This is who they are now. Open borders. Outlawing voter ID. Free healthcare for illegal migrants. And now court packing. What the president doesn\u2019t have is the courage to come out and flatly tell the radical left that he\u2019s not going to pack the Supreme Court.\u201d<\/p>\n<p>Senator Marsha Blackburn of Tennessee added, \u201cJoe Biden and the radical left will destroy our institutions to seize power.&nbsp;This means eradicating the electoral college and the filibuster and packing the Supreme Court.\u201d<\/p>\n<p>Biden appears to have radically changed his position since 1983, when during a debate over whether Congress should permit President Ronald Reagan to replace members of the Commission on Civil Rights, he opposed the commissioners Reagan had nominated because he thought the Commission\u2019s image would be delegitimized, and likened it to Democratic President Franklin D. Roosevelt\u2019s attempt to pack the Supreme Court. He stated:<\/p>\n<blockquote readability=\"13\">\n<p><em>President Roosevelt clearly had the right to send to the United States Senate and the United States Congress a proposal to pack the court. It was totally within his right to do that. He violated no law. He was legalistically, absolutely correct. But it was a bonehead idea. It was a terrible, terrible mistake to make. And it put in question, if for an entire decade, the independence of the most significant body \u2014 including the Congress in my view \u2014 the most significant body in this country, the Supreme Court of the United States of America.<\/em><\/p>\n<\/blockquote>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"11.08\">\n<p lang=\"en\" dir=\"ltr\">1983: Sen. <a href=\"https:\/\/twitter.com\/JoeBiden?ref_src=twsrc%5Etfw\">@JoeBiden<\/a> calls FDR&#8217;s attempt to pack the Supreme Court a &#8220;bonehead idea.&#8221;<\/p>\n<p>&#8220;It was a terrible, terrible mistake to make, and it put in question there for an entire decade the independence of THE most significant body\u2026 in this country.&#8221; <a href=\"https:\/\/t.co\/MEPu0fMRG4\">pic.twitter.com\/MEPu0fMRG4<\/a><\/p>\n<p>\u2014 Washington Examiner (@dcexaminer) <a href=\"https:\/\/twitter.com\/dcexaminer\/status\/1380592689012383744?ref_src=twsrc%5Etfw\">April 9, 2021<\/a><\/p>\n<\/blockquote>\n<p>After winning reelection in 1936, Roosevelt proposed the Judicial Procedures Reform Bill of 1937, which would permit the president to appoint an additional justice to the U.S. Supreme Court, up to a maximum of six, for every member of the court over the age of 70 years and 6 months.Even Roosevelt\u2019s vice-president, John Nance Garner, opposed the plan and actually rallied the opposition to it.<\/p>\n<p>The Senate Judiciary Committee in 1937, which was controlled by Democrats, condemned Roosevelt\u2019s plan as \u201ca needless, futile and utterly dangerous abandonment of constitutional principle \u2026 without precedent or justification.\u201d<\/p>\n<p>As The Daily Wire&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/a-political-power-grab-biden-creates-commission-to-study-packing-the-supreme-court\">reported<\/a>:<\/p>\n<blockquote readability=\"6.8055555555556\">\n<p><em>Court packing is so toxic that even socialist Sen. Bernie Sanders (I-VT) does not support it and has&nbsp;<a href=\"https:\/\/www.reuters.com\/article\/us-usa-election-sanders\/u-s-senator-bernie-sanders-against-increasing-number-of-supreme-court-justices-idUSKCN1RD3AL\">warned<\/a>&nbsp;that if Democrats do it then \u201cthe next time the Republicans are in power they will do the same thing.\u201d<\/em><\/p>\n<\/blockquote>\n<p>Last week, Senate Minority Leader Mitch McConnell <a href=\"https:\/\/www.republicanleader.senate.gov\/newsroom\/press-releases\/mcconnell-on-court-packing-commission-disdain-for-judicial-independence-\">blasted the idea<\/a> after Biden\u2019s White House announced it was creating acommission to study packing the Supreme Court. McConnell said:<\/p>\n<blockquote readability=\"20\">\n<p><em>Today\u2019s announcement is a direct assault on our nation\u2019s independent judiciary and yet another sign of the Far Left\u2019s influence over the Biden Administration. Rational observers know well there is nothing about the structure or operation of the judicial branch that requires \u2018study.\u2019 &nbsp;Constitutional scholars and the justices themselves have repeatedly affirmed the position of the late Justice Ruth Bader Ginsburg: \u2018nine seems to be a good number.\u2019 Justice Breyer said just this week that \u2018structural alteration\u2019 like court packing would mean \u2018eroding\u2019 the public\u2019s trust in the judiciary. And by overwhelming margins, the American people agree. \u2026<\/em><\/p>\n<p><em>[A]nyone who was surprised by the creation of a commission on packing the Supreme Court simply hasn\u2019t been paying attention. This faux-academic study of a nonexistent problem fits squarely within liberals\u2019 years-long campaign to politicize the Court, intimidate its members, and subvert its independence. \u2026 this is just another example of the liberal preference for attacking norms and institutions, rather than working within them. When Democrats lose a floor vote, it\u2019s time to change Senate rules. When they lose a presidential election, it\u2019s time to abolish the Electoral College.
