Rick Santorum, still passed both the House and the Senate.\u00a0<strong><a href=\"https:\/\/dailycaller.com\/2021\/02\/23\/becerra-abortion-romney-partial-birth-california-biden\/\">(RELATED: Republican Senators Push Biden Nominee Becerra On His Abortion Record)<\/a><\/strong><\/p>\n<p>The legislation bans partial-birth abortions, which it defines as \u201can abortion in which a physician deliberately and intentionally vaginally delivers a living, unborn child\u2019s body until either the entire baby\u2019s head is outside the body of the mother, or any part of the baby\u2019s trunk past the navel is outside the body of the mother and only the head remains inside the womb, for the purpose of performing an overt act (usually the puncturing of the back of the child\u2019s skull and removing the baby\u2019s brains) that the person knows will kill the partially delivered infant, performs this act, and then completes delivery of the dead infant\u2013is a gruesome and inhumane procedure that is never medically necessary and should be prohibited.\u201d<\/p>\n<p>Yet on Wednesday, when asked by Republican Florida Rep. Gus Bilirakis whether he believes that \u201cpartial-birth abortion is illegal,\u201d Becerra responded that \u201cpartial-birth abortion\u201d is not a medical term and then said that \u201cthere is no law\u201d that specifically deals with partial-birth abortions.<\/p>\n<p>\u201cThere is no medical term like partial-birth abortion, so I would probably have to ask you what you mean by that, to describe what is allowed by the law,\u201d the HHS secretary said. \u201cRoe v. Wade is very clear, settled precedent, a woman has a right to make decisions about her reproductive health, and we will make sure we enforce the law and protect these rights.\u201d<\/p>\n<p><strong>WATCH:\u00a0<\/strong><\/p>\n<p>\u201cThere is no law that deals specifically with the term partial-birth abortion,\u201d he said. \u201cWe have clear precedent in the law on the rights that women have to reproductive health care, and we will follow the law and protect the rights of all Americans to their healthcare.\u201d<\/p>\n<p>Becerra did not immediately respond to a request for comment from the Daily Caller News Foundation.<\/p>\n<p>Susan B.
