The case, <em>New York State Rifle &#038; Pistol Association v. Corlett,\u00a0<\/em>will force the Court to decide whether or not Americans can be forced to prove the \u201cneed\u201d to carry a firearm for self-defense.<\/p>\n<p>Under New York law, a person must apply for a permit to carry but he or she must prove \u201cproper cause\u201d exists. New York is a \u201cmay issue\u201d state, meaning it\u2019s up to local law enforcement agencies \u2013 generally sheriffs departments \u2013 to determine whether or not a person\u2019s \u201cneed\u201d to carry a firearm is valid.<\/p>\n<p>This case is a follow-up to two other landmark Second Amendment cases:\u00a0<em>McDonald v. Chicago\u00a0<\/em>and\u00a0<em>District of Columbia v. Heller.\u00a0<\/em><\/p>\n<p><b>About the\u00a0<em>Heller\u00a0<\/em>decision<\/b><\/p>\n<p>In the 2008 landmark\u00a0<em>Heller\u00a0<\/em><a href=\"https:\/\/www.law.cornell.edu\/supct\/pdf\/07-290P.ZO\">decision<\/a>, the Supreme Court <a href=\"https:\/\/www.law.cornell.edu\/supct\/html\/07-290.ZS.html\">ruled<\/a> in a 5-4 decision that \u201cthe Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home.\u201d<\/p>\n<p>D.C. Special Police Officer Dick Heller brought the case before the Court because he believed the District\u2019s gun control laws were unconstitutional. At the time, D.C. prohibited residents from possessing handguns and carrying unregistered firearms. Heller applied for registration but was denied. The reason? D.C. prohibited handguns from being registered.<\/p>\n<p>The other area of concern was the District\u2019s law requiring gun owners to keep their registered long guns unloaded and disassembled or bound with a trigger lock, unless they were utilized at a place of business or used for recreational activities.<\/p>\n<p>\u201cAs we have said, the law totally bans handgun possession in the home. It also requires that any lawful firearm in the home be disassembled or bound by a trigger lock at all times, rendering it inoperable,\u201d Justice Antonin Scalia <a href=\"https:\/\/www.law.cornell.edu\/supct\/pdf\/07-290P.ZO\">wrote<\/a> in the majority opinion. \u201cAs the quotations earlier in this opinion demonstrate, the inherent right of self-defense has been central to the Second Amendment right. The handgun ban amounts to a prohibition of an entire class of \u201carms\u201d that is overwhelmingly chosen by American society for that lawful purpose. The prohibition extends, moreover, to the home, where the need for defense of self, family, and property is most acute.\u201d<\/p>\n<p>\u201cUnder any of the standards of scrutiny that we have applied to enumerated constitutional rights, banning from the home \u2018the most preferred firearm in the nation to \u2018keep\u2019 and use for protection of one\u2019s home and family,\u2019 would fail constitutional muster,\u201d he concluded.<\/p>\n<p><strong>About the\u00a0<em>McDonald\u00a0<\/em>decision<\/strong><\/p>\n<p>The 2010 landmark <em>McDonald\u00a0<\/em>decision reaffirmed the\u00a0<em>Heller\u00a0<\/em>decision. The Supreme Court <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/mcdonald-v-city-of-chicago\/\">concluded<\/a> in a 5-4 decision that the \u201cSecond Amendment right of individuals to keep and bear arms in self defense applies against state and local governments as well as the federal government.\u201d<\/p>\n<p>McDonald challenged Chicago\u2019s gun control laws that were similar to those addressed in the <em>Heller\u00a0<\/em>decision. The city of Chicago and the suburb of Oak Park argued their gun control laws were constitutional because the Second Amendment doesn\u2019t apply to states. The High Court disagreed.<\/p>\n<p>\u201cWe have previously held that most of the provisions of the Bill of Rights apply with full force to both the Federal Government and the States. Applying the standard that is well established in our case law, we hold that the Second Amendment right is fully applicable to the States,\u201d Justice Samuel Alito <a href=\"https:\/\/www.supremecourt.gov\/opinions\/09pdf\/08-1521.pdf\">wrot<\/a>e in the majority opinion.<\/p>\n<p><strong>About the <em>Corlett<\/em> case<\/strong><\/p>\n<p>When looking at concealed carry permits, there are two types of states: \u201cmay issue\u201d and \u201cshall issue.\u201d<\/p>\n<p>According to <a href=\"https:\/\/www.npr.org\/2021\/04\/26\/990846329\/supreme-court-to-take-up-first-major-gun-rights-case-in-more-than-a-decade\">NPR<\/a>, in a handful of states \u2013 California, Delaware, Hawaii, Maryland, Massachusetts, New Jersey, Rhode Island, and New York \u2013 a person applying for a permit to carry must prove they have a need to carry. Based on the applicant\u2019s reasoning, local law enforcement agencies can approve or deny an application, even if he or she passes a background check and has an understandable need.<\/p>\n<p>The remaining states are \u201cshall issue\u201d states, meaning a local sheriff will approve a person\u2019s permit to carry concealed as long as he or she passes a comprehensive background check. Some states have other requirements, like taking an instructional class and passing a range test. As long as those requirements are met, the applicant is granted a permit to carry.<\/p>\n<p>In the Corlett case, two of the petitioners, Robert Nash and Brandon Koch, were denied carry permits because of New York\u2019s \u201cmay issue\u201d stance.<\/p>\n<p>\u201cNash, for instance, requested to carry a handgun for self-defense after a string of robberies in his neighborhood. But he was denied because he did not demonstrate a special need for self-defense. Koch wanted a similar license, and he was able to cite his experience of participating in safety training courses,\u201d <a href=\"https:\/\/www.cnn.com\/2021\/04\/26\/politics\/supreme-court-second-amendment-case\/index.html\">CNN<\/a> reported. \u201cHe too was denied.\u201d<\/p>\n<p>The petitioners argued the Second Amendment protects a person\u2019s right to carry a firearm outside of the home. They believe New York\u2019s \u201cproper cause\u201d tramples on their Second Amendment rights.<\/p>\n<p>\u201cA small minority persists in denying the right to typical law-abiding citizens, instead of reserving self-defense rights to the small subset of individuals whom the state deems worthy,\u201d they argue. \u201cNew York is illustrative: It curtails fundamental, individuals self-defense rights. The governmental insistence upon a unique showing of <em>need\u00a0<\/em>ignores that the Second Amendment broadly guarantees rights to all \u2018the people.\u2019\u201d<\/p>\n<p><strong>Why it matters<\/strong><\/p>\n<p>This case could have a dramatic impact on a number of states, especially gun control havens like California, New Jersey, and New York. Should the Court follow prior precedent and rule along the lines of <em>Heller\u00a0<\/em>and <em>MacDonald<\/em>, Second Amendment rights could be expanded for millions of Americans.<\/p>\n<p><em>Beth Baumann is a Political Reporter and Editor at The Daily Wire.
