The Civil Board <a href=\"https:\/\/www.dailywire.com\/news\/breaking-city-of-atlanta-reinstates-police-officer-fired-last-summer-after-shooting-rayshard-brooks\">decided<\/a> Tuesday that the officer was indeed denied his right to due process.<\/p>\n<p class=\"zn-body__paragraph\" data-paragraph-id=\"paragraph_FA286104-21DC-1A20-F011-3D2F7F1AE16D\" data-act-id=\"paragraph_1\">\u201cWe are very excited that the Civil Board says that due process matters,\u201d attorney Lance LoRusso said in a statement, <a href=\"https:\/\/www.cnn.com\/2021\/05\/05\/us\/atlanta-former-officer-garrett-rolfe-reinstated\/index.html\">according<\/a> to CNN.<\/p>\n<p class=\"zn-body__paragraph\" data-paragraph-id=\"paragraph_FA286104-21DC-1A20-F011-3D2F7F1AE16D\" data-act-id=\"paragraph_1\">LoRusso added that his\u00a0client\u2019s \u201creinstatement will likely take some time, but he intended to get his client back to work.\u201d<\/p>\n<p data-paragraph-id=\"paragraph_FA286104-21DC-1A20-F011-3D2F7F1AE16D\" data-act-id=\"paragraph_1\">\u201cDue to the City\u2019s failure to comply with several provisions of the Code and the information received during witnesses\u2019 testimony, the Board concludes the Appellant was not afforded his right to due process,\u201d the board <a href=\"https:\/\/www.atlantaga.gov\/home\/showpublisheddocument\/51084\/637558016777502482\">said<\/a>. \u201cTherefore, the Board GRANTS the Appeal of Garrett Rolfe and revokes his dismissal as an employee of the APD.\u201d<\/p>\n<p data-paragraph-id=\"paragraph_FA286104-21DC-1A20-F011-3D2F7F1AE16D\" data-act-id=\"paragraph_1\">Rolfe was hit with\u00a0felony charges in the death of Brooks a week after the fatal shooting took place in a Wendy\u2019s parking lot. The reinstated officer is currently facing 11 counts, including felony murder and assault with a deadly weapon.<\/p>\n<p data-paragraph-id=\"paragraph_FA286104-21DC-1A20-F011-3D2F7F1AE16D\" data-act-id=\"paragraph_1\"><a href=\"https:\/\/www.dailywire.com\/news\/breaking-former-atlanta-officer-charged-with-felony-murder-in-shooting-of-rayshard-brooks\">The Daily Wire<\/a> reported on the incident back in June:<\/p>\n<blockquote readability=\"13.768275862069\">\n<p><em>Rolfe <a href=\"https:\/\/www.dailywire.com\/news\/report-atlanta-man-fatally-shot-by-police-after-struggle-outside-drive-thru\">killed<\/a> Brooks late on Friday night after responding to a call from a Wendy\u2019s employee that a man had fallen asleep behind the wheel in his car in the drive-through and was obstructing traffic. The officers ran Brooks through a field sobriety test and a breathalyzer that pegged Brooks\u2019 blood alcohol concentration at .108%, according to body cam footage released by the Atlanta police department. The legal limit to drive is .08%.<\/em><\/p>\n<p><em>After cooperating for nearly half an hour, Brooks <a href=\"https:\/\/www.dailywire.com\/news\/watch-police-body-cam-footage-challenges-narrative-on-death-of-rayshard-brooks\">fought<\/a> with the officers as they tried to place him in handcuffs. All three struggled and fell to the ground where Brooks managed to take Brosnan\u2019s taser and escape the officers. Rolfe shot after Brooks fired the stolen taser at him.<\/em><\/p>\n<\/blockquote>\n<p>Following the reinstatement, the Atlanta Police Department emphasized that the board \u201cdid not make a determination as to whether officer Rolfe violated Atlanta Police Department policies.\u201d<\/p>\n<p>\u201cIt is important to note that the CSB did not make a determination as to whether officer Rolfe violated Atlanta Police Department policies,\u201d the department said in a statement. \u201cIn light of the CSB\u2019s rulings, APD will conduct an assessment to determine if additional investigative actions are needed.\u201d<\/p>\n<p><span class=\"css-901oao css-16my406 r-1qd0xha r-ad9z0x r-bcqeeo r-qvutc0\">Back in June, Atlanta Police Department homicide detective assigned to the Brooks case, Al Hogan, sided with Rolfe in a defense filing, noting that he would have brought 10 charges against <em>Brooks<\/em> had he survived the incident.<\/span><\/p>\n<p><span class=\"css-901oao css-16my406 r-1qd0xha r-ad9z0x r-bcqeeo r-qvutc0\">\u201cAtlanta PD detective assigned to the [Rayshard Brooks]\u00a0<\/span><span class=\"css-901oao css-16my406 r-1qd0xha r-ad9z0x r-bcqeeo r-qvutc0\">investigation says he would have charged Brooks \u2014 not Rolfe \u2014 with 10 counts, including multiple felonies,\u201d posted legal analyst\u00a0<\/span>Philip Holloway.
