The Santa Ana River, where the water comes from, provides water for roughly 750,000 residents in the area, as well as wildlife.<\/p>\n<p>Over the last few years, state and local officials accused Nestl\u00e9 of illegally diverting water from local communities for bottling purposes. Although the company has water rights that date back to the mid-1800s, a state investigation discovered Nestl\u00e9 is exceeding their water allocations. According to <a href=\"https:\/\/www.theguardian.com\/us-news\/2021\/apr\/27\/california-nestle-water-san-bernardino-forest-drought\">The Guardian<\/a>, in 2020, Nestl\u00e9 drew 58 million gallons of water, far surpassing the 2.3 million gallons the company is legally allotted per year.<\/p>\n<p>\u201cWhile Nestl\u00e9 may be able to claim a valid basis of right to some water in Strawberry Canyon, a significant portion of the water currently diverted by Nestl\u00e9 appears to be diverted without a valid basis of right,\u201d the letter from the water board states.<\/p>\n<p>According to the Desert Sun, \u201cthe U.S. Forest Service was allowing the company to pipe water from the national forest using a permit with a 1988 expiration date, and with no review of the environmental impacts during the state\u2019s last severe drought.\u201d<\/p>\n<p>As California heads into the second year of a drought, water officials are concerned about Nestl\u00e9\u2019s water operations.<\/p>\n<p>\u201cIt is concerning that these diversions are continuing despite recommendations from the initial report, and while the state is heading into a second dry year,\u201d Jul\u00e9 Rizzardo, assistant deputy director of the Division of Water Rights, said in a statement to <a href=\"https:\/\/www.lamag.com\/citythinkblog\/nestle-water-california-legal-dispute\/\">L.A. Magazine<\/a>. \u201cThe state will use its enforcement authority to protect water and other natural resources as we step up our efforts to further build California\u2019s drought resilience.\u201d<\/p>\n<p>Although the water board could have slapped Nestl\u00e9 with fines dating back to 2017, their first priority is getting the company into compliance with their permit.<\/p>\n<p>\u201cWe didn\u2019t issue a monetary penalty because the immediate priority is bringing Nestl\u00e9 into compliance through the Cease and Desist Order,\u201d water board spokesperson Ailene Voisin told the Desert Sun. \u201cThe order does not preclude the Board pursuing future penalties for violations.\u201d<\/p>\n<p>If the board decides to institute fines against the company, Nestl\u00e9 could face a fine up to $1,000 a day for violating the order. If a drought is declared, that fine would increase ten-fold to $10,000 a day.<\/p>\n<p>To complicate matters even more, Nestl\u00e9 recently sold its U.S. and Canadian water brands to Blue Triton, a newly-formed company made up of private equity firms One Rock Capital Partners and Metropoulos &#038; Co.<\/p>\n<p>\u201cWe do not anticipate the sale of Nestl\u00e9 Waters North America to affect the enforcement action moving forward,\u201d Rizzardo told the Desert Sun. \u201cWhile ownership of Nestl\u00e9\u2019s parent company has changed, it\u2019s our understanding that its day-to-day operations and management has not changed.\u201d<\/p>\n<p><i>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
