Foster denied standing \u2014 the legal ability to appear on a matter \u2014 to the group. Media attorneys for the coalition, Mike Tadych and Amanda Martin, \u201csaid the ruling is the first denial of standing in the more than 30 body camera cases they have handled. When the ruling is final, they will likely appeal, they said, pending client approval,\u201d according to <a href=\"https:\/\/carolinapublicpress.org\/44948\/will-body-camera-footage-be-released-in-andrew-brown-jr-case\/\">Carolina Public Press<\/a>, one of the media groups requesting the release.<\/p>\n<p class=\"p1\">According to <a href=\"https:\/\/www.npr.org\/2021\/04\/28\/991590657\/n-c-judge-will-not-release-bodycam-footage-of-police-shooting-andrew-brown\"><span class=\"s1\">NPR<\/span><\/a>, Foster said that giving the footage to the public could damage the reputation or safety of the deputies involved and impact the state\u2019s investigation.<\/p>\n<p class=\"p1\">The outlet reported, \u201cThe judge said five body camera videos and one car camera video will be disclosed to Brown\u2019s family and to their attorney. He ordered all faces and nametags of deputies blurred. Foster ordered the videos released to the public in no less than 30 and no more than 45 days. The state must notify the court when its investigation is complete.\u201d<\/p>\n<p class=\"p1\">Brown\u2019s family\u2019s attorneys reportedly said they were \u201cdeeply disappointed\u201d by the judge\u2019s decision.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">\u201dIn this modern civil rights crisis where we see Black people killed by the police everywhere we look, video evidence is the key to discerning the truth and getting well-deserved justice for victims of senseless murders,\u201d they said in a statement. \u201cJust look at the murder of George Floyd \u2014 if the world had not seen that clear and disturbing footage, there might not have even been an ounce of accountability for those officers. We refuse to be discouraged and vow to keep the pressure on these agencies until we get to the truth.\u201d<\/p>\n<p class=\"p1\">On Wednesday, Andrew Brown, Jr., a 42-year-old black man, was <a href=\"https:\/\/www.dailywire.com\/news\/mayor-declares-state-of-emergency-ahead-of-bodycam-footage-release-of-fatal-shooting\"><span class=\"s1\">reportedly<\/span><\/a> killed following an encounter with law enforcement authorities. As reported by\u00a0<a href=\"https:\/\/apnews.com\/article\/shootings-north-carolina-elizabeth-city-arrests-01c55d101b91880fa4389025fe00b1fb\"><span class=\"s1\">The Associated Press,<\/span><\/a>\u00a0\u201cPasquotank County Sheriff Tommy Wooten II has said that deputies shot and killed Brown while serving drug-related search and arrest warrants but released few other details.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><a href=\"https:\/\/www.wunc.org\/news\/2021-04-23\/calls-mount-for-video-release-in-fatal-shooting-by-deputies\">WUNC North Carolina Public Radio<\/a><\/span>\u00a0reported:<\/p>\n<blockquote readability=\"9\">\n<p class=\"p1\"><i>Recordings of scanner traffic compiled by broadcastify.com from the morning of the shooting include emergency personnel indicating that Brown was shot in the back. An eyewitness has said that deputies fired shots at Brown as he tried to drive away, and a car authorities removed from the scene appeared to have multiple bullet holes and its back windshield shattered.<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><\/p>\n<\/blockquote>\n<p class=\"p1\">Amid growing calls for the body camera footage to be released, Wooten said over the weekend that he would ask a judge to release the footage on Monday. He said that he would make sure that the release of the footage would not compromise any investigation efforts by the State Bureau of Investigation.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">\u201cOnly a judge can release the video. That\u2019s why I\u2019ve asked the North Carolina State Bureau of Investigation to confirm for me that the releasing of the video will not undermine their investigation. Once I get that confirmation, our county will file a motion in court, hopefully Monday, to have the footage released,\u201d he\u00a0<a href=\"https:\/\/apnews.com\/article\/ap-top-news-shootings-north-carolina-us-news-bf929b0a66c89ce76e8438135867f57e\"><span class=\"s1\">said<\/span><\/a>.<\/p>\n<p class=\"p1\">Andrew Womble, district attorney for the First Prosecutorial District, appeared at a hearing Wednesday morning before Foster. Womble argued that the videos should not be released to the public because it could impede the investigation. Instead, he requested that the judge immediately \u201cdisclose\u201d any footage he decides is \u201cappropriate\u201d to the family of Andrew Brown Jr.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Attorneys for Brown\u2019s family have <a href=\"https:\/\/www.dailywire.com\/news\/fbi-announces-investigation-into-andrew-brown-jr-shooting\"><span class=\"s1\">said<\/span><\/a> that the shooting was an \u201cexecution,\u201d but Womble has pushed back against those claims. He said that Brown\u2019s car moved and \u201cmade contact with law enforcement\u201d before deputies began to shoot.<\/p>\n<p class=\"p1\">\u201cThe next movement of the car is forward, it is in the direction of law enforcement, and makes contact with law enforcement. It is then and only then that you hear shots,\u201d the district attorney said.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">The Federal Bureau of Investigation (FBI) <a href=\"https:\/\/www.dailywire.com\/news\/fbi-announces-investigation-into-andrew-brown-jr-shooting\"><span class=\"s1\">announced<\/span><\/a> Tuesday that it will be investigating Brown\u2019s death. The investigation was announced a day after Brown\u2019s family and their attorneys were able to view body camera footage of the incident. An\u00a0<a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/andrew-brown-jr-shot-five-times-once-back-head-according-n1265460\"><span class=\"s1\">autopsy<\/span><\/a>\u00a0was also conducted that the family commissioned.
