The killing took place inside a gated condominium complex shortly after 1:45 a.m. on Friday.<\/p>\n<p>According to the Sheriff\u2019s Department, the bail agent, Fabian Herrera, 36, \u201cwas not properly licensed and due to his criminal history, was prohibited from possessing firearms.\u201d He was arrested and booked for murder later that day. Herrera was reportedly found guilty in 2010 of felony assault with a deadly weapon that resulted in great bodily injury.<\/p>\n<p>Police said officers were initially dispatched to the area in response to a panic alarm activated inside a residence within the complex, followed by a call from the owner of that property indicating someone was attempting to break in.<\/p>\n<p>\u201c[Palm Springs Police Department] then received a third notification from a bail agent who said he was on scene of the same residence in question, with a subject he was trying to arrest,\u201d <a href=\"https:\/\/www.facebook.com\/PalmSpringsPD\/posts\/3877194662329607\">according<\/a> to the department\u2019s post on Facebook on Friday night. \u201cThe bail agent further reported that the subject was brandishing a knife and he needed emergency assistance.\u201d<\/p>\n<p>Authorities said when officers arrived, Spann refused to follow their instructions.<\/p>\n<p>\u201cA PSPD officer used a taser on the subject, but the subject still refused to comply,\u201d the post continued. \u201cThe bail agent fired his weapon, which resulted in the death of a 33-year-old male.\u201d<\/p>\n<p>Despite life-saving measures performed by the officers and medical personnel, Spann died at the scene. Police officers did not discharge any firearms. Because Palm Springs Police Officers were present at the time of the shooting death, investigators from the Riverside County Sheriff\u2019s Department Force Investigations Detail were called to assist in the investigation. PSPD said officers were wearing body cameras that \u201ccaptured the incident as it occurred,\u201d but the footage has not been released.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"9.6706948640483\">\n<p lang=\"en\" dir=\"ltr\">Palms Springs Police has requested our assistance with an incident in their area. Suspect is deceased. <a href=\"https:\/\/t.co\/FeaaAHQKS4\">pic.twitter.com\/FeaaAHQKS4<\/a><\/p>\n<p>\u2014 Riverside County Sheriff&#8217;s Dept (@RSO) <a href=\"https:\/\/twitter.com\/RSO\/status\/1385632928529408007?ref_src=twsrc%5Etfw\">April 23, 2021<\/a><\/p>\n<\/blockquote>\n<p>Spann\u2019s father, William Spann, a medical doctor from Washington state, spoke to The Desert Sun after the fatal shooting and accused PSPD of being \u201ccomplicit\u201d in his son\u2019s death, which he called \u201can unjustified killing.\u201d According to the outlet, \u201cthe elder Spann said his son had previously struggled with substance addiction and mental health issues.\u201d<\/p>\n<p>\u201cIf they wanted to tase anyone it should have been the bail bond agent,\u201d he <a href=\"https:\/\/www.desertsun.com\/story\/news\/2021\/04\/23\/police-sheriff-investigation-ongoing-east-via-escuela-palm-springs\/7349445002\/\">reportedly<\/a> said. \u201cThe police were aware of his mental illness because I had told them such more than once. He\u2019d been\u00a0arrested the day before along East\u00a0Vista Chino near Avenida Caballeros in Palm Springs on suspicion of violating a domestic violence\u00a0restraining order,\u00a0a misdemeanor.<\/em><\/p>\n<p><em>Court records show a bail bond was filed on April 6, in connection with the misdemeanor restraining order violation against Spann. He had no active warrants and had not failed to appear in criminal court. He had no other criminal cases filed against him in Riverside County.<\/em><\/p>\n<p><em>There is also no record that\u00a0his bond was revoked by the court. \u2026<\/em><\/p>\n<p><em>William Spann said he believed his son had been released on bail after a domestic dispute and was not facing further legal action.<\/em><\/p>\n<\/blockquote>\n<p>\u201cI\u2019m going to explore legal action against these people,\u201d Mr. Spann told The Desert Sun. \u201cI don\u2019t think you kill people for misdemeanors. I don\u2019t think you break into their house for misdemeanors. If that\u2019s true we\u2019re all at risk.\u201d<\/p>\n<p>According to The Desert Sun, Spann\u2019s father said Justice Bail Bonds in Temecula, California, had put forth three conditions for David\u2019s release: seek mental health treatment, wear an electronic monitor, and submit to random drug tests.<\/p>\n<p>Tony Romero, a neighbor in the complex, told News Channel 3 that he thought bail agents came to his door shortly before the shooting death.<\/p>\n<p>\u201cI come home, turn into the complex here where we live and a vehicle gets right behind me to follow me in and enter and it looked to me like a police undercover car,\u201d he said.<\/p>\n<p>Romero claimed a man and a woman spoke with his wife, asked questions about the complex layout, and wanted to know whether they knew Spann. According to News Channel 3, \u201ca short time after they left, Romero said he heard \u2018loud banging [and] shouting.\u2019\u201d<\/p>\n<p>Spann, who managed short-term vacation rentals in the desert resort city, is survived by a 4-year-old son and a 2-year-old daughter.<\/p>\n<p>Spann\u2019s mother, Sue Pearson, told The Desert Sun that her son had attended a child custody hearing on Thursday. She said she thought he was scheduled to appear in court for his misdemeanor criminal case this week. According to the outlet, \u201cit is unclear if the mother of David Spann\u2019s two children is the same person connected to the domestic dispute,\u201d adding, \u201cshe has not responded to a Desert Sun request for an interview.\u201d<\/p>\n<p>Barbara Limardo, another neighbor, <a href=\"https:\/\/kesq.com\/news\/2021\/04\/24\/rso-bail-agent-booked-for-murder-in-shooting-of-suspected-fugitive\/\">told<\/a> News Channel 3 that Spann \u201cspent a lot of time at the pool and with the kids,\u201d adding, \u201che never really caused any problems, he was pretty quiet.\u201d She speculated Spann had been struggling emotionally in his relationship with his wife, the outlet reported.<\/p>\n<p>\u201cI was surprised the way it turned out but I wasn\u2019t surprised because of where he was at emotionally, probably,\u201d said Limardo. \u201cI had just saw him that morning before I went to work so I was kind of sad to come back at the end of the day and know that, the next day, that he wasn\u2019t here anymore.\u201d<\/p>\n<p>Herrera is scheduled to appear in court on Wednesday, April 28.<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
