Since the jury\u2019s <a href=\"https:\/\/www.dailywire.com\/news\/breaking-jury-finds-derek-chauvin-guilty\">verdict<\/a> last month, Mitchell has done a string of media appearances intent on <a href=\"https:\/\/www.dailywire.com\/news\/chauvin-juror-speaks-out-to-help-push-for-change-suggests-hes-been-pulled-over-by-cops-because-hes-black\">helping<\/a> \u201cpush for change.\u201d He has also <a href=\"https:\/\/www.dailywire.com\/news\/chauvin-juror-jury-duty-a-chance-to-spark-some-change-something-we-got-to-do\">suggested<\/a> that jury duty is an avenue for activists to \u201cspark some change.\u201d<\/p>\n<p>A recently resurfaced photo of Mitchell shows him in a Black Lives Matter shirt with a caption that says \u201cget your knee of our necks,\u201d an apparent reference to Chauvin\u2019s arrest of Floyd in May 2020. The photo of Mitchell was posted in August by Mitchell\u2019s uncle. It was taken in Washington, D.C., at a rally commemorating Martin Luther King Jr.\u2019s 1963 \u201cI Have a Dream\u201d speech.<\/p>\n<p>During the jury selection process, Mitchell told the court that he had not participated in any demonstrations or marches against police brutality and that while he knew of the case against Chauvin, was not familiar with many specifics and could be impartial in weighing the evidence.<\/p>\n<p>After the photo surfaced, Mitchell said Monday he did not remember wearing the Floyd-inspired shirt and said that the rally he attended in Washington was unrelated. Floyd\u2019s family spoke at the rally and it was used to build support for the George Floyd Justice in Policing Act.<\/p>\n<p>Jury consultant Alan Tuerkheimer said that Chauvin\u2019s attorney Eric Nelson could make use of the revelation about Mitchell\u2019s activism and the juror\u2019s potentially contradictory statements in an appeal. Tuerkheimer said that that would likely not be enough to overturn the case, but it could prompt Judge Peter Cahill to bring Mitchell in for questioning to determine if he lied during the jury selection process.<\/p>\n<p>\u201cThat could change the outcome of things; if there is anything that makes him seem that he was not forthcoming, it could be an avenue for the judge to reconsider the case,\u201d Tuerkheimer told <a href=\"https:\/\/www.washingtonpost.com\/nation\/2021\/05\/03\/chauvin-trial-juror\/\">The Washington Post<\/a>.<\/p>\n<p>Civil rights attorney Brian Dunn said the photo of Mitchell is is \u201cundeniably suggestive of a possible bias in this juror.\u201d Dunn said, however, that the key to throwing out the trial lies in determining whether Mitchell \u201clied about, or failed to provide complete answers on whether he has engaged in public activism, or whether he has any affiliations with BLM that go beyond the mere wearing of the shirt.\u201d<\/p>\n<p>Mitchell Hamline School of Law professor Ted Sampsell-Jones said the picture of Mitchell in a Black Lives Matter shirt is \u201cevidence that Chauvin can point to in order to establish that his right to an impartial jury was denied,\u201d according to the <a href=\"https:\/\/abcnews.go.com\/US\/wireStory\/chauvin-juror-defends-participation-washington-protest-77472635\">Associated Press<\/a>.<\/p>\n<p>\u201cSpeaking frankly, Chauvin did not have a fully impartial jury in the sense we usually give criminal defendants. That wasn\u2019t the fault of the judge or the prosecutors, it was simply a function of the incredible publicity and public pressure\u201d around the trial, he added.<\/p>\n<p>Nelson <a href=\"https:\/\/www.dailywire.com\/news\/derek-chauvins-attorney-files-motion-for-new-trial\">filed<\/a> an appeal in Chauvin\u2019s case on Tuesday alleging in part that members of the jury \u201ccommitted misconduct, felt threatened or intimidated, felt race-based pressure during the proceedings, and\/or failed to adhere to instructions during deliberations.\u201d<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
