Wade<\/em>.<\/p>\n<p>\u201cMississippi\u2019s 15-week abortion ban, which then-Gov. Phil Bryant, a Republican, signed into law in 2018, made exceptions only for medical emergencies or cases in which there is a \u201csevere fetal abnormality,\u201d but not for instances of rape or incest. A federal judge in Mississippi\u00a0struck down the law\u00a0in November 2018, and the 5th US Circuit Court of Appeals\u00a0upheld that ruling\u00a0in December 2019,\u201d <a href=\"https:\/\/www.cnn.com\/2021\/05\/17\/politics\/supreme-court-abortion-mississippi\/index.html\">CNN reported Monday<\/a>, as the Supreme Court granted the appeal.<\/p>\n<p>The 5th Circuit struck down the law using Roe v. Wade as an excuse, claiming that the Supreme Court has \u201cestablished (and affirmed and re-affirmed) a woman\u2019s right to choose an abortion before viability,\u201d and that states may only regulate and restrict abortion \u201cprior to viability so long as they do not impose an undue burden on the woman\u2019s right\u2026[T]hey may not ban abortions.\u201d<\/p>\n<p>Other states have enacted similar bans, most of which were blocked by courts. Mississippi\u2019s is a largely straightforward ban, giving the Court the opportunity to look at how\u00a0<em>Roe v. Wade<\/em>, which legalizes abortion prior to fetal viability \u2014 a standard which now hovers somewhere between 22 and 24 weeks of pregnancy.<\/p>\n<p>The appellants presented three questions: whether \u201call pre-viability prohibitions on elective abortions are unconstitutional,\u201d which standard these types of laws should be judged under by the courts, and whether abortion providers have the standing to challenge a law restricting access to abortion after a certain period of time if they, themselves, are not the target of the abortion restriction.<\/p>\n<p>The Supreme Court, though, will only consider one of the three issues on appeal in the case: whether all pre-viability prohibitions are, by definition, unconstitutional without regard to what they ban and whether they present only limited restrictions on what the Supreme Court has defined to be a \u201cright.\u201d<\/p>\n<p>Mississippi\u2019s Attorney General argued in the state\u2019s appeal that the case is \u201cideal\u201d for a clear and concise ruling on the topic of what constitutes \u201cviability\u201d for purposes of restricting abortion.<\/p>\n<p>\u201cThis case remains an ideal vehicle to promptly resolve both that question and the first question presented \u2014 the contradictions in this Court\u2019s decisions overuse of \u2018viability\u2019 as a bright line for measuring pro-life legislation,\u201d Mississippi Attorney General Lynn Fitch wrote.<\/p>\n<p>The Supreme Court, which, until recently, was reluctant to weigh in on the abortion debate, will actually take up two cases dealing with the subject next term. In addition to the case concerning Mississippi\u2019s 15-week abortion ban, the Court will consider a case from Kentucky over whether a separate party \u2014 in Kentucky\u2019s case, a Republican Attorney General \u2014 can step in to defend a partial-birth abortion ban when a Democrat-run administration refuses.<\/p>\n<p>Last year, the Supreme Court also \u201cgranted the Trump administration\u2019s request to reinstate long-standing restrictions for patients seeking to obtain a drug used for abortions early in pregnancy \u2014 with the three liberals dissenting in a potential preview of a new chapter in the court\u2019s rulings on the procedure,\u201d per CNN.
