Andrew Womble <a href=\"https:\/\/www.wavy.com\/andrew-brown\/pasquotank-da-holding-press-conference-tuesday-on-investigation-into-death-of-andrew-brown-jr\/\"><span class=\"s1\">stated<\/span><\/a> Tuesday that the shooting of Andrew Brown Jr. during an encounter with law enforcement last month was \u201cjustified\u201d as he discussed the results of an independent investigation conducted by the North Carolina State Bureau of Investigation.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Womble added that the three deputies involved in the incident who fired their weapons will not face charges. \u201cWhile tragic, the shooting of Mr. Brown was justified due to his actions,\u201d Womble <a href=\"https:\/\/www.wavy.com\/andrew-brown\/pasquotank-da-holding-press-conference-tuesday-on-investigation-into-death-of-andrew-brown-jr\/\"><span class=\"s1\">said<\/span><\/a>.<\/p>\n<p class=\"p1\">As reported by CNN, \u201cBrown was shot twice, including once in the back of the head, by Pasquotank County sheriff\u2019s deputies in Elizabeth City, North Carolina, on April 21 when they attempted to serve two felony warrants and a search warrant, Womble said. Four body-camera videos shown to the public for the first time showed the entirety of the incident, which lasts 44 seconds from the time officers exit their vehicle to the time Brown is removed from his.\u201d<\/p>\n<p class=\"p1\">CNN <a href=\"https:\/\/www.cnn.com\/2021\/05\/18\/us\/andrew-brown-jr-press-conference\/\"><span class=\"s1\">reported<\/span><\/a>:<\/p>\n<blockquote readability=\"44\">\n<p class=\"p1\"><i>The videos show that uniformed law enforcement officers arrived in a marked police truck to arrest Brown and surrounded him as he sat inside his vehicle.<\/i><\/p>\n<p class=\"p1\"><i>They ordered him to stop the car, Womble said, but Brown instead reversed his car into a corner, pulling a deputy who was trying to open the car door off his feet. Brown then accelerated forward in his attempt to flee, forcing the deputy to jump out of the way, the videos show.<\/i><\/p>\n<p class=\"p1\"><i>After Brown\u2019s vehicle drove toward the deputy, a sergeant on scene then fired into the front window, the videos show. The car continued forward, and officers fired several more shots at Brown from the side and through the back windshield, he said. Brown\u2019s vehicle accelerated across a vacant lot and drove at another officer sitting in an unmarked police vehicle, which accelerated to avoid a collision, Womble said.<\/i><\/p>\n<p class=\"p1\"><i>Brown\u2019s vehicle finally came to a rest against a tree, and the officers removed Brown and called for emergency services, he said.<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><\/p>\n<p class=\"p1\"><i>Womble said Brown\u2019s driving constituted a threat and justified the officers\u2019 decision to shoot at him. He also offered an expansive interpretation of what officers are legally allowed to do.<\/i><\/p>\n<p class=\"p1\"><i>\u201dWhen you employ a car in a way that puts officers\u2019 lives in danger, that is a threat,\u201d Womble said. \u201cAnd I don\u2019t care what direction you\u2019re going, forward, backwards, sideways. I don\u2019t care if you\u2019re stationary, and neither do our courts.\u201d<\/i><\/p>\n<\/blockquote>\n<p class=\"p1\">\u201cThe deputies faced both actual and apparent danger as perceived by them on the scene,\u201d Womble <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/north-carolina-sheriff-s-deputies-justified-fatally-shooting-andrew-brown-n1267744\"><span class=\"s1\">said<\/span><\/a>. \u201cThis apparent threat was reinforced by Brown\u2019s dangerous and felonious use of a deadly weapon. As tragic as this incident is with the loss of life, the deputies on scene were nonetheless justified in defending themselves from death or great bodily injury.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">He added, \u201cThere is insufficient evidence beyond a reasonable doubt to show that any of the deputies acted in a manner that was inconsistent with their perception of an apparent threat.\u201d<\/p>\n<p class=\"p1\">NBC News <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/north-carolina-sheriff-s-deputies-justified-fatally-shooting-andrew-brown-n1267744\"><span class=\"s1\">reported<\/span><\/a> that Womble discussed <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/plumhoff-v-rickard\/\"><span class=\"s1\">case law<\/span><\/a> that allows police to have discretion in utilizing deadly force against a suspect who is fleeing.<\/p>\n<p class=\"p1\">\u201cOnce a threat is perceived \u2026 and the officers fire the first shot, if the first shot is justified, the last shot is justified until the threat is extinguished,\u201d Womble said.<\/p>\n<p class=\"p1\">Attorneys for Brown\u2019s family have been vocal about the shooting and <a href=\"https:\/\/www.dailywire.com\/news\/fbi-announces-investigation-into-andrew-brown-jr-shooting\"><span class=\"s1\">spoke<\/span><\/a> out last month about the clip from body camera footage they were able to view at the time. Wayne Kendall, one of the lawyers, <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/andrew-brown-jr-shot-five-times-once-back-head-according-n1265460\"><span class=\"s1\">said<\/span><\/a>, \u201cThis, in fact, was a fatal wound to the back of Mr. Brown\u2019s head as he was leaving the site trying to evade being shot at by these particular law enforcement officers that we believe did nothing but a straight-up execution.\u201d<\/p>\n<p class=\"p1\">Brown family attorney Bakari Sellers said in a statement to CNN that the attorneys will be filing a petition to put out all of the body camera footage and State Bureau of Investigation (SBI) report.
