From the filing:\u00a0<\/span><\/p>\n<blockquote readability=\"13\">\n<p><em><span>The Court abused its discretion when it failed to sequester the jury for the duration of the trial, or in the least, admonish them to avoid all media, which resulted in jury exposure to prejudicial publicity regarding the trial during the proceedings, as well as jury intimidation and potential fear of retribution among jurors, which violated Mr. Chauvin\u2019s constitutional rights to due process and to a fair trial.\u00a0<\/span><\/em><\/p>\n<\/blockquote>\n<p>Although Nelson did not give specific details in the filing, Judge Peter Cahill previously said that Chauvin\u2019s team may have grounds to overturn the trial on appeal in light of public remarks from Rep. Maxine Waters (D-CA).<\/p>\n<p><span>Nelson also argued that the court violated Chauvin\u2019s rights by not ordering Morries Hall \u2014 the man in the car with Floyd before his death \u2014 to testify at the trial or to submit into evidence \u201chis statements to law enforcement regarding his\u201d interaction with Floyd. <\/span><span>According to <\/span><a href=\"https:\/\/www.nytimes.com\/2021\/04\/14\/us\/morries-hall-fifth-amendment.html#:~:text=via%20Court%20TV-,Morries%20Lester%20Hall%2C%20who%20was%20in%20a%20car%20with%20George,called%20to%20testify%20on%20Wednesday.\"><span>The New York Times<\/span><\/a><span>, Hall invoked the Fifth Amendment during the trial after his lawyer argued that Hall\u2019s testimony could expose him to drug-related charges.\u00a0<\/span><\/p>\n<p><span>Chauvin\u2019s attorney, separately, also requested a hearing to throw out the court\u2019s verdict \u201con the grounds that the jury committed misconduct, felt threatened or intimidated, felt race-based pressure during the proceedings, and\/or failed to adhere to instructions during deliberations.\u201d\u00a0<\/span><\/p>\n<p><span>The Minnesota Attorney General\u2019s Office, through a spokesperson, told <\/span><a href=\"https:\/\/www.kare11.com\/article\/news\/local\/george-floyd\/derek-chauvin-defense-seeks-new-trial\/89-ada3b281-ab4f-40be-a000-da46bf5a90be\"><span>KARE-11<\/span><\/a><span>: \u201c<\/span><span>The court has already rejected many of these arguments and the State will vigorously oppose them.\u201d<\/span><\/p>\n<p><span>The filing comes after a report emerged that Brandon Mitchell, a 31-year old juror who started speaking publicly to the media after the trial was over, wore a shirt that said \u201cBLM\u201d and \u201cGet Your Knees Off Our Necks\u201d last summer in Washington, D.C. The filing, however, did not mention Mitchell, so it\u2019s unclear whether it even relates to him or not.\u00a0<\/span><\/p>\n<p><span>Mitchell told \u201cCBS This Morning\u201d host Gayle King last week that he didn\u2019t feel pressured to come to a specific verdict, and didn\u2019t suspect any of the other jurors did either. The juror, known as juror number 52 during the trial, also briefly detailed the deliberation process.\u00a0<\/span><span>As <a href=\"https:\/\/www.dailywire.com\/news\/chauvin-trial-juror-speaks-publicly-dont-think-any-of-us-felt-pressured-to-convict\">The Daily Wire<\/a> previously reported:\u00a0<\/span><\/p>\n<blockquote readability=\"24\">\n<p><em><span>Mitchell told King that, once the jurors entered the deliberation room, all but one of them believed that Chauvin was guilty on the manslaughter charge \u2014 the least severe of the three charges against him \u2014 in a preliminary vote. And after 40 minutes of discussion, going over court-provided legal definitions, and talking about the evidence, the hold-out juror was convinced that Chauvin was guilty of manslaughter as well.\u00a0<\/span><\/em><\/p>\n<p><em><span>After King asked Mitchell, \u201cWhat was the one person unsure about Brandon,\u201d Mitchell responded: \u201cI think it was just the terminology. So within the instructions, you know, some of the terminology can be a little tricky because it\u2019s legal jargon. Sometimes some of the words can be interpreted differently amongst people, so they wanted to do their due diligence and make sure that they were coming out with the right verdict that they believed in. So they were just hung up on a few words, and we kind of went through the definitions that were given to us and kinda broke it down from different perspectives to get everyone on the same page.\u201d<\/span><\/em><\/p>\n<\/blockquote>\n<p><span>Chauvin was found guilty earlier this month of second-degree murder, third-degree murder, and second-degree manslaughter in the death of George Floyd.
