They then demanded the platform revisit the suspension in six months after it has had a chance to clarify the standards by which is institutes bans.<\/p>\n<p>\u201cThe Board has upheld Facebook\u2019s decision on January 7, 2021, to restrict then-President Donald Trump\u2019s access to posting content on his Facebook page and Instagram account,\u201d the Oversight Board said in its statement, released Wednesday morning.<\/p>\n<p>\u201cGiven the seriousness of the violations and the ongoing risk of violence, Facebook was justified in suspending Mr. Trump\u2019s accounts on January 6 and extending that suspension on January 7,\u201d the Board added, noting that it believed Trump \u00a0\u201ccreated an environment where a serious risk of violence was possible\u201d by continuing to post about the validity of the 2020 presidential election results.<\/p>\n<p>\u201cHowever, it was not appropriate for Facebook to impose the indeterminate and standardless penalty of indefinite suspension,\u201d the board added. \u201cFacebook\u2019s normal penalties include removing the violating content, imposing a time-bound period of suspension, or permanently disabling the page and account.\u201d<\/p>\n<p>\u201cAs Facebook suspended Mr. Trump\u2019s accounts \u2018indefinitely,\u2019 the company must reassess this penalty,\u201d the board said. \u201cIt is not permissible for Facebook to keep a user off the platform for an undefined period, with no criteria for when or whether the account will be restored.\u201d<\/p>\n<p>The board referred further decisions on the issue back to Facebook with an instruction to clarify how it handles violations of its terms of service. The social media platform must review the matter \u201cwithin six months\u201d of today\u2019s date. Although a full report has yet to be released, the Board noted that it has sent \u201cpolicy recommendations\u201d to Facebook.<\/p>\n<p>\u201cThe Board insists that Facebook review this matter to determine and justify a proportionate response that is consistent with the rules that are applied to other users of its platform. Facebook must complete its review of this matter within six months of the date of this decision,\u201d they said. \u201cThe Board also made policy recommendations for Facebook to implement in developing clear, necessary, and proportionate policies that promote public safety and respect freedom of expression.\u201d<\/p>\n<p>The company, the Board said, should ultimately have a \u201cdefined penalty\u201d for violations of its terms.<\/p>\n<p>Michael McConnell, the co-chair of the Oversight Board, said in a phone call Wednesday that \u201cOur sole job is to hold this extremely powerful organization, Facebook, to be held accountable,\u201d and that the Board believed Trump\u2019s permanent ban \u201cdid not meet these standards.\u201d<\/p>\n<p>\u201cThe Oversight Board is clearly telling Facebook they can\u2019t invent new, unwritten rules when it suits them,\u201d another board member, a former Prime Minister of Denmark, added in the call.<\/p>\n<p>Nick Clegg, a former far-left legislator in the United Kingdom who now serves as Facebook\u2019s Vice President for Global Affairs and Communications, addressed the board\u2019s decision <a href=\"https:\/\/about.fb.com\/news\/2021\/05\/facebook-oversight-board-decision-trump\/\">in a post on Facebook\u2019s website<\/a>, saying that the company will \u201cnow consider the board\u2019s decision and determine an action that is clear and proportionate.\u201d<\/p>\n<p>\u201cIn the meantime, Mr. Trump\u2019s accounts remain suspended,\u201d Clegg added.<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
