Prosecutors did not say in the filing how much time they are seeking Chauvin to serve.\u201d<\/p>\n<p data-el=\"text\">Chauvin defense attorney Eric Nelson is arguing that \u201cprosecutors failed to prove the aggravating factors during the trial that would trigger additional prison time,\u201d the Post said.<\/p>\n<p data-el=\"text\">\u201cMr. Chauvin was authorized, under Minnesota law, to use reasonable force\u201d during the arrest of Floyd, \u201can actively-resisting criminal suspect,\u201d Nelson argued in a court filing.<\/p>\n<\/div>\n<\/section>\n<\/div>\n<p>As highlighted by <a href=\"https:\/\/www.dailywire.com\/news\/biden-doj-was-going-to-arrest-derek-chauvin-in-court-if-jury-found-him-innocent-report\">The Daily Wire<\/a>, it was revealed last month that the\u00a0Biden Department of Justice (DOJ) reportedly planned to arrest Chauvin in court and charge him with civil rights violations if the jury were to acquit Chauvin of the murder charges.<\/p>\n<p id=\"WBBpCh\">\u201cLeading up to Derek Chauvin\u2019s murder trial, Justice Department officials had spent months gathering evidence to indict the ex-Minneapolis police officer on federal police brutality charges, but they feared the publicity frenzy could disrupt the state\u2019s case,\u201d a <a href=\"https:\/\/www.startribune.com\/feds-plan-to-indict-chauvin-other-three-ex-officers-on-civil-rights-charges\/600051374\/?refresh=true\">report<\/a> from the Minneapolis Star Tribune outlined. \u201cSo they came up with a contingency plan: If Chauvin were found not guilty on all counts or the case ended in a mistrial, they would arrest him at the courthouse, according to sources familiar with the planning discussions.\u201d<\/p>\n<p>This \u201cbackup plan,\u201d the report said, wasn\u2019t \u201cnecessary\u201d for the DOJ, since the jury on April 20 found Chauvin guilt of second-degree murder, third-degree murder, and second-degree manslaughter in relation to the death of George Floyd.<\/p>\n<p>Still, the DOJ is reportedly moving forward with the case, planning to level charges of civil rights violations against the former officer, who is still awaiting sentencing for the murder and manslaughter convictions.<\/p>\n<p>Nelson on Tuesday filed\u00a0a motion for a new trial, claiming that his client\u2019s right to due process and a fair trial was violated, in part, when the court decided against sequestering the jury and against granting a venue change.<\/p>\n<p>\u201cThe Court abused its discretion when it failed to sequester the jury for the duration of the trial, or in the least, admonish them to avoid all media, which resulted in jury exposure to prejudicial publicity regarding the trial during the proceedings, as well as jury intimidation and potential fear of retribution among jurors, which violated Mr. Chauvin\u2019s constitutional rights to due process and to a fair trial,\u201d the filing <a href=\"https:\/\/www.dailywire.com\/news\/derek-chauvins-attorney-files-motion-for-new-trial\">said<\/a>.<\/p>\n<p>Nelson separately requested a hearing to <a href=\"https:\/\/www.dailywire.com\/news\/derek-chauvins-attorney-files-motion-for-new-trial\">throw out the verdict<\/a> \u201con the grounds that the jury committed misconduct, felt threatened or intimidated, felt race-based pressure during the proceedings, and\/or failed to adhere to instructions during deliberations.\u201d<\/p>\n<p>Days ago, it was revealed that now-public juror\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/chauvin-juror-speaks-out-to-help-push-for-change-suggests-hes-been-pulled-over-by-cops-because-hes-black\">Brandon Mitchell<\/a>, 31, back in August, wore a \u201cBlack Lives Matter\u201d and a T-shirt that says \u201cBLM\u201d with the words, \u201cGet Your Knee Off Our Necks,\u201d a reference to the death of Floyd. He also attended a\u00a0racial justice rally in Washington, D.C., which in part focused on police brutality and featured remarks from members of the Floyd family.<\/p>\n<p>The revelations seem to contradict statements Mitchell gave to the court during the jury selection process. For example, on his\u00a0juror questionnaire, Mitchell reportedly answered \u201cno\u201d when asked about past participation in demonstrations.
