According to Cahill, \u201cthere is nothing in the statement to indicate it was trustworthy which is required for it to be presented under an exception to the hearsay rule,\u201d Law &amp; Crime reported.<\/p>\n<p>Prosecution has made it clear that they do not want the statements from Hall to be heard by the jury; the state has even refused to grant Hall immunity in exchange for testimony. Nelson has requested that prosecution outline their decision to deny Hall immunity, but Cahill has denied the request.<\/p>\n<p>Last week it was reported that Hall was refusing to testify before the jury, invoking his Fifth Amendment right against self-incrimination. Hall\u2019s lawyer contends that her client\u2019s testimony could lead to a third-degree murder charge in the death of Floyd because of his alleged drug activity with the 46-year-old just before the arrest.<\/p>\n<p>Nelson has claimed that Hall gave drugs to Floyd before the incident and could testify on specifics about what went on in the Cup Foods, the alleged counterfeit money, and Floyd\u2019s apparent temporary inability to wake up after he ingested Percocet pills.<\/p>\n<p>\u201cThis will include evidence that while they were in the car, Mr. Floyd consumed what were thought to be two Percoset [sic] [painkiller] pills,\u201d Nelson said during his opening statement, ABC News <a href=\"https:\/\/abcnews.go.com\/US\/man-car-george-floyd-day-died-testify\/story?id=76897872\">reported<\/a>. Floyd, Hall, and Floyd\u2019s ex-girlfriend were sitting in a Mercedes Benz SUV before the events of the day further unrolled.<\/p>\n<p>\u201cMr. Floyd\u2019s friends will explain that Mr. Floyd fell asleep in the car and that they couldn\u2019t wake him up to get going, that they thought the police might be coming because now the store [employees] were coming out,\u201d Nelson continued.<\/p>\n<p>Hall\u2019s lawyer, Adrienne Cousins, has filed a motion attempting to block subpoenas from both the prosecution and defense teams.<\/p>\n<p>\u201cYour honor, I cannot envision any topic that Mr. Hall would be called to testify on that would be both relevant to the case that would not incriminate him,\u201d Cousins <a href=\"https:\/\/abcnews.go.com\/US\/man-car-george-floyd-day-died-testify\/story?id=76897872\">told<\/a> Judge Cahill last Tuesday. \u201cMr. Hall\u2019s testimony in these matters would specifically put him in the position of being in very close proximity to Mr. Floyd, in a vehicle where drugs were found during a search by police following Floyd\u2019s death.\u201d<\/p>\n<p>The assistant Hennepin County public defender argued her client\u2019s testimony could be a&nbsp;\u201clink in the chain\u201d to Floyd\u2019s death, leaving Hall open to a third-degree murder charge.<\/p>\n<p>As highlighted by <a href=\"https:\/\/www.dailywire.com\/news\/george-floyds-girlfriend-floyd-hospitalized-for-overdose-months-earlier-drug-dealer-with-him-during-arrest\">The Daily Wire<\/a>, Nelson has strongly argued that drugs played a crucial role in Floyd\u2019s death.
