According to Brnovich, arrest records indicate the federal government is failing to utilize Immigration and Customs Enforcement (ICE) despite the surge at the border.<\/p>\n<p>ICE\u2019s Enforcement and Removal Operations (ERO) ran historical data to determine how the Biden administration\u2019s interim guidance, which halted deportations for the first 100 days of the new administration, would have on arrests. That guidance is allegedly responsible for cutting apprehensions in half.<\/p>\n<p>\u201cRough estimate is book-ins would be reduced by 50% of historical numbers and the vast majority of book-ins would come from CBP transfers,\u201d ERO\u2019s Acting Executive Associate Director Enrique Lucero said in an internal email. \u201cA book-in is defined as an individual entering ice custody from a single event (arrest by CBP or ICE).\u201d<\/p>\n<div id=\"attachment_216408\" class=\"wp-caption alignnone\">\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-216408\" src=\"https:\/\/www.dailywire.com\/wp-content\/uploads\/2021\/04\/ICE-ERO-Email.jpeg\" sizes=\"auto, (max-width: 623px) 100vw, 623px\" srcset=\"https:\/\/dw-wp-production.imgix.net\/2021\/04\/ICE-ERO-Email.jpeg 623w, https:\/\/dw-wp-production.imgix.net\/2021\/04\/ICE-ERO-Email-300x254.jpeg 300w\" alt=\"\" width=\"623\" height=\"528\" aria-describedby=\"caption-attachment-216408\"  style=\"display:none\"><\/p>\n<p id=\"caption-attachment-216408\" class=\"wp-caption-text\">Courtesy of Arizona Attorney General Mark Brnovich<\/p>\n<\/div>\n<p>ERO took the historical data and applied the Biden administration\u2019s guidelines to those who were previously apprehended in fiscal year 2020. The following convicted felons would have been released:<\/p>\n<ul>\n<li>3,371 (Assault)<\/li>\n<li>4,174 (Dangerous Drugs)<\/li>\n<li>85 (Homicide)<\/li>\n<li>46 (Kidnapping)<\/li>\n<li>225 (Sex Offenses)<\/li>\n<li>73 (Sexual Assault)<\/li>\n<li>503 (Weapon Offenses)<\/li>\n<\/ul>\n<p>According to Brnovich, the move is evidence of the Biden administration\u2019s disregard for Americans\u2019 safety.<\/p>\n<p>\u201cThe DHS records we have obtained convey a shocking disregard for the safety of American communities by the Biden Administration,\u201d Attorney General Mark Brnovich said in a statement. \u201cThe Biden Administration and its radical allies are effectively abolishing ICE through administrative acts.\u201d<\/p>\n<p>Data from the Department of Homeland Security (DHS) appears to back up Brnovich\u2019s claim.<\/p>\n<p>A table on the DHS website shows a staggering number of apprehensions between October 2020 and April 2021. He is currently <a href=\"https:\/\/www.azag.gov\/press-release\/attorney-general-mark-brnovich-amends-lawsuit-stop-dangerous-dhs-immigration-policy\">challenging<\/a> the halt on deportations alongside Montana Attorney General Austin Knudsen (R).<\/p>\n<p>Along with concerns about Americans\u2019 safety, Brnovich believes this is a way for the Biden administration to sidestep U.S. District Judge Drew Tipton\u2019s decision to issue a temporary restraining order (TRO) on the 100-day deportation memo.<\/p>\n<p>As <a href=\"https:\/\/www.dailywire.com\/news\/breaking-texas-judge-blocks-bidens-plan-to-pause-deportations\">The Daily Wire<\/a> previously reported, Judge Tipton expressed concerns over the Biden administration\u2019s failure to consult with Texas before changing immigration policies, an agreement Texas and DHS came to under the Trump administration.<\/p>\n<p>Tipton said the Biden administration \u201carbitrarily and capriciously departed from its previous policy without sufficient explanation\u201d when the 100-day deportation halt was announced.
