In 19 states and the District of Columbia, a family member, colleague, or law enforcement officer <a href=\"https:\/\/www.nssf.org\/wp-content\/uploads\/2020\/06\/NSSF-Factsheet-Red-Flag.pdf\">can petition<\/a> the court to remove a person\u2019s firearms if they believe the person is at risk of harming themselves or others. The problem, however, is the court makes the determination without the person in question appearing before a judge. This is known as an ex parte decision order.<\/p>\n<p>\u201cAll fifty states currently have civil commitment procedures and many lack basic due process protections,\u201d the NRA <a href=\"https:\/\/www.nraila.org\/get-the-facts\/emergency-risk-protection-orders-erpos\/\">said in a fact sheet<\/a> on the issue. \u201cThis is unacceptable. The NRA believes that no one should be deprived of a fundamental right without due process of law.\u201d<\/p>\n<p>\u201cThe ERPO laws in place provide for some level of due process. Whether the due process provided in those laws is constitutionally adequate for the deprivation of a fundamental civil liberty and constitutional rights is a serious concern,\u201d the NSSF <a href=\"https:\/\/www.nssf.org\/wp-content\/uploads\/2020\/06\/NSSF-Factsheet-Red-Flag.pdf\">previously<\/a> stated.<\/p>\n<p>It\u2019s that very part of Red Flag laws that has Loesch alarmed.<\/p>\n<p>\u201cWe\u2019re talking about the issue of due process. It\u2019s more than just Second Amendment rights,\u201d Loesch told The Daily Wire. \u201cWe\u2019re also looking at due process which is a cornerstone of our republic.\u201d<\/p>\n<p>\u201cWhile I think all of [Biden\u2019s executive orders on gun control] are troubling, I think the issue with Red Flag laws, I think that\u2019s incredibly troubling because of the precedent it\u2019s going to establish. Firearms are just the variable here. It becomes about more than just firearms,\u201d she explained. \u201cCan we substitute firearms with anything in that particular position and see a lack of due process? We live in this era where we\u2019re criticizing policing and criticizing the policing system, why in the world would we do that \u2026 by removing due process?\u201d<\/p>\n<p>The radio host argued that those who are \u201chellbent\u201d on carrying out a crime will do so, regardless of what their weapon of choice is.<\/p>\n<p>\u201cPenalties are given and property is seized. If it\u2019s about neutralizing a dangerous person, [Red Flag laws] are just removing the tools for them,\u201d Loesch said. \u201cThere is nothing more serious than the tragedy of murder but the idea of penalizing people<em> then<\/em> seizing property, <em>then<\/em> maybe in three weeks \u2013 sometimes it\u2019s months \u2013 they issue a court date, where are the protections? There are no protections. What kind of protections are there for people to clear their name? There\u2019s a rush to remedy the situation.\u201d<\/p>\n<p>Biden\u2019s executive action focuses on cracking down on \u201cghost guns\u201d and providing guidance on Red Flag laws. The Justice Department also has 60 days to redefine a stabilizing brace as a \u201cshort barreled rifle,\u201d meaning it would be regulated under the National Firearms Act.<\/p>\n<p>During that same press conference, Biden also announced David Chipman as his pick for ATF Director, despite his <a href=\"https:\/\/www.dailywire.com\/news\/bidens-pick-for-atf-director-has-a-questionable-past-that-deserves-a-second-look\">questionable past<\/a>, which <a href=\"https:\/\/www.dailywire.com\/news\/records-indicate-bidens-pick-for-atf-director-was-a-registered-gun-control-lobbyist\">included<\/a> working as a lobbyist for Everytown for Gun Safety, a gun control organization.<\/p>\n<p><em>Beth Baumann is a Political Reporter at The Daily Wire.
