Twitter balked. The Biden DOJ withdrew the subpoena, a person familiar with the matter said. <a href=\"https:\/\/t.co\/EO8ihrg7Yt\">https:\/\/t.co\/EO8ihrg7Yt<\/a><\/p>\n<p>\u2014 Charlie Savage (@charlie_savage) <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.224281\/gov.uscourts.dcd.224281.3.0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">motion to dismiss<\/a> the subpoena, Twitter stated that the DOJ sought \u201cnames, addresses, local and long-distance telephone records\u201d among other details related to the account, which Twitter refused to provide.<\/p>\n<p>\u201c[Nunes\u2019s] efforts to suppress critical speech are as well-publicized as they are unsuccessful,\u201d the motion says, pointing to a <a href=\"https:\/\/dailycaller.com\/2019\/03\/18\/devin-nunes-suing-twitter\/\" target=\"_blank\" rel=\"noopener noreferrer\">2019 lawsuit<\/a> for $250 million against the company alleging the \u201cshadow-banning\u201d of conservatives.<\/p>\n<p>Twitter also suggested that the motion should be quashed if the subpoena was infringing on \u201ca Twitter user\u2019s first-amendment right to engage in anonymous speech,\u201d adding that they were \u201cconcerned\u201d a user was being targeted for political speech. <strong><a href=\"https:\/\/dailycaller.com\/2021\/05\/17\/twitter-suspends-politician-man-cannot-get-pregnant\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Spanish Politician Suspended From Twitter For Saying \u2018A Man Cannot Get Pregnant\u2019)<\/a><\/strong><\/p>\n<p>The company also asked that the gag order be vacated as well, stating the order could not \u201cwithstand strict scrutiny under the first amendment.\u201d<\/p>\n<p>The account responded to the subpoena on Tuesday, according to the Guardian, stating that the court record release was \u201cthe closest thing [they an effort to fight the lawsuit, The Guardian reported.<\/p>\n<p>Twitter is also <a href=\"https:\/\/dailycaller.com\/2021\/03\/09\/twitter-lawsuit-texas-attorney-general-ken-paxton-censorship-retaliation\/\" target=\"_blank\" rel=\"noopener noreferrer\">suing Texas Attorney General<\/a> Ken Paxton, alleging that the office was being used in retaliation for the removal of President Trump off of the platform, while Paxton claims the suit is a \u201ccoordinated
