies that aim to end mass incarceration, criminalization and deportation of immigrants. <a href=\"https:\/\/t.co\/EInq4zMNA7\">pic.twitter.com\/EInq4zMNA7<\/a><\/p>\n<p>\u2014 Rep. Alexandria Ocasio-Cortez (@RepAOC) <a href=\"https:\/\/twitter.com\/RepAOC\/status\/1394368444045438986?ref_src=twsrc%5Etfw\">May 17, 2021<\/a><\/p>\n<\/blockquote>\n<p>According to the <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-12-part-f-chapter-4\">ICE Policy Manual<\/a>, an \u201caggravated felony\u201d includes:<\/p>\n<ul>\n<li>Murder, rape, or sexual abuse of a minor<\/li>\n<li>Illicit trafficking in controlled substance<\/li>\n<li>Illicit trafficking inf firearms or destructive devices<\/li>\n<li>Money laundering offenses (over $10,000)<\/li>\n<li>Explosive materials and firearms offenses<\/li>\n<li>Crimes of violence (imprisonment term of at least 1 yr)<\/li>\n<li>Theft offense (imprisonment term of at least 1 yr)<\/li>\n<li>Demand for or receipt of ransom<\/li>\n<li>Child pornography offense<\/li>\n<li>Racketeering, gambling (imprisonment term of at least 1 yr)<\/li>\n<li>Prostitution offenses (managing, transporting, trafficking)<\/li>\n<li>Gathering or transmitting classified information<\/li>\n<li>Fraud or deceit offenses or tax evasion (over $10,000)<\/li>\n<li>Alien smuggling<\/li>\n<li>Illegal entry or reentry by removed aggravated felon<\/li>\n<li>Passport, document fraud (imprisonment term of at least 1 yr)<\/li>\n<li>Failure to appear sentence (offense punishable by at least 5 yrs)<\/li>\n<li>Bribery, counterfeiting, forgery, or trafficking in vehicles<\/li>\n<li>Obstruction of justice, perjury, bribery of witness<\/li>\n<li>Failure to appear to court (offense punishable by at least 2 yrs)<\/li>\n<li>Attempt or conspiracy to commit an aggravated felony<\/li>\n<\/ul>\n<p>While not all of these \u201caggravated felonies\u201d are heinous crimes, completely doing away with the distinction would mean child predators, rapists, and murderers would be more likely to exploit our southern border, especially as the border crisis rages on.<\/p>\n<p><i>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
