The lawsuit contended they had been negligent by failing to exert control over the late King of Pop\u2019s alleged behavior.<\/p>\n<p>The Associated Press <a href=\"https:\/\/abc7chicago.com\/lawsuit-dismissed-against-estate-in-alleged-michael-jackson-molestation-case\/10552327\/\">reported<\/a>\u00a0Robson\u2019s attorney argued that \u201cthe two corporations Jackson had started had a duty to protect him the same way the Boy Scouts or a school would need to protect children from their leaders.\u201d<\/p>\n<p>\u201cThere is no evidence supporting Plaintiff\u2019s contention that Defendants exercised control over Jackson,\u201d wrote Los Angeles County Superior Court Judge Mark A. Young in Monday\u2019s <a href=\"https:\/\/mjjr.net\/docs\/2021-04-26-Robson-Final-Ruling.pdf\">ruling<\/a>. \u201cThe evidence further demonstrates that Defendants had no legal ability to control Jackson, because Jackson had complete and total ownership of the corporate defendants. Without control, there is no special relationship or duty that exists between Defendants and Plaintiff.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"5.8857142857143\">\n<p lang=\"en\" dir=\"ltr\">Michael Jackson Estate Gets Judge to Toss Wade Robson\u2019s Abuse Suit <a href=\"https:\/\/t.co\/jSeViAl4UZ\">https:\/\/t.co\/jSeViAl4UZ<\/a><\/p>\n<p>\u2014 The Hollywood Reporter (@THR) <a href=\"https:\/\/twitter.com\/THR\/status\/1386752979890577408?ref_src=twsrc%5Etfw\">April 26, 2021<\/a><\/p>\n<\/blockquote>\n<p>Robson had testified on Jackson\u2019s behalf in 1993, when the singer was first accused of molesting children, and again in Jackson\u2019s 2005 criminal trial, reiterating that Jackson had never sexually abused him.<\/p>\n<p>But when Robson first filed his suit eight years ago, he said he had been covering up for Jackson and was molested by him as a young boy. Robson said the abuse began in 1990, when he was just seven years old, and continued for seven years.<\/p>\n<p>His accusations were amplified two years ago in HBO\u2019s Emmy-award-winning \u201cLeaving Neverland\u201d documentary. The film\u2019s credibility relied heavily on graphic personal testimonies from Robson and James Safechuck, who had a similar lawsuit against Jackson tossed out by the same judge last year on the same grounds.<\/p>\n<p>Both Robson, 38, and Safechuck, 43, defended Jackson\u2019s honor when the singer was alive. But after a lethal dose of propofol killed Jackson in 2009, they filed separate suits claiming the international entertainment icon had sexually abused them as children. The courts eventually dismissed the cases because the statute of limitations had expired. Both were reconsidered, however, after California Democratic Governor Gavin Newsom <a href=\"https:\/\/www.dailywire.com\/news\/lawsuit-from-michael-jacksons-accusers-will-likely-be-restored\">signed a law<\/a> extending the time limit for people claiming to be sexual abuse victims to file lawsuits.<\/p>\n<p>The same attorney, Vince Finaldi, represents Robson and Safechuck. He said Monday\u2019s ruling has \u201cfatal flaws\u201d and <a href=\"https:\/\/www.hollywoodreporter.com\/thr-esq\/michael-jackson-estate-gets-judge-to-toss-wade-robsons-abuse-suit\">vowed<\/a> to challenge the dismissal \u201cto the Court of Appeal, and to the Supreme Court if necessary.\u201d<\/p>\n<p>\u201cIf allowed to stand, the decision would set a dangerous precedent that would leave thousands of children working in the entertainment industry vulnerable to sexual abuse by persons in places of power,\u201d <a href=\"https:\/\/abc7chicago.com\/lawsuit-dismissed-against-estate-in-alleged-michael-jackson-molestation-case\/10552327\/\">said<\/a> Finaldi in a statement provided to multiple media outlets. \u201cThe children of our state deserve protection, and we will not stop fighting until we [ensure] that every child is safe.\u201d<\/p>\n<p>Finaldi also appealed Judge Young\u2019s decision to toss out Safechuck\u2019s lawsuit in October.<\/p>\n<p><a href=\"https:\/\/www.dailywire.com\/news\/report-michael-jacksons-niece-dated-leaving-jeffrey-cawood\">According<\/a> to Michael Jackson\u2019s niece, Brandi Jackson, she and Robson dated for more than seven years, including part of the time period that his alleged molestation took place. She recalled that their romance began as puppy love between two 12-year-olds. Brandi has described Robson as a dishonest opportunist, claiming, \u201che\u2019s just after money.\u201d<\/p>\n<p>Jonathan Steinsapir, an attorney representing Jackson\u2019s companies, provided a statement to The Hollywood Reporter after Monday\u2019s ruling.<\/p>\n<p>\u201cWade Robson has spent the last 8 years pursuing frivolous claims in different lawsuits against Michael Jackson\u2019s estate and companies associated with it,\u201d the statement read. \u201cRobson has taken nearly three dozen depositions and inspected and presented hundreds of thousands of documents trying to prove his claims, yet a judge has once again ruled that Robson\u2019s claims have no merit whatsoever, that no trial is necessary.\u201d<\/p>\n<p>Variety <a href=\"https:\/\/variety.com\/2021\/music\/news\/michael-jackson-wade-robson-sexual-abuse-dismissed-1234960929\/\">reports<\/a>, \u201cJackson\u2019s companies were also represented in the case by Howard Weitzman, the attorney who died earlier this month at the age of 81.\u201d He was <a href=\"https:\/\/www.latimes.com\/entertainment-arts\/business\/story\/2021-04-08\/hollywood-lawyer-howard-weitzman-attorney-to-michael-jackson-o-j-simpson-dies\">described<\/a> by the Los Angeles Times as \u201cthe Hollywood power lawyer perhaps best known for defending Michael Jackson and his estate.\u201d<\/p>\n<p>The Jackson estate filed a lawsuit against HBO for broadcasting \u201cLeaving Neverland,\u201d saying the cable network had violated a previous non-disparagement agreement with Jackson.
