Sealy Massingill <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2021\/05\/177114225527.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">sued<\/a> the city Monday night, alleging the \u201cOrdinance Outlawing Abortion\u201d violates the Fourteenth Amendment.<\/p>\n<p>\u201cIt imposes substantial liability on anyone who procures, performs, aids, or abets an abortion in Lubbock, be it a doctor, nurse, relative, friend, or stranger,\u201d the complaint reads. The complaint also alleges the law violates state law because the city doesn\u2019t have the power to \u201ccreate civil liability between private parties.\u201d<\/p>\n<p>The city approved <a href=\"https:\/\/dailycaller.com\/2021\/05\/02\/lubbock-texas-abortion-ban-planned-parenthood\/\" target=\"_blank\" rel=\"noopener noreferrer\">the ordinance<\/a> on May 1 banning <a href=\"https:\/\/dailycaller.com\/2021\/05\/14\/greg-abbott-roe-v-wade-texas\/\" target=\"_blank\" rel=\"noopener noreferrer\">abortion<\/a> procedures within city limits. The measure passed with 62% of the vote, with the city joining dozens of other cities with similar ordinances. &nbsp;The ordinance is set to take effect June 1.<\/p>\n<p>Due to Roe v. Wade, the city government will not enforce the abortion ban, instead relying on citizens to sue, according to the <a href=\"https:\/\/www.texastribune.org\/2021\/05\/01\/lubbock-abortion-vote-sanctuary-unborn\/\" target=\"_blank\" rel=\"noopener noreferrer\">Texas Tribune<\/a>.<\/p>\n<p>The complaint argues the \u201clegal and financial risk to [Planned Parenthood] and to its personnel personally is too great,\u201d under the ordinance\u2019s rules.<\/p>\n<p>\u201cEven if [Planned Parenthood] were to successfully defend against a civil suit, the litigation costs from the barrage of civil lawsuits encouraged by the Ordinance would be crushing. Indeed, the Ordinance has already forced Plaintiffs to cancel abortion-related appointments to avoid potential liability.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2021\/05\/17\/supreme-court-abortion-case-mississippi-roe-wade-dobbs-jackson-womens-health\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Supreme Court Takes Up Major Abortion Case Directly Challenging Roe v. Wade)<\/a><\/strong><\/p>\n<p>The complaint alleges the ordinance forces Planned Parenthood to \u201ccease all abortion services\u201d which allegedly undermines Planned Parenthood\u2019s \u201cmission of providing affordable, comprehensive reproductive health care.\u201d<\/p>\n<p>The suit says the ordinance violates the Due Process Clause of the Fourteenth Amendment because the \u201cConstitution guarantees the right to abortion before viability,\u201d and the ordinance \u201cBans pre-viability abortions.\u201d<\/p>\n<p>\u201cThe city of Lubbock, TX thinks it can ban abortion and defy nearly 50 years of Supreme Court precedent,\u201d Planned Parenthood said in a tweet. \u201cThey\u2019re wrong \u2013 and we\u2019ll see them in court.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"8.3111111111111\">\n<p dir=\"ltr\" lang=\"en\">The city of Lubbock, TX thinks it can ban abortion and defy nearly 50 years of Supreme Court precedent.
