The <a href=\"https:\/\/www.federalregister.gov\/documents\/2021\/01\/19\/2021-01234\/securing-the-information-and-communications-technology-and-services-supply-chain\" target=\"_blank\" rel=\"noopener noreferrer\">rule<\/a> implements provisions of an <a href=\"https:\/\/www.federalregister.gov\/executive-order\/13873\" target=\"_blank\" rel=\"noopener noreferrer\">executive order<\/a> signed by former President Donald Trump in May 2019, giving the Commerce Department far-reaching power to block Chinese technology transactions deemed to pose a national security threat to the U.S.<\/p>\n<p>The Telecommunications Industry Association (TIA) asked Commerce Secretary Gina Raimondo not to enforce the rule while the administration reviewed the best path forward, according to an April 28 letter reviewed by the WSJ. <strong><a target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Joe Biden Reportedly Will Keep Trump\u2019s Sanctions On Chinese Tech Threats)<\/a><\/strong><\/p>\n<p>\u201c[The administration\u2019s] actions should be more tailored,\u201d the TIA said in a <a href=\"https:\/\/mk0tiaonlinedevs02ww.kinstacdn.com\/wp-content\/uploads\/2021\/04\/Multiassociation-Letter-on-SCS-4.12.2021-FINAL-PDF.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">separate April letter<\/a> to Raimondo. \u201cIn the long term, the nation is best served by pragmatic approaches that are designed to address specific risks.\u201d<\/p>\n<p>The TIA, Cellular Telecommunications Industry Association, Consumer Technology Association, National Association of Broadcasters, Wireless Infrastructure Association and other top groups signed onto the letter.<\/p>\n<div id=\"attachment_7188167\" class=\"wp-caption alignnone\" readability=\"34\"><img decoding=\"async\" aria-describedby=\"caption-attachment-7188167\" loading=\"lazy\" class=\"wp-image-7188167 size-full\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/05\/GettyImages-490009832-scaled-1.jpg\" alt=\"President Joe Biden and Chinese President Xi Jinping toast during a luncheon on Sept. 25, 2015 at the Department of State. Richards\/AFP via Getty Images)<\/p>\n<\/div>\n<p>\u201cThe interim rule\u2019s all encompassing and non-exhaustive list of in-scope products and services captures most, if not all, [information communication technology services (ICTS)] products and services, leaving U.S. companies with a high level of uncertainty about what transactions could be problematic and where to focus attention,\u201d IBM Vice President of Government and Regulatory Affairs Christopher Padilla said in a public letter to Raimondo <a href=\"https:\/\/www.regulations.gov\/comment\/DOC-2019-0005-0105\" target=\"_blank\" rel=\"noopener noreferrer\">opposing the rule<\/a>.<\/p>\n<p>\u201cSimilarly, the criteria for determining whether a particular transaction poses an undue or unacceptable national security risk remain broad and include a seemingly limitless catchall for any information that the Secretary deems relevant,\u201d he continued.<\/p>\n<p>The rule allows the Commerce Department to regulate all transactions involving software, technology hardware, satellite telecommunications systems, internet hosting services, cloud-based data storage and several other ICTS technologies, according to the Federal Register.<\/p>\n<p>The U.S. Chamber of Commerce, US-China Business Council, the Software Alliance, Information Technology Industry Council, National Taxpayers Union and others <a href=\"https:\/\/www.uschamber.com\/sites\/default\/files\/multi_association_letter_-_icts_supply_chain_proposed_rule_01.10.2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">previously announced<\/a> their opposition to the regulation, saying it would create \u201csignificant uncertainty\u201d in the business community.<\/p>\n<p>Businesses would be forced to stop dealing with Chinese ICTS companies, including ones that may not pose a threat to the U.S., out of fear the federal government may intervene, the groups argued.<\/p>\n<p>The Commerce Department \u201cappreciates the participation of industry and will as always carefully consider all comments as part of the rulemaking process,\u201d a spokesperson told the WSJ.<\/p>\n<p>President Joe Biden <a href=\"https:\/\/dailycaller.com\/2021\/02\/27\/joe-biden-donald-trump-commerce-department-china-tech-threats\/\" target=\"_blank\" rel=\"noopener noreferrer\">chose to continue<\/a> the Trump policy in February even as his administration conducted a <a href=\"https:\/\/dailycaller.com\/2021\/01\/16\/biden-approach-towards-china\/\" target=\"_blank\" rel=\"noopener noreferrer\">sweeping review<\/a> of all Commerce Department rules regarding China.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
