Version: 4.0.47--><div><img decoding=\"async\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/05\/Jack-Dorsey-1-scaled-1.jpg?w=1200&#038;h=800&#038;ixlib=react-9.0.3\" class=\"ff-og-image-inserted\"  style=\"display:none\"><\/div>\n<p>Twitter is trying to dismiss a second child pornography lawsuit filed against them by an underaged vicim, citing outlined protections under Section 230 of the Communications Decency Act \u2014 a controversial clause that has protected Big Tech from viewpoint discrimination and, in this case, they claim, child pornography being hosting on their platforms.<\/p>\n<p>In the court filing, Twitter argued that even if \u201call\u201d of the minors\u2019 \u201callegations\u201d are accepted \u201cas true, there is no legal basis for holding Twitter liable for the Perpetrators\u2019 despicable acts.\u201d<\/p>\n<p>Twitter was hit with a <a href=\"https:\/\/www.dailywire.com\/news\/sex-trafficking-survivor-challenges-dorsey-on-heels-of-lawsuit\">lawsuit<\/a>\u00a0in January alleging that a young boy who was solicited and recruited for sex trafficking,\u00a0known as John Doe #1, had to endure his own sexual abuse material being promoted on Twitter, even after attempts were made to remove the content.<\/p>\n<p>A second alleged victim, known as\u00a0John Doe #2, later joined the federal lawsuit. \u201cBoth plaintiffs were harmed by Twitter\u2019s distribution of material depicting their sexual abuse and trafficking, and by Twitter\u2019s knowing refusal to remove the images of their sexual abuse (child pornography) when notified by John Doe #1 and his parents,\u201d <a href=\"https:\/\/endsexualexploitation.org\/articles\/statement-second-survivor-of-child-sexual-abuse-sues-twitter\/\">read<\/a> a press release from the National Center on Sexual Exploitation (NCOSE).<\/p>\n<p>\u201cTo encourage platforms to moderate\u00a0and remove offensive content without risking incurring potentially ruinous legal costs, in 1996\u00a0Congress enacted Section 230 of the Communications Decency Act (\u2018CDA \u00a7 230\u2019), granting online\u00a0platforms like Twitter broad immunity from legal claims arising out of the failure to remove\u00a0content,\u201d a motion to dismiss argued. \u201cGiven that Twitter\u2019s alleged liability here rests on its failure to remove content quickly\u00a0enough from its platform, dismissal of the FAC with prejudice is warranted on this ground alone.\u201d<\/p>\n<p>Section 230 of the U.S. Code\u00a0<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/47\/230\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.law.cornell.edu\/uscode\/text\/47\/230&#038;source=gmail&#038;ust=1606584876135000&#038;usg=AFQjCNFGgZi4A-zVD0x3_jLEAkXq9IQWKQ\">states<\/a>:<\/p>\n<blockquote readability=\"15\">\n<p><em>No provider or user of an interactive computer service shall be held liable on account of any action voluntarily taken in good faith to restrict access to or availability of material that the provider or user considers to be obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, whether or not such material is constitutionally protected.<\/em><\/p>\n<\/blockquote>\n<p>Twitter noted that the company eventually \u201cdid remove the videos\u00a0and suspend the accounts that had posted them,\u201d adding, \u201cThat the offending content was not taken down\u00a0immediately does not make Twitter liable under any applicable law.\u201d<\/p>\n<p>\u201cMistakes or delays, however, do not make Twitter a knowing participant in a sex trafficking venture, as Plaintiffs here have alleged,\u201d \u00a0the court filing said. \u201cPlaintiffs do not (and cannot) allege, as they must, that Twitter ever had any actual connection to the Perpetrators, took any part in their crimes, or benefitted from them. Thus, even accepting all of Plaintiffs\u2019 allegations as true, there is no legal basis for holding Twitter liable for\u00a0the Perpetrators\u2019 despicable acts.\u201d<\/p>\n<p>On the heels of the suits, advocates are pushing a <a href=\"https:\/\/www.change.org\/p\/twitter-inc-make-reporting-child-sexual-abuse-material-a-two-step-process-on-twitter?recruiter=1086189488&#038;utm_source=share_petition&#038;utm_medium=twitter&#038;utm_campaign=share_petition&#038;recruited_by_id=07f814e0-8f17-11ea-8ebc-ff46644377e2\">petition<\/a> on Change.org to create an easier two-step reporting process on Twitter\u00a0for victims of child sexual abuse material.<\/p>\n<p>\u201cThe reporting process for victims of child sexual abuse material and Twitter users should be a two step process. Clear, direct, and easy for children to report,\u201d reads the petition, which has racked up more than 13,000 signatures.<\/p>\n<p>\u201cTwitter is currently being sued by two minor survivors of child sexual exploitation. John Doe #1 and John Doe #2 were both 13 years of age in the video shared on Twitter,\u201d the petition adds. \u201cTheir\u00a0abuse was watched 167,000 views and 2,223 retweets. John Doe #1 was a minor when he started reporting the video.
