The aid program was approved in March as part of Democrats\u2019 $1.9 trillion coronavirus relief bill and began accepting applications from restaurants around the country on May 3, the day Vitolo submitted his application.<\/p>\n<p>\u201cI do not want special treatment. I just want to be treated equally under the law. I am opposed to race and sex discrimination, and I would hope my government lived up to the same principle,\u201d Vitolo said, according to a <a href=\"https:\/\/will-law.org\/will-sues-biden-administration-for-race-sex-discrimination-in-allocation-of-covid-relief-funds-for-restaurants\/\">press release<\/a> from conservative law firm\u00a0Wisconsin Institute for Law &#038; Liberty, which filed the lawsuit on his behalf.<\/p>\n<p>The program bars\u00a0white male restaurant owners from applying for aid for three weeks, by which time the money may run out. The fund is experiencing extremely high demand, but the Small Business Administration (SBA)\u00a0<a href=\"https:\/\/www.sba.gov\/funding-programs\/loans\/covid-19-relief-options\/restaurant-revitalization-fund\">said<\/a>\u00a0it will initially only select applications from restaurants and other eligible small businesses that are at least 51 percent owned\u00a0by \u201cwomen, veterans, or socially and economically disadvantaged individuals.\u201d<\/p>\n<p>As a\u00a0white male, Vitolo did not qualify for the priority application period. However, Vitolo\u2019s wife is Hispanic and owns 50% of their business, according to the lawsuit, which names\u00a0SBA Administrator Isabella Casillas Guzman as a defendant.<\/p>\n<p>\u201cVitolo\u2019s application has been put on hold because he is a white male,\u201d the lawsuit states. \u201cOther restaurant owners\u2019 applications, however, have been and are being processed because they are not white males.\u201d<\/p>\n<p>The program places \u201cwhite male restaurant owners behind certain minority or female applicants, regardless of when they filed an application,\u201d the lawsuit claims. \u201cGiven the limited pot of funds, this puts white male applicants at significant risk that, by the time their applications are processed, the money will be gone.\u201d<\/p>\n<p>The lawsuit calls the program \u201cunconstitutional\u201d and asks the court to halt grants to restaurants and other eligible businesses until the SBA stops \u201cdiscriminating on the basis of race and gender.\u201d<\/p>\n<p>Hans Bader, a longtime civil rights lawyer who worked in the federal Office for Civil Rights, previously <a href=\"https:\/\/www.dailywire.com\/news\/bidens-restaurant-relief-program-excludes-white-male-owners\">told<\/a> The Daily Wire that prioritizing minority groups in a broad manner, as the program does, is unconstitutional.<\/p>\n<p>\u201cTo legally give minority groups a preference in an area, the government has to be seeking to remedy the present effects of its own past discrimination against those particular minority groups, in the area where they are being given a preference,\u201d Bader said, adding that the government discrimination must also be \u201crecent\u201d and \u201cwidespread.\u201d<\/p>\n<p>In this case, the American Rescue Plan, which launched the restaurant aid program, did not make any such finding that all minority-owned restaurants have been recently discriminated against by the federal government. A federal appeals court ruled nearly three decades ago that discrimination even\u00a0<a href=\"https:\/\/casetext.com\/case\/brunet-v-city-of-columbus-3\">14 years<\/a>\u00a0old is too old to justify affirmative action and that isolated instances of discrimination\u00a0<a href=\"https:\/\/casetext.com\/case\/middleton-v-the-city-of-flint-michigan\">do not justify<\/a>\u00a0a racial preference.<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
