Ron DeSantis (R-FL) was among the first chief executives to ban vaccine passports through <a href=\"https:\/\/www.flgov.com\/wp-content\/uploads\/2021\/04\/EO-21-81.pdf\">executive order<\/a>.<\/p>\n<p>The March 9 measure clarifies that although the state \u201cseeks to ensure that every Floridian who desires a COVID-19 vaccine can obtain one,\u201d such vaccines \u201cwill not be mandated\u201d or \u201crequired by law.\u201d<\/p>\n<p>The order also reaffirms that \u201cCOVID-19 vaccination records are private health information which should not be shared by mandate\u201d through vaccine passports, which \u201creduce individual freedom and will harm patient privacy.\u201d<\/p>\n<p>The order notes that vaccine passports would \u201ccreate two classes of citizens based on vaccination.\u201d It therefore prohibits government entities and private businesses from issuing vaccine passports or other documents \u201cfor the purpose of certifying an individual\u2019s COVID-19 vaccination status to a third party.\u201d<\/p>\n<p>Gov. DeSantis\u2019 order directs all executive agencies to enforce the policy; businesses that fail to comply will no longer be eligible for \u201cgrants or contracts funded through state revenue.\u201d<\/p>\n<p><b>Texas<\/b><\/p>\n<p>Gov. Greg Abbott (R-TX) likewise prohibited vaccine passports through executive order.<\/p>\n<p>\u201cEveryday, Texans are returning to normal life as more people get the safe and effective COVID-19 vaccine. But, as I\u2019ve said all along, these vaccines are always voluntary and never forced,\u201d said Gov. Abbott in an April 6 <a href=\"https:\/\/gov.texas.gov\/news\/post\/governor-abbott-issues-executive-order-prohibiting-government-mandated-vaccine-passports\">press release<\/a>. \u201cGovernment should not require any Texan to show proof of vaccination and reveal private health information just to go about their daily lives.\u201d<\/p>\n<p>\u201cWe will continue to vaccinate more Texans and protect public health \u2014 and we will do so without treading on Texans\u2019 personal freedoms,\u201d he added.<\/p>\n<p>The <a href=\"https:\/\/gov.texas.gov\/uploads\/files\/press\/EO-GA-35_private_health_information_protection_vaccines.pdf\">executive order<\/a> points to the federal Project BioShield Act of 2004, which recognizes that each American has \u201cthe option to accept or refuse administration\u201d of a product under emergency use authorization \u2014 such as COVID-19 vaccines.<\/p>\n<p>The order clarifies that though the state of Texas strongly encourages inoculation, the vaccine will \u201cnever be mandated by the government.\u201d Likewise, any private entity that receives public funding \u201cshall not require a consumer to provide, as a condition of receiving any service or entering any place, documentation regarding the consumer\u2019s vaccination status for any COVID-19 vaccine administered under an emergency use authorization.\u201d<\/p>\n<p><b>Idaho<\/b><\/p>\n<p>One day after Gov. Abbott signed his order, Gov. Brad Little (R-ID) banned vaccine passports in his state.<\/p>\n<p>\u201cIdahoans should be given the choice to receive the vaccine. We should not violate Idahoans\u2019 personal freedoms by requiring them to receive it,\u201d said Gov. Little in a <a href=\"https:\/\/gov.idaho.gov\/pressrelease\/gov-little-bans-vaccine-passports-in-idaho\/\">statement<\/a>. \u201cVaccine passports create different classes of citizens. Vaccine passports restrict the free flow of commerce during a time when life and the economy are returning to normal. Vaccine passports threaten individual freedom and patient privacy.\u201d<\/p>\n<p>The governor has \u201cserious concerns that implementing COVID-19 vaccine passports will violate Idahoans\u2019 medical privacy rights, prejudice those unable to receive the vaccine, slow our economic recovery, cause division among our populace and, ultimately, be counterproductive to the widespread administration of the COVID-19 vaccines among Idahoans.\u201d<\/p>\n<p><b>Montana<\/b><\/p>\n<p>One week after Idaho enacted its ban, Gov. Greg Gianforte (R-MT) issued an order banning vaccine passports across the state.<\/p>\n<p>\u201cI strongly encourage Montanans to get a safe, effective COVID-19 vaccine, which is our best path to protect our family and friends and get back to a more normal life,\u201d Gov. Gianforte said in a <a href=\"https:\/\/news.mt.gov\/gov-gianforte-issues-executive-order-prohibiting-vaccine-passports\">press release<\/a>. \u201cReceiving one is entirely voluntary and will not be mandated by the State of Montana, nor compelled through vaccine passports, vaccine passes, or other compulsory means. We are committed to protecting individual liberty and personal privacy.\u201d<\/p>\n<p>The order \u201cprohibits the State of Montana from requiring a vaccine to access state services or facilities; producing, issuing, or funding vaccine passports; and sharing an individual\u2019s vaccination status with any person, company, or governmental entity for purposes of a vaccine passport program.\u201d Under the order, businesses are prevented from requiring proof of vaccination status from patrons.<\/p>\n<p><b>Arizona<\/b><\/p>\n<p>Gov. Doug Ducey (R-AZ) enacted a similar ban on vaccine passports.<\/p>\n<p>\u201cThe residents of our state should not be required by the government to share their private medical information,\u201d remarked Gov. Ducey in an April 19 <a href=\"https:\/\/azgovernor.gov\/governor\/news\/2021\/04\/governor-ducey-bans-vaccine-passports\">press release<\/a>. \u201cWhile we strongly recommend all Arizonans get the COVID-19 vaccine, it\u2019s not mandated in our state \u2014 and it never will be. Vaccination is up to each individual, not the government.\u201d<\/p>\n<p>Under the order, \u201cstate agencies, counties, cities and towns cannot issue a measure that requires an individual to provide documentation of their COVID-19 vaccination status in order to enter a business, building or area or to receive a government service, permit or license.\u201d<\/p>\n<p>Private businesses are \u201cnot prohibited from requiring vaccination documentation in order to provide services or allow entry.\u201d However, businesses contracting with the state cannot request documentation. Health care institutions may also \u201crequire COVID-19 vaccination status documentation of a patient, resident, employee or visitor.\u201d<\/p>\n<p><b>Utah<\/b><\/p>\n<p>The Utah state legislature is advancing a similar <a href=\"https:\/\/le.utah.gov\/~2021\/bills\/static\/HB0308.html\">ban<\/a> on vaccine passports through its chambers.<\/p>\n<p>State Rep. Robert Spendlove (R-UT) and State Sen. Daniel McCay (R-UT) sponsored a bill stating that a government entity \u201cmay not require, directly or indirectly, that an individual receive an emergency COVID-19 vaccine.\u201d<\/p>\n<p>Likewise, government agencies would not be able to mandate inoculation as a prerequisite for employment.<\/p>\n<p><b>Iowa<\/b><\/p>\n<p>Legislators in the state of Iowa crafted a similar <a href=\"https:\/\/www.legis.iowa.gov\/docs\/publications\/LGI\/89\/HF889.pdf\">proposal<\/a>.<\/p>\n<p>Rep.
