Gore, is often referred to as an example of its favoritism of conservative causes,\u201d he later added. \u201cBut the court did not hear or decide cases that affected the political disagreements arising out of the 2020 Trump v. Biden election. It did uphold the constitutionality of Obamacare, the health care program favored by liberals,\u201d Breyer said in noting some of the things that the court has sided with liberals on. \u201cIt did re-affirm precedents that favored a woman\u2019s right to an abortion. It did find unlawful certain immigration, census, and other orders, rules, or regulations, favored by a conservative president.\u201d<\/p>\n<p>A recent <a href=\"https:\/\/www.msnbc.com\/opinion\/i-m-convinced-justice-stephen-breyer-should-retire-supreme-court-n1263399\">op-ed for MSNBC<\/a> lamented Breyer\u2019s position and called on him to step down from the bench so Biden can replace him, fearing another Ruth Bader Ginsburg incident.<\/p>\n<p>\u201cFirst, where on Earth has he been over the past two decades as the Supreme Court delivered one partisan decision after another? Napping? Sen. Sheldon Whitehouse, D-R.I., a member of the Judiciary Committee, <a href=\"https:\/\/twitter.com\/SenWhitehouse\/status\/1379897838939738112\" target=\"_blank\" rel=\"noopener noreferrer\">has tallied<\/a> \u201980 5-4 partisan decisions by Republican Justices giving victories to big Republican donor interests\u2019 in the 15 years <a href=\"https:\/\/www.acslaw.org\/issue_brief\/briefs-landing\/a-right-wing-rout-what-the-roberts-five-decisions-tell-us-about-the-integrity-of-todays-supreme-court\/\" target=\"_blank\" rel=\"noopener noreferrer\">since Chief Justice John Roberts was sworn in<\/a> in 2005. Does Breyer really believe these rulings \u2014 in which he dissented! \u2014 were all guided by \u2018legal principle, not politics\u2019?\u201d lamented Mehdi Hasan.<\/p>\n<p class>\u201cAs for \u2018confidence\u2019 in the Supreme Court, how about the fact that a <a href=\"https:\/\/www.msnbc.com\/opinion\/democracy-isn-t-gop-s-side-why-should-they-pretend-n1243423\" target=\"_blank\" rel=\"noopener noreferrer\">majority of the nine justices<\/a>&nbsp;were appointed by presidents who&nbsp;<a href=\"https:\/\/apnews.com\/article\/AP-explains-elections-popular-vote-743f5cb6c70fce9489c9926a907855eb\" target=\"_blank\" rel=\"noopener noreferrer\">lost the popular vote<\/a>? Or that one of those five, Neil Gorsuch, is sitting in a&nbsp;<a href=\"https:\/\/www.nytimes.com\/2017\/01\/31\/opinion\/neil-gorsuch-the-nominee-for-a-stolen-seat.html\" target=\"_blank\" rel=\"noopener noreferrer\">blatantly stolen seat<\/a>? Or that two of the nine justices, Brett Kavanaugh and Clarence Thomas, have been credibly accused of&nbsp;<a href=\"https:\/\/www.nytimes.com\/2018\/09\/20\/us\/politics\/anita-hill-testimony-clarence-thomas.html\" target=\"_blank\" rel=\"noopener noreferrer\">sexual<\/a>&nbsp;<a href=\"https:\/\/www.nbcnews.com\/think\/opinion\/allegations-against-brett-kavanaugh-are-not-simply-he-said-she-ncna910771\" target=\"_blank\" rel=\"noopener noreferrer\">misconduct<\/a>?\u201d continued Hasan.<\/p>\n<p class>On Breyer\u2019s position regarding the far-left\u2019s desire to pack the court, Hasan put forth the idea that Republicans have already packed the Supreme Court.<\/p>\n<p class>\u201cWhy did he not say this to conservatives in 2016? When Republicans led by McConnell, R-Ky., <a href=\"https:\/\/time.com\/4731066\/neil-gorsuch-confirmation-record-vacancy\/\" target=\"_blank\" rel=\"noopener noreferrer\">reduced<\/a> the Supreme Court from nine to eight justices for 14 months \u2014 between Scalia\u2019s death and Gorsuch\u2019s confirmation \u2014 did that not count as \u2018structural alteration\u2019?\u201d asked Hasan. \u201cHow else to describe the <a href=\"https:\/\/www.washingtonpost.com\/news\/powerpost\/wp\/2016\/03\/16\/republicans-refuse-to-budge-following-garland-nomination-to-supreme-court\/\" target=\"_blank\" rel=\"noopener noreferrer\">refusal<\/a>&nbsp;to even consider President Barack Obama\u2019s nominee for the vacant seat? Or Republican Sen. Ted Cruz\u2019s&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/news\/post-politics\/wp\/2016\/10\/26\/cruz-says-theres-precedent-for-keeping-ninth-supreme-court-seat-empty\/\" target=\"_blank\" rel=\"noopener noreferrer\">suggestion<\/a> in October 2016 to keep the court at fewer than nine justices for four more years if Hillary Clinton won the presidential election?\u201d<\/p>\n<p class>\u201cIt feels odd for me to have to remind a sitting justice that nowhere in the Constitution does it say there should be nine justices on the court. The court\u2019s own website <a href=\"https:\/\/www.supremecourt.gov\/about\/faq_general.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">says<\/a>, \u2018The Constitution places the power to determine the number of Justices in the hands of Congress,&#8217;\u201d Hasan continued. \u201cIn fact, if Biden does eventually yield to pressure from <a href=\"https:\/\/www.mcclatchydc.com\/news\/politics-government\/white-house\/article248674405.html\" target=\"_blank\" rel=\"noopener noreferrer\">liberal activists<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.forbes.com\/sites\/mattperez\/2020\/09\/20\/democratic-lawmakers-float-idea-to-expand-supreme-court-if-republicans-fill-vacancy-before-election\/?sh=224b8bec4f15\" target=\"_blank\" rel=\"noopener noreferrer\">Democratic lawmakers<\/a>&nbsp;and decides to change the size of the court, backed by a congressional majority, he will be following in the footsteps of&nbsp;<a href=\"https:\/\/www.fox13memphis.com\/news\/trending\/supreme-court-changing-number-justices-not-new-idea\/CUTZV643QNDJRIDQK6OBDGA2DY\/\" target=\"_blank\" rel=\"noopener noreferrer\">five previous presidents<\/a> \u2014 history-makers like John Adams, Thomas Jefferson, Andrew Jackson, Abraham Lincoln, Ulysses S.
